20 - Master Thoroughfare Plan Amendment from a Major Collector Roadway an Arterial Roadway North of Jefferson Road from SE Loop 286 to Collegiate DriveItem No. 20 TO: Mayor, Mayor Pro -Tem and City Council Grayson Path, City Manager FROM: Andrew Mack, AICP Director Planning & Community Development SUBJECT: Public hearing to consider and take action regarding the petition of Nathan Spaulding on behalf of Benton Rainey for a Master Thoroughfare Plan Amendment from a Major Collector Roadway to an Arterial Roadway North of Jefferson Rd. from SE Loop 286 to Collegiate Dr. MTG. DATE: July 25, 2022 BACKGROUND At its meeting held on July 5, 2022, the Planning & Zoning Commission recommended approval of this developer initiated change to the Master Thoroughfare Plan. The Planning & Zoning Commission, City Council, Staff and Developer have reviewed the new proposed master planned development known as the Forestbrook Estates during a recent work session held in the past couple of months. The current thoroughfare plan calls for a collector street system supporting the residential development of the site. The plan, however, does not extend easterly to SE Loop 286 incorporating the old railroad bed that went back to the land owner once abandoned years ago. This affords 80 ft. of ROW fronting along SE Loop 286 which is sufficient width for a Major Arterial Roadway. The developer has worked with staff to incorporate this upgraded roadway plan into the Planned Development to accommodate higher density residential and commercial development, along with a proposed school site and parkland further to the North end of this nearly 200 acre land area for the development. Further to the West the current plan also calls for the extension of the roadway through the City's ballfields at the Civic Center Park area and into low lying wetland areas. None of this makes any sense from an actual standpoint of actually construction the roadway some day with a goal of connecting New Jefferson at Collegiate with Loop 286 to support new development in this area inside the Loop and beyond. Accordingly the developer has petitioned to amend the thoroughfare plan to support the mixed use master planned community. This was the subject of a recent joint work session with the developer, P&Z and City Council. This change in the thoroughfare plan makes very good sense from a planning perspective as the community seeks to grow to the undeveloped areas of the Southeast portion of the city. It will also create another major east -west route south of Lamar and Clarksville without reliance on the Loop system. It would also be considered as a future TX DOT roadway if the City and developer can agree on how to collectively pay for its new construction. A meeting has been planned with the developer, adjacent property owner and TX DOT to further discuss this plan and requirements for a developer initiated Traffic Impact Analysis (TIA) for connection of all roads in the development to the TX DOT Trunk Highway System. Continued discussions between the developer and staff are on-going with regard to how this will be constructed and paid for. Continued discussions on this subject will be held during and after the City Council Meeting regarding implementation of this Thoroughfare Plan Amendment to serve the proposed development and beyond. RECOMMENDATION Staff recommends approval of the Minor Amendment to the Master Thoroughfare Plan from a Major Collector Roadway to an Arterial Roadway North of Jefferson Rd. from SE Loop 286 to Collegiate Dr. Oft-PIRANCE NO. WHEREAS, the proposed collector street is insufficient for the planned development of this site, and an Arterial Roadway would better suit said development; and WHEREAS, the developer has petitioned to amend the thoroughfare plan to sup ort the mixed use master ilanned communitv creatinE,� another major e 11#14RIJRRMIR'141� M, 11;"Vllmm�l roensidered a future TXDoT roadway if the City and developer can agree on how to collectively pay for the new construction; and WHEREAS, at its July 5, 2022 meeting, after conducting a public hearing, the Planning and Zoning Commission recommended approval of the minor amendment to the Master Thoroughfare Plan upsizing the Major Collector Roadway to an Arterial Roadway; and WHEREAS, at the July 25, 2022 meeting of the Paris City Council, the City Council, after conducting a public hearing, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing approves a minor amendment to the Master Thoroughfare Plan from a Major Collector Roadway to an Arterial Roadway North of Jefferson Rd. from SE Loop 286 to Collegiate Dr.; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY JIF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That a Minor amendment to the Master Thoroughfare Plan from a Major Collector Roadway to an Arterial Roadway North of Jefferson Rd. from SE Loop 286 to Collegiate Dr. be approved. Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 5. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above -enumerated sections shall constitute and be deemed a separate offense. Section 7. This ordinance shall become effective from and after its passage and publication as required by law.
