1984-041-RES WHEREAS, the City Council of the City of Paris did heretofore in Resolution 83-06l, passed on the 12th RESOLUTION NO. 84-04l WHEREAS, the City Council of the City of Paris did heretofore in Resolution 83-06l, passed on the 12th day of September, 1983, approve the form of a hanger lease, which was attached thereto as Exhibit A, and a tie down space rental agreement, which was attached thereto as Exhibit B; and, WHEREAS, the City Council is of the opinion that said lease agreement should be amended to conform with Exhibit A attached hereto; and, WHEREAS, the City Council is of the opinion that the heretofore approved tie down agreement is not desired for use at Paris Cox Field at this time and should be withdrawn; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the - hanger lease form, attached hereto as Exhibit A, is hereby approved and amends Exhibit A of Resolution No. 83-061; and, BE IT FURTHER RESOLVED that Exhibit B of Resolution No. 83-06l, be, and the same is hereby repealed and deleted therefrom. A. In consideration of the payment of $ per month, payable on the first day of each month, CITY agrees to let, on a month to month basis, the above designated Hanger Space No. , at the Cox Field Airport, hereinafter called AIRPORT, subj ect to the conditions and covenants herein contained, and to be used for the following: 1. LESSEE agrees to notify Airport Manager, in writing, within ten (10) days, of any change in the information furnished herein. 2. LESSEE agrees to accept all facilities on the leased premises in the condition in which they are found. CITY hereby disclaims and LESSEE hereby accepts CITY'S disclaimer of any warranty, express or implied, of the condition or fitness of the premises or the tie-down apparatus. 5. LESSEE shall furnish such equipment as may be necessary to property secure his aircraft. LESSEE agrees to be solely responsible for setting EII/IS,T Ii ') ') brakes, placing chocks, tying down or otherwise securing his aircraft. 6. LESSEE covenants and agrees that he will not hold CITY or any of its agents responsible for any loss occasioned by fire, theft, rain, windstorm, hail, or any other cause whatsoever, whether said cause be the direct, indirect, or merely a con- tributing factor in producing the loss to any airplane, automobile, personal property, parts or surplus that may be located or stored in the hangers, offices, aprons, field, or any other location at the airport; and LESSEE agrees that the aircraft and its contents are to be stored at airport; and LESSEE agrees that the aircraft and its contents are to be stored at LESSEE I S risk whether on the field or in the hangers, not withstanding the aforesaid LESSEE does not forfeit the rights that other members of the flying public have. 7. LESSEE agrees to indemnify, defend, hold harmless the CITY, its agents, officers, and employees, from and against any and all liability or loss resulting from claims or court action arising directly or indirectly out of the acts of LESSEE, his agents, servants, guests, or business visitors under this agreement or by reason of any act or omission of such person arising from any use of the airport premises and/or facilities. 8. LESSEE agrees that in the event of any misrepresentation or default by LESSEE regarding any of the obligations of this agreement CITY may impound all aircraft and padlock all facilities of LESSEE herein leased. LESSEE further covenants and agrees that LESSEE will, upon failure to pay the rental hereinabove agreed upon, yield up unto CITY all and singular the leased premises in good condition, reasonable use and wear and tear accepted; LESSEE further covenants and agrees that if LESSEE shall fail to pay the rental hereinabove agreed upon, CITY may lawfully at any time there- after, after five (5) days written notice by depo~iting in the U.S. Mail addressed to the last known address of LESSEE, enter upon the leased premises or any part thereof and remove LESSEE 's aircraft thereform, forcibly if necessary, without being taken or deemed guilty of any manner of trespass, and without liability on the part of the CITY of any kind or nature whatsoever, and without prejudice to any legal remedies which might otherwise be used by CITY for possession of said premises or for arrears of rent, and that upon entry aforesaid the rights of LESSEE under this lease shall cease. 9. CITY may terminate this agreement with cause on delivery of written notice to the LESSEE at his last know address and upon refunding to LESSEE a pro rate amount of the storage charges heretofore provided for the unexpired portion of the month following the date of such termination; and upon such termination, the LESSEE shall immediately remove said aircraft from the Airport. lOr Airport Manager shall have the right to enter said premises at any time for inspection or repairs, additions or alterations necessary for the safety, improvement, or preservation of the leased premises. LESSEE hereby acknowledges receipt of a copy of this agreement and a copy of Article I of Chapter 6 Code of Ordinances of the City of Paris and a copy of Federal Aviation Agency Air Traffic Service, effective August 27, 1962 as amended, Rules and Regulations of the Airport, said Rules and Regulations being specifically incorporated by reference as though fully set forth herein, and agrees that he shall be bound thereby.
