Chairman Clifton Fendley called the meeting of the Planning & Zoning Commission to order at 5:30 p.m. Commissioners Present: Francine Neeley, Chance Abbott, Clifton Fendley, Austin Anthony, Michael Mosher, Sims Norment Commissioner Absent: Tylesha Ross -Mosley 2. Citizens' forum. (Persons desiring to address the Planning and Zoning Commission must limit their presentation to no more than two minutes. Unless an item is posted on the Agenda, the Texas Open Meetings Act prohibits the Commission from responding to any comments other than to refer the matter to a future agenda, to an existing policy, or to a staff person with specific factual information. Claims against the City, Council Members, or employees, as well as individual personal appeals are not appropriate for citizens' forum.) The citizen's forum was declared open. Richard Thompson, 3206 Bonham asked about FEMA study for item 13. The Chairman advised City staff would address this when we get to that item. With no one else speaking, the forum was declared closed. Approve minutes from the meeting of August 01, 2022. A motion to approve the minutes for the August 01, 2022 meeting was made by Sims Norment, seconded by Austin Anthony. Motion carried 6-0. 4. Public hearing to consider and take action regarding the petition of Bruce Pearson for a Comprehensive Plan Amendment from Public Lands & Institutions (PLI) to Medium Density Residential (MDR) in the City of Paris, Block 127, Part of Lot 3, containing 125 ft. of LCAD 16081 +/- 0.84 Acre (35,380 sf) located in the 800 Block of W Kaufman St. Mack presented the item to commissioners stating staff recommends approval of the change from PLI to MDR for guiding the rezoning of new multi -family dwelling units consistent with the comprehensive plan. The public hearing was declared open. With no one speaking, the public hearing was declared closed. A motion to approve the Comprehensive Plan Amendment was made by Austin Anthony, seconded by Chance Abbott. Motion carried 6-0. 5. Public hearing to consider and take action regarding the petition of Bruce Pearson for a change in zoning from a Commercial District (C) to a Multi -Family District No. 1 (MF - 1) in the City of Paris, Block 127, Part of Lot 3, containing 125 ft. of LCAD 16081 +/- 0.84 Acre (35,380 sf) located in the 800 Block of W Kaufman Street. Mack presented the item to commissioners with staff recommendation to approve the request. The public hearing was declared open. With no one speaking, the public hearing was declared closed. A motion to approve the zoning change was made by Austin Anthony, seconded by Francine Neeley. Motion carried 6-0. Public hearing to consider and take action regarding the petition of Asay & Sons Construction, LLC for a change in zoning from a Two -Family Dwelling District (2F) to a Four -Family Dwelling District (4F) in the City of Paris, Block 32-B, Lot 1-A thru 1-K, located in the 1000 Block of Pine Bluff Street-LCAD 13823. Mack advised there is no presentation, public hearing nor action to be taken on this item at this time due to a technical error. The public hearing will be opened and held over to the special P&Z meeting scheduled for Tuesday, September 13, 2022. The public hearing was declared open. No action at this time. Consideration of and action on the Final Plat of the PUD 61 Addition, Lot 1, Block A, LCAD Property 14462, located at 455 NE 6th Street. Mack presented the item to commissioners stating that engineering has reviewed the final plat and recommends approval with the following conditions: 1. All preliminary plat comments shall be satisfactorily addressed (Chapter 9, Exhibit A, Section V). 2. The field notes do not match the dimensions listed on the plans. In the fourth paragraph, "Thence S 89°39'02 " W with the South.... " Does not match the bounds "S 89°32'02" W. " One of these shall be selected and corrected (Chapter 9, Exhibit A, Section V(7)). 3. Please note the minimum finished floor elevation (Chapter 9, Exhibit A, Section V (8)). 4. The dedication of additional ROW along 6th St NE shall be adjusted. The owner of this property currently owns property up to the existing 40' ROW, and so this shall be indicated on the plans with a line and found or set pins. Then, the 5' dedication shall be noted with an additional set of pins and a solid line on the plans (as currently shown.) The plans shall show both the existing property boundary and the dedicated area for ROW (Chapter 9, Exhibit A, Section V (9)). A motion to approve the final plat with conditions was made Sims Norment, seconded by Michael Mosher. Motion carried 6-0. Consideration of and action on the Final Plat of the Warren 174-A Addition, Lot 1, Block A, LCAD Property 16781, located at 1202 Martin Luther King Jr. Blvd. Mack presented the item to commissioner stating that engineering has reviewed the final plat and recommends approval. A motion to approve the final plat was made by Austin Anthony, seconded by Francine Neeley. Motion carried 6-0. 9. Consideration of and action on the Preliminary Plat of the Park Place Addition C1398, Lots 1-6, Block A, LCAD Property 15470, located in the 1100 Block of NW 7th Street. Mack presented the item to commissioners stating that engineering has reviewed the preliminary plat and recommends approval with the following conditions: 1. Lot I is a corner lot and should therefore include a 25' setback on 7th Street just like it does on Henderson Street (Chapter 9, Exhibit B, Appendix Illustrations) 2. Any trees over 19" diameter should be shown (Chapter 9, Article 9.07, Sec 9.07.004) 3. Park Place is an existing shopping center and plat. The title of the plat should be changed to avoid confusion (Chapter 9, Exhibit A, Section IV (3)). 