WHEREAS, Ordinance No. 2424 adopted on final passage
December 11, 1978, granted to Midwest Video Corporation a
franchise to use specified public facilities for business
related purposes; and,
WHEREAS, provisions of Ordinance 2424 provided, in
part, as follows: Section 3 "that the service furnished
and provided hereunder to said City and its inhabitants
shall be first class in all respects... ". Section 4 "the
City of Paris shall have the right to fix the rates to be
charged by the grantee herein by ordinance ... "; and,
WHEREAS, Ordinance 2538 passed November 10, 1980,
granted Midwest Video Corporation authority to charge
certain specified rates; and,
WHEREAS, one of the reasons given for the need of the
rate structure authorized in Ordinance 2538 was to estab-
lish adequate fiscal resources to allow system improvement
and maintenance of "first class" service; and,
WHEREAS, complaints received by members of the City
Council of the City of Paris, as well as their own observa-
tion caused such members to question whether or not the
service being provided by Midwest Video Corporation is
"first class in all respects "; and,
WHEREAS, the matter was discussed with representatives
of Midwest Video Corporation in a regularly scheduled City
Council meeting on September 12, 1983, at which time such
representatives agreed service provided by Midwest Video
corporation was not "first class in all respects "; and,
WHEREAS, such representatives agreed to improve service
to a "first class" level and to report back to the City
Council on December 12, 1983; and,
WHEREAS, at a regular Council meeting on January 9,
1984, representatives of Midwest Video Corporation reported
to the City Council that although system improvements had
been made, service provided by Midwest Video Corporation
still was not "first class in all respects "; and,
WHEREAS, the City Council believes that the rates
authorized by Ordinance 2538 were reasonable for service
provided by Midwest Video Corporation if it is "first class
in all respects "; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, that the City Council of the City of Paris, Paris,
Texas does hereby find that there is sufficient reason to
question whether or not the quality of service provided by
Midwest Video Corporation is a failure to comply with the
terms of its franchise or is "first class in all respects"
and therefore justifying the rates authorized by Ordinance
2538 and does hereby call a public hearing for 5:15 o'clock
P.M. on the 21st day of February, 1984 to be held in the
Council room, City Hall, Paris, Texas to hear evidence
concerning such service.
BE IT FURTHER RESOLVED, that by copy of this Resolution
being delivered to the Office of Midwest Video Corporation
in Paris, Texas, such Midwest Video Corporation is notified
to show cause, if any it has why its franchise should not be
repealed or why its rates should not be decreased.
