1984-072 - Extraterritorial jurisdictions that overlap with City of Paris and City of Reno...RESOLUTION NO. 84 -072 WHEREAS, the City of Paris and the City of Reno have statutory extraterritorial jurisdictions that overlap each other; and, WHEREAS, Section 3b or Article 970a, Revised Civil Statutes of Texas, known as the Municipal Annexation Act has provided a method for resolution of such overlap; and, WHEREAS, the agreement apportioning extraterritorial jurisdiction overlap attached hereto as Exhibit A would in accordance with such Municipal Annexation Act resolve such overlap and is recommended by the City staff and has this day been approved by the City Commission of the City of Reno; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, That the agreement apportioning extraterritorial jurisdiction overlap attached hereto as Exhibit A be, and the same is hereby approved. BE IT FURTHER RESOLVED, That the Mayor of the City of Paris, Joe Graham, be, and he is hereby authorized and directed to execute on behalf of the City of Paris said agreement apportioning extraterritorial jurisdiction overlap. Passed and adopted this 8th day of October, 1984. om"� it e Graham, Mayor ATTEST: r H. eene, City Clerk APPROVED AS FORM: aynes, City Attorney EXHIBIT A AGREEMENT APPORTIONING EXTRATERRITORIAL JURISDICTION OVERLAP This Agreement made and entered into between the CITY OF PARIS, PARIS, TEXAS, a municipal corporation, acting by and through its Mayor, Joe Graham, duly authorized by Resolution of its City Council, attested by its City Clerk, H. C. Greene, and approved as to form by its City Attorney, T. K. Haynes, hereafter called PARIS, and the CITY OF RENO, TEXAS, acting herein by and through its Mayor, attested by its City Secretary, both officers being authorized to act in the premises by Ordinance of its City Commission duly adopted, hereafter called RENO, agree that the following facts exist and are true: 1. The City of PARIS is a home rule city entitled to an extraterritorial jurisdiction consisting of all the contiguous unincorporated area not a part of any other city, within two (2.0) miles of its corporate limits under the provisions of Article 970a, as amended, Revised Civil Statutes of Texas, the Municipal Annexation Act, hereafter called Act. 2. The City of RENO, Texas, is a general law city and is entitled to an extraterritorial jurisdiction consisting of all the contiguous unincorporated area, not a part of any other city, within one -half (0.5) mile of its corporate limits under the Act. 3. PARIS and RENO are situated within such proximity to one another that their statutory extraterritorial juris- dictions overlap one another. 4. PARIS and RENO recognize that the apportionment of the extraterritorial jurisdiction overlap between the two cities would be difficult because to do so would involve a determination of the respective populations of each city on September 1, 1963, the effective date of the Act; increases in population of each city, if such increases raised the population limits of the city to a different entitlement under the Act; the sequence and validity of annexations of property to each city and the effect of such annexations to the expansion of the extraterritorial jurisdiction of each city; and the proper method of resolution of any resulting overlap under the terms and provisions of the Act and specifically Section 3B thereof. 5. Both PARIS and RENO have annexed territory within the extraterritorial jurisdiction of the other without the written consent of the other, creating conflicts under the terms of the Act, which should be resolved. 6. The respective City Council and City Commission of PARIS and RENO, acting through their city staffs, have reached agreement as to the apportionment of the conflicts and overlays in their extraterritorial jurisdiction which they desire to reduce to writing, thereby resolving such conflict and providing guidance for the annexations of each party hereto in the future. NOW, THEREFORE, KNOW ALL MEN BY THESE PRESENTS, that the CITY OF PARIS and the CITY OF RENO, TEXAS, in considera- tion of the premises and the desire of their respective governing bodies to resolve all conflicts in extra- territorial jurisdiction between them do hereby contract and agree as follows: 1. There is apportioned to RENO the following overlaps in extraterritorial jurisdiction between the parties: (a) A tract of land commencing at the intersection of the east boundary line of F. M. Highway 1508 and the south boundary line of the Missouri - Pacific Railroad right -of -way and thence east with said south railroad right -of -way line 500 feet to a point; thence south parallel with the east right -of -way line of F. M. Highway 1508 to a point of intersection with the