1984-061 - McCrory Engineering, Inc. proposal for engineering and management services for repairRESOLUTION NO. 84 --061 WHEREAS, the City of Paris, has need for professional services and McCrory Engineering, Inc., 2400 Central Parkway, Ste. H., Houston, Texas 77092 has made a proposal for engineering and management services for the repair of a potable water storage tank located at the ground storage station and pump site between Center Street and Loop 286 N. W., which proposal consists of four phases as follows: preliminary, construction, post construction, and future; and, WHEREAS, it is deemed to be in the best interest of the City of Paris that such proposal be accepted and that a professional services contract in the form of Exhibit A attached hereto and made a part hereof, be, and the same is hereby approved; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the proposal of McCrory Engineering, Inc. for professional engineering and management services described in Exhibit A attached hereto, be, and the same is hereby accepted. BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, Joe Graham, be, and is hereby authorized and directed on behalf of the City of Paris to execute the Professional Service Contract attached hereto as Exhibit A. Gfeene, City Clerk APPROVED AS 0 FORM: K. ynes, City Attorney EXHIBIT A PROFESSIONAL SERVICE CONTRACT STATE OF TEXAS § KNOW ALL MEN BY THESE PRESENT: COUNTY OF LAMAR § That the CITY OF PARIS, Paris, Texas, a municipal corporation, acting by and through its Mayor, Joe Graham, hereinafter referred to as CITY and McCRORY ENGINEERING, INC. 2400 Central Parkway, Ste. H, Houston, TX 77092, hereinafter referred to as ENGINEER do contract and agree as follows: 1. The CITY wishes to procure and the ENGINEER desires to provide professional services as described in Exhibit A attached hereto and incorporated herein for all legal purposes, entitled "Engineering Outline" consisting of three (3) phases of work for which CITY agrees to pay as hereinafter stated. All phases of this work are included in the total cost of $11,748. and any addition thereto will require specific authorization executed by the City Manager of the City of Paris. 2. All original plans, drawings, reports, specifications and other work products prepared by the ENGINEER in conjunction with the proposed services, shall become the property of the CITY. 3. CITY agrees to pay for professional services on a time and material bases according to the rate schedule shown in Exhibit B attached hereto and made a part hereof, enti- tled "Engineering/ Inspection Costs ". The CITY shall have the right at its option, to either temporarily suspend or terminate this contract at any time before the services are completed. The CITY shall promptly notify the ENGINEER in writing of its determination to suspend or terminate, and the effective date of the action. Upon receipt of notice to terminate, the ENGINEER shall stop all work and not incur any additional expense and shall promptly inform contractors or sub - contractors contracted for by ENGINEER to stop all t work and not incur any further expense. The CITY shall pay only for work done and cost incurred on or before the date of termination. No anticipated profits or charges other than time and materials incurred on or before the date of termination shall be due the ENGINEER. 4. The CITY and the ENGINEER each binds itself, its successors and assigns to this agreement and to the cove- nants herein contained. The ENGINEER shall not assign, sublet, or transfer its interest in the contract without the written consent of the CITY. 5. ENGINEER will not discriminate against any employee or applicant for employment because of race, religion, color, sex, or national origin. ENGINEER will take affirmative action to insure that applicants are employed and that employees are treated during employment without regard to their race, religion, color, sex or national origin. Such action shall include, but is not limited to the following: employment, upgrading, demotion or transfer; recruitment or recruitment advertising; layoff or termination; rates of pay or other forms of compensation; and selection for training, including apprenticeship. ENGINEER agrees to post, in conspicuous places available to employees and applicants for employment, notices setting forth the requirements of these nondiscrimination pro- visions. 6. Write specifications for purchase and installation of isolation flanges. 3. Compute requirements 4. Write specifications system. 5. Write specifications 6. Design secondary flo 7. .Write specifications for cathodic protection system. for materials and installation of cathodic protection for grout displacement under tank and between floors. Dr and prepare engineering drawings. for materials and installation of secondary floor. 8. Prepare list of potential bidders for all phases of.project. 9. Prepare requests for quotations and send to bidders, using procedures which conform to City of Paris requlations. 10. Evaluate bids and recommend successful bidders to City. Construction Phase 1. Conduct pre- construction meeting with contractor representatives to assure specification understanding and schedule requirements. 2. Provide on -site inspector /coordinator for the duration of the project. 3. Conduct final inspection. Post Construction Phase I. Conduct an inspection 15 days after completion of the project to insure tank isolation and proper electrical potential readings. 2.
