1984-023 - Project plan for projects entitled landfill closure and I & I Flow Equalization Basin ProjectstRESOLUTION NO. 84 -023 WHEREAS, the City Council of the City of Paris has received a project plan for projects entitled Landfill Closure and I & I Flow Equalization Basin Projects which, if approved, will be described in plans and specifications prepared by the City of Paris Department of Engineering and consultants as needed and approved under said departments direction; and, WHEREAS, the project consists of two phases. Phase I being the landfill closure directed by the Judgment entered on the 26th day of September, 1983 in Cause No. 49477 in the 6th Judicial District Court of Lamar County, Texas. Phase II is the construction of the I & I Flow Equalization Basin, consisting of pump station and piping for the purpose of eliminating the by -pass overflow into Pine Creek as directed in EPA Order on Consent authorized in Resolution No. 84 -017; and, WHEREAS, the property descriptions of the property required for the completion of said projects are shown on Exhibit A attached hereto; and, WHEREAS, the City Council finds that the property described on Exhibit A attached hereto as five tracts and one temporary easement are necessary for said ordered projects and that the same should be condemned; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the City Attorney, T. K. Haynes, be, and he is hereby authorized and directed to proceed with the aid of outside counsel to condemn the above described property to be used for Phase I and Phase II of the Landfill Closure and I & I Flow Equalization Basin Projects.