corporate limits of the City of Paris on the north side of Cox Airport; thence west 500 feet to the east boundary line of F. M. Highway 1508; thence north with said east right -of -way line of F. M. Highway 1508 to the point of beginning. (b) A tract of land beginning at the inter- section of an extension of the east boundary line of 6 N. E. south across Highway 82 East to said highways south boundary line beginning at that point thence south to the north boundary line of the Missouri - Pacific Railroad right - of -way; thence west with said north right -of -way line 150 feet to the east corporate limits of the City of Reno; thence north to the south right -of -way line of U. S. Highway 82; thence east with said south right -of -way of U. S. Highway 82 to the point of beginning. (c) Beginning at a point in the west boundary line of 13th Street S.W. (Reno) at its intersection with the southern most corporate limits of Reno as it presently exists; thence west 150 feet with said south corporate limit line of Reno to a point; thence south to the north boundary line of Old Clarksville Road; thence east approximately 150 feet with the north boundary line of Old Clarksville Road to its intersection with the west boundary line of 13th Street S.W.; thence north with the west boundary line of 13th Street S.W. to the place of beginning. (d) All of the conflicting extraterritorial jurisdiction of the parties from the north boundary line of U. S. Highway 82 in a northwesterly direction to the intersection of the agreed service line between Paris and Reno extended from its present terminus north of Reno to the northwest in the same course. 2. All other overlaps and extraterritorial jurisdic- tion between the parties hereto are apportioned to PARIS subject to the following provisions of this subparagraph: (a) The area designated "Area A" on the Plat attached hereto as an Exhibit as set out in Paragraph 3 hereof shall be considered within the extraterritorial jurisdiction of the City of PARIS; however, it is expressly agreed and understood that the City Council of the City of PARIS will entertain and favorably consider ceding Area A or a part thereof to the extraterritorial jurisdiction of the City of RENO for annexation by the City of RENO upon receipt of a request from the property owner of the land included within Area A for annexation to the City of RENO, accompanied by a development plan acceptable to the City Council of the City of PARIS. 3. There is attached hereto as Exhibit A, a Plat prepared by the city staff of PARIS reflecting and depicting the apportionment set out in paragraphs 1 and 2 hereof for illustrative purposes. In the event of conflict between the recitations of this Contract and the Plat attached hereto, the recitations of this Contract and the location of the respective reference points shall control. 4. PARIS hereby expressly consents to each and every annexation made by RENO, prior to the date hereof of land or territory within the extraterritorial jurisdiction of PARIS. Without limiting the generality of the foregoing, PARIS expressly consents to, ratifies, confirms and validates those annexations by RENO which are set out on Exhibit "B" attached hereto. 5. RENO hereby expressly consents to each and every annexation made by PARIS prior to the date hereof of land or territory within the extraterritorial jurisdiction of RENO. 6. The parties hereto expressly agree by and between themselves that it is recognized that a material consid- eration for the approval of this Plat by RENO is the under- standing and agreement reached between the parties that the area available to RENO for expansion in the future after the development of its present extraterritorial jurisdiction should logically lie between the north boundary line of U.S. Highway 82 and the service line extended as it appears on Exhibit "A ". The parties have specifically agreed that all of Reno's extraterritorial jurisdiction lying within that area is apportioned to RENO, but further understand and agree that the parties cannot, by this Agreement, confer upon RENO extraterritorial jurisdiction beyond that conferred upon RENO by the Legislature of the State of Texas by its adoption of the Act. Accordingly, the parties express their consensus that RENO should have the future right to expand, if necessary, within the area defined for the logical development and extension of its corporate boundaries. PARIS agrees that its City Council will seriously consider properly supported requests for property lying within the area described in this paragraph to be annexed by RENO, even though such property is within Paris's extraterritorial jurisdiction as depicted on Exhibit "A" attached hereto, if such request is presented by RENO in the future.
