1984-016 - Continuing water service to Paris Junior CollegeRESOLUTION NO. 84 -016 WHEREAS, the City Council of the City of Paris is desirous of continuing water service to Paris Junior College which is served by a fire main system that does not lend itself to single metering; and, WHEREAS, Paris Junior College has agreed to the meter- ing system included in the Water Service Contract attached hereto as Exhibit A and made a part hereof; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that Joe Graham, Mayor of the City of Paris, be, and he is hereby authorized and directed to execute on behalf of the City of Paris, Water Service Contract with Paris Junior College attached hereto as Exhibit A. S TO FORM: ayn ity Attorney EXHIBIT A WATER SERVICE CONTRACT STATE OF TEXAS I KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR X THAT, the CITY OF PARIS, Paris, Texas, a Municipal corporation, acting by and through its Mayor, Joe Graham, hereinafter referred to as CITY and PARIS JUNIOR COLLEGE, acting by and through its President, Dr. Dennis Michaelis, duly authorized hereinafter called PJC, do contract and agree as follows: 1. Water mains on the campus of PJC are the property of PJC and shall be maintained by PJC. Mains leaving PJC campus become City of Paris water system property at PJC property lines. 2. All main connections for the benefit of PJC water system shall be constructed at PJC's cost by the CITY if the CITY can do so in a timely manner otherwise by a private contractor. Maintenance of the CITY system to PJC's pro- perty line shall be CITY's responsibility. 3. PJC agrees to make timely repairs on unmetered mains and in the event of failure to so do, the CITY may make said repairs charging the cost therefor to PJC. 4. PJC is responsible for purchasing from the City of Paris all meters necessary to meter all water used from the City of Paris system by PJC. The meters so purchased shall remain the property of the CITY and shall be maintained by the CITY. PJC will supply all labor, and equipment neces- sary for installation of meters; however, the actual setting of the meter is to be done under CITY supervision. 5. PJC agrees to read all meters and supply in- dividual readings to the CITY on a schedule set by CITY. The CITY agrees to aggregate the individual readings into composite water usage figure and to calculate PJC's water bill as a single customer. 6. PJC agrees to directly meter all water usage. A metering plan shall be prepared by PJC depicting meter location and size providing for the direct metering of all water usage, which plan shall be approved by the City Engineer prior to the commencement of installation of the metering system. In the event of the future need to amend such plan as approved, such amendment shall be approved prior to modification of such original plan. 7. The CITY shall have unencumbered access to its meters used in metering PJC's water consumption. The CITY agrees to maintain meters installed upon PJC campus for the purpose of metering its water consumption. 8. PJC acknowledges its responsibility to provide an adequate fire protection system.
