1984-006 - quit claim deed, 36th N.W. StreetRESOLUTION NO. 84 -006
WHEREAS, it has been called to the attention of the
City Council of the City of Paris that there is a street
beginning approximately 130 feet South of the South
Right -of -way line of West Houston Street and running South
for approximately 130 feet, known as 36th N. W. Street; and,
WHEREAS, it has been called to the attention of the
City Council that the street is not desired by the property
owner adjacent to said street, but that said street is of use
and necessary to the City of Paris and its citizens for
utility easement purposes; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the Mayor of the City of Paris, Joe Graham, be,
and he is hereby authorized to execute a quit claim deed to
the street being closed to the adjacent owners on either side
of said street, it appearing that Jim F. Kirby and J.
Michael Henderson are the sole and only property owners
adjacent to said street;
BE IT FURTHER RESOLVED, that the City of Paris retain a
utility easement in the area to be described in the above
described quit claim deeds.

That the CITY OF PARIS, PARIS, TEXAS, a municipal
corporation, of Lamar County, Texas, acting by and through
its Mayor, Joe Graham, duly authorized by Resolution
No. 84 -006 for and in consideration of the sum of TEN AND
N01100 DOLLARS ($10.00), cash, and other good and valuable
consideration, to it in hand paid by Jim F. Kirby and J.
Michael Henderson, of Paris, Lamar County, Texas, the
receipt and sufficiency of which is hereby acknowledged,
does by these presents, bargain, sell, release and forever
quit claim unto the said Jim F. Kirby and J. Michael
Henderson, its successors and assigns, all its right, title
and interest in and to that certain tract or parcel of land
situated in the County of Lamar and State of Texas,
described as follows, to -wit:
Situated within the corporate limits of the
City of Paris, Lamar County, Texas, a part of the
Issac Cruise Survey and being part of the Street
Right -of -way dedication to the City of Paris,
Texas, by Final Plat, by owner R. E. Hickman,
dated January 19, 1965, recorded in envelope No.
172 -D, Plat Records, Lamar County, Texas;
BEGINNING at a point for corner in the West
Right -of -way line of 36th Street N. W., said point
located South 0° 25' West, a distance of 130 feet
from the South Right -of -way line of West Houston
Street, said point also being the Southeast corner
of Lot 1, Block D, of the Westwood Addition;
THENCE South 0 °25' West, along the West
Right -of -way line of 36th Street N. W., a distance
of 130 feet to a point for corner;
THENCE South 89° 35' East along the South
Right -of -way line of 36th Street N. W., a distance
of 50 feet to a point for corner;
THENCE North 0° 25' East along the East Right
of -way line of 36th Street N. W., a distance of
130 feet to a point for corner, said point being
the Southwest corner, of Lot 9, Block B, of the
Westwood Addition;
THENCE North 890 35' West along a line which
is parallel to and 130 feet South of the South
Right -of -way line of West Houston Street to the
place of beginning and containing 0.1492 acres of
land more or less.

SAVE AND EXCEPT a utility easement is retained by
Grantor to the above described property, which utility
easement gives the right and privilege to Grantor of placing
utilities above, on and over said easement and the right to
maintain any and all utilities placed therein.
TO HAVE AND TO HOLD the said premises, together with
all and singular the rights, privileges and appurtenances
thereto in any manner belonging unto the said Jim F. Kirby
and J. Michael Henderson, their heirs and assigns forever,
so that neither it, the said CITY OF PARIS, PARIS, TEXAS,
nor its successors or assigns, nor any other person or
persons claiming under it shall, at any time hereafter,
have, claim or demand any right or title to the aforesaid
premises or appurtenances, or any part thereof.
