14 - Minor Master Thoroughfare Plan Amendment FM 195 and Lamar AvenueItem No. 14 Memorandum TO: Mayor, Mayor Pro Tem and City Council Grayson Path, City Manager FROM: Andrew Mack, AICP Director Planning & Community Development SUBJECT: Public hearing to consider and take action regarding the petition for a Minor Master Thoroughfare Plan Amendment temporarily removing the entire segment of the proposed major arterial roadway between FM 195 and Lamar Avenue (TH 82, the `Delete All' option). DATE: November 14, 2022 BACKGROUND Development Staff Team believes this classification, as shown on the plan between FM 195 and Lamar Avenue (TH 82), is unrealistic as drawn (see attached exhibit). Staff believes the origin of this segment of the plan pre -dates the majority of development in this portion of the city over the past 30+ years. Staff strongly recommends that this entire segment be temporarily removed in its entirety. This would afford plenty of additional time for the City to study this portion of the future extension of the arterial out into the future growth area of the Northwest portion of the City to accommodate new development over time. It will also afford an opportunity to allow recording of the conditionally approved Whitaker Little Hollow Estates in order for lots to be sold. RECOMMENDATION At its meeting held on 11/7/22 the P&Z unanimously recommended approval of this change. Staff recommends approval of the `delete all' agenda item for a Minor Master Thoroughfare Plan Amendment temporarily removing the entire segment of the proposed major arterial roadway between FM 195 and Lamar Avenue (TH 82). AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING A MINOR MASTER THOROUGHFARE PLAN AMENDMENT BY REMOVING THE ENTIRE SEGMENT OF THE PROPOSED MAJOR ARTERIAL ROADWAY BETWEEN FM 195 AND LAMAR AVENUE (US 82); PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, AND A SAVINGS CLAUSE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING AN EFFECTIVE DATE. WHEREAS, city staff has reviewed the classification and location of a proposed arterial roadway as shown on the Master Thoroughfare Plan ("MTP") between FM 195 and Lamar Avenue (US 82) as depicted in the attached Exhibit A, and believe it is unrealistic as drawn; and WHEREAS, city staff believes this segment of the MTP pre -dates the majority of development in this portion of the city over the past 30 plus years; and WHEREAS, city staff strongly recommends that this entire segment be temporarily removed in its entirety to afford time for the staff to study this portion of the future extension of an arterial roadway out into the future growth area of the northwest portion of the city to accommodate new development over time; and WHEREAS, at its November 7, 2022 meeting, after conducting a public hearing, the Planning and Zoning Commission unanimously recommended approval of the minor amendment to the MTP; and WHEREAS, at the November 14, 2022 meeting of the Paris City Council, the City Council, after conducting a public hearing, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing found and recommends approval of the minor amendment to the Master Thoroughfare Plan by removing the entire segment of the proposed major arterial roadway between FM 195 and Lamar Avenue (US 82); NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Master Thoroughfare Plan be amended by removing the entire segment of the proposed major arterial roadway between FM 195 and Lamar Avenue (US 82) as shown on Exhibit A hereto which is incorporated herein by reference for all purposes. Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 5. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. This ordinance shall become effective from and after its passage and publication as required by law.
