1985-071-RES WHEREAS, the City of Paris did heretofore in Resolution No. 84-053 authorize contracting with Withers
RESOLUTION NO. 85-071
WHEREAS, the City of Paris did heretofore in Resolution
No. 84-053 authorize contracting with Withers Land Forming,
Inc., for the execution of the Landfill Closure And Flow
Equalization Basin Site Development Project; and,
WHEREAS, an abnormal amount of rainfall during the
month of October 1984, rainfall during the month of November
and December 1984, rainfall, snow and ice during the month
of January and February 1985, delayed adequate progress in
the execution of excavation and placement of landfill cover,
and necessitated the granting of a time extension for the
completion of the cover placement phase of the landfill
closure work in the amount of 51 calendar days; the date for
substantial completion of the entire project is increased by
49 days due to weather and additional items of construction
added to the project; overhaul outside anticipated project
limits added an additional cost of $6,883.00; adding
drainage to the site to relieve trapped water required
approximately 400 feet of 24" drainage pipe, requiring an
additional cost of $3,300.00; and the time of year that
seeding was accomplished required a change in the type of
seed which brought about a unit price increase for seeding
from $101.53 to $106.19 which in all brings about a change
in the total contract price to $437,012.99; as shown in
Change Order No. 4 attached hereto as Exhibit A, which
should be approved; NOW THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, That Change Order No. 4 to City of Paris contract
with Withers Land Forming, Inc., is hereby approved; and,
BE IT FURTHER RESOLVED THAT George Fisher, Jr., Mayor
of the City of Paris, be, and he is hereby authorized and
directed to execute said Change Order on behalf of the City
of Paris.

The following changes <He hereby made to the Contract Documents:
1. CHANGE TO CONTRACT PRICE
1.1 Extra of $6,883.00 for overhaul outside anticipated project limits.
1.2 Extra of $3,300.00 for installing approximately 400 feet of 24" drainage
pipe to drain water trapped on property south of project site.
1.3 Unit price for seeding is changed from $101.53 to $106.19 to compensate
for change in specified seed. Total acres to be seeded is increased to
161.1 acres. All sprigging is deleted.
New Total Contract Price:$437,012.99
2. CHANGE TO CONTRACT TIME
2.1 The contract time for the completion of the cover placement phase of the
landfill closure work will be increased by ~ calendar days.
The date for completion of the cover placement phase of the landfill
closure work will be June 18, 1985.
2.2 The date for substantial completion of the entire project is increased by
49 calendar days. The date for substantial completion of the entire
project will be June 18, 1985.
