1984-051 - B. Bray Construction Co. Inc. awarded bidRESOLUTION NO. 84 -051 WHEREAS, the City of Paris, did at its special meeting on November 22, 1983, approve the advertisement for bids for a unit price contract for construction of street improve- ments on Sycamore Street from 6th Street S. E. to 8th Street S. E., Paris, Texas, which bids were received until 10:00 o'clock A.M., Monday, June 11, 1984; and, WHEREAS, the best bid for such construction was made by B. Bray Construction Co., Inc., P 0 Box 517, Paris, Texas 75460, and it should be awarded the bid for such construction; and, WHEREAS, the form of contract for such construction project is attached hereto as Exhibit A, and such form should be approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the bid of B. Bray Construction C., Inc., for street improvements on Sycamore Street from 6th Street S. E. to 8th Street S. E. in the amount of $14,730.00, is hereby accepted and let, conditioned said contractor meeting all of the terms and specifications included in the bid documents; and, BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, Joe Graham, be, and he is hereby authorized and directed to execute on behalf of the City of Paris the contract for street improvements on Sycamore Street from 6th Street S. E. to 8th Street S. E., upon the terms and con- ditions and in the form shown in Exhibit A attached hereto, with B. Bray Construction Co., Inc. Passed and adopted this 14th day of June, 1984. K. a s, City Attorney AGREEMENT STATBYOVTEXAS COUNTY OF LAMAR EXHIBIT A THIS AGREEMENT, made and entered into this 14th day of June A.D. 1984, by and between fha ritx of Paris ,acting through its Mayor, thereunto duly authorize so to do, Party the First Part, hereinafter termed Owner, and B. Bray Construction Coupany, Inc... of the City of Paris , County of Lamar and State of Texas , Party of the Second Part, hereinafter termed CONTRACTOR: WITNESS, THAT for and in consideration of the payments and agreements herein after mentioned, to be made and performed by the Party of the First Part (OWNER), and under the conditions expressed in the'bond bearing even date herewith, the said Party of the Second Party (CONTRACTOR), hereby agrees with the said Party of the First Part (OWNER) to commence and complete construction of certain improvements described as followai reshape and compact existing subgrade; furnish 568 tons of crushed rock compacted in place; 90 linear feet of 15" reinforced concrete pipe in place; and 9 utility adjustments ( SF -1 ) All extra work in connection therewith, under the terms as stated in the General Conditions of the Agreement and at his (or their) own proper cost and expense to furnish all the materials, supplies, machinery, equipment, tools, superintendaace,-. labor, insurance, and other assories and services necessary to complete the said construction, in accordance with the conditions herto, and in accordance with the Notice to Contrac- tors, General and Special Conditions of the Agreement, Plans and other drawings and printed or written explanatory matter thereof, and Specifica- tions and Addenda therefto:1 as prepared by CHANEY ENGINEERING, INC. CONSULTING ENGINEERS, PARIS, TEXAS, herein entitled the Engineer, together which has been identified-by the -Contractor and the Engineer, together with the Contractors Written Proposal, the General Conditions of the Agreement and the Performance and Payment Bonds hereto attached: all of which are made a part hereof and collectively evidence and constitute the entire contract, The following is an enumeration of the Specifications, Drawings and Addenda that form a part of the Contract: Construction Plans Sheet 1 Specifications and Contract Documents Standard specifications Special Conditions items ..l through 29 (SF -2) The-Contractor herby agrees to commence Work within five (5) days after the date written notice to do so shall have been given to him, and to substantially complete the same within forty (40) (calendar days) after the date of the written, notice to commence work, subject to such extensions of time as are provided by the General and Special Conditions. 1. The Owner agrees to pay the Contractor in current funds the follow- ing price or prices as shown in the Proposal, which forma a part of this Contract, such payments to be subject to the General Special Conditions of the Contract: See' Bid Proposal.