4. Sidewalk will be required on the west side of Lot I along 7th Street (Chapter 9, Exhibit A, Section VIII. C & I). 5. After the approval of the preliminary plat, submit construction plans for the proposed water line along Henderson Street (Chapter 9, Exhibit A, Section VIII.J) 6. Provide a preliminary drainage plan (Chapter 9, Exhibit A, Section IV (6)). 7. On the final plat, provide a reference for the 7th Street and Henderson Street ROW (Chapter 9, Exhibit A, Section IV (5)). 8. Oncor has requested a 10' utility easement be shown along the entirety of the inside of the property line with the bearing NO°05"W (Chapter 9, Exhibit A, Section IV (9)). A motion to approve the preliminary plat with conditions was made by Michael Mosher, seconded by Austin Anthony. Motion carried 6-0. 10. Consideration of and action on the Preliminary Plat of the Asay Addition, Lots 1-10, Block A, LCAD Property 13823, located in the 1000 Block of Pine Bluff Street. Mack presented the item to commissioners stating that engineering has reviewed the preliminary plat and recommends approval with the following conditions: 1. Asay Addition is too similar in name to the recorded plat Asay Properties Addition (Chapter 9, Exhibit A, Section IV (3)). 2. Please show and label the parts of NE I1 th St and NE 10th St that are north of the property. Also, show and label E. Price St. All three are within 200 feet of the subject property. 3. The ROW dedication is shown incorrectly. The ROW dedication should be shown within the bounds of the property as it currently exists (Chapter 9, Exhibit A, Section IV (9)). a. Ensure appropriate dimensions are provided so it is clear how much ROW is being dedicated. 4. Building setback lines should not extend into the detention pond easements (Chapter 9, Exhibit A, Section IV (9)). 5. Denote the zoning on the plat (Chapter 9, Exhibit A, Section IV (10)). 6. Oncor has asked that a 10' utility easement be shown along the inside of the property lines with the bearings N 00°52'18" W, N 89°09'22 " E, and S 02°07'38" E. (Chapter 9, Exhibit A, Section IV(9)). A motion to approve the preliminary plat with conditions was made by Sims Norment, seconded by Austin Anthony. Motion carried 6-0. 11. Consideration of and action on the Final Plat of the Asay Addition, Lots 1-10, Block A, LCAD Property 13823, located in the 1000 Block of Pine Bluff Street. Mack presented the item to commissioners stating that engineering has reviewed the final plat and recommends approval with the following conditions: 1. All preliminary plat comments shall be satisfactorily addressed ((Chapter 9, Exhibit A, Section V). 2. Show minimum finished floor elevations (Chapter 9, Exhibit A, Section V (8)). A motion to approve the final plat with conditions was made by Austin Anthony, seconded by Michael Mosher. Motion carried 6-0. 12. Consideration of and action on the Preliminary Plat of the Little Hollow Estates CB317, LCAD Property 50201, located in the 2200 Block of NE 36th Street. Mack presented the item to commissioners stating that engineering has reviewed the preliminary plat and recommends approval with the following conditions: 1. Chapter 9, Exhibit A, Section IV, (6): There are a number of large trees that should be shown. 2. Chapter 9, Exhibit A, Section IV, (9): A 20' drainage easement should be added for the channel that cuts through Lots 4 and 5 3. Chapter 9, Exhibit A, Section IV, (9): Oncor has requested that a 10' utility easement be shown running north/south along the inside of each property line post -ROW dedication. They have also requested that on either side of the length of each property line running east/west a 5' utility easement be shown except for at the north and south most property lines where a 10' easement shall be shown instead. 4. Chapter 9, Exhibit A, Section VIII, A, E7, E14: An amendment to the Master Thorough Plan shall be put forward before the approval of the final plat in order to prevent the necessitation of dedication of ROW for a planned arterial road. 5. Any proposed alternations to the drainage ditch that cuts across Lots 4 & 5 must first be approved by the City of Paris. This includes but is not limited to grading, relocating, lining, or widening the existing drainage ditch. Plans and relevant calculations should be provided to the City showing that any proposed alterations will not negatively impact adjacent properties. A motion to approve the preliminary plat with conditions was made by Chance Abbott, seconded by Austin Anthony. Motion carried 6-0. 13. Consideration of and action on the Final Plat of the Little Hollow Estates CB317, LCAD Property 50201, located in the 2200 Block of NE 36th Street. Mack presented the item to the commissioners stating that engineering staff has reviewed the final plat and recommends approval with the same noted conditions of the preliminary plat. Mack advised this property is not within the floodplain to address the citizen's concern that spoke during the forum. A motion to approve the final plat with conditions was made Chance Abbott, seconded by Michael Mosher. Motion carried 6-0. 14. Request items for future agendas. No request were made at this time. 15. Meeting adjourned at 5:46 p.m.. APPROVED THIS 13th DAY OF SEPTEMBER 2022
