BACKGROUND & DISCUSSION
One of the greatest challenges every municipality faces is being able to fund the services it
provides. While a municipality has numerous options for sources of revenue to support these
services, the default source of funding is property tax. However, citizens, councilmembers, and
staff actively seek opportunities to supplant property tax with other forms of revenue when
possible and appropriate. While many of our city departments do not have the option of producing
much if any revenue, there are several departments that do have the option available to apply fees
to help cover the cost of the service provided by that department. This can help with replacing
the need for property tax support, thereby cutting the property tax or redirecting it elsewhere for
additional needed services in the City.
One such revenue source that the City has available to it is through its Building, Planning &
Zoning, Fire and Engineering permits & services via charging fees for permits, reviews,
inspections, water & sewer taps, etc. This can help to offset the cost of operating these
departments. Ideally, the fees charged would equal the operating expenses, but unfortunately this
has not been the case in the City of Paris. While the amount of local development ultimately
drives whether or not revenue is collected, it is difficult to guarantee that certain fixed costs (ex:
payroll, insurance, etc.) will be covered strictly by internal department revenue. As such, it is
logical and fair that as much of the cost of permitting and inspection services as possible should
be borne by those receiving the specialized service and not be an additional burden on the general
taxpaying public. Some services in these departments do provide a direct public benefit by
ensuring public safety, thus warranting little to no fee and being supported by public funding.
However, most of the services performed in these departments directly and primarily benefit the
developer and additional consideration should be given to more closely aligning these fees paid
for by the developer commensurate with the cost of providing the services. In other instances,
the cost of labor and parts have increased over time such as for the water & sewer tap services.
In order to align our permitting and development review processes better with the aforementioned

principle, a new permit and inspection system and process has been established. This system
allows for better performance and tracking on My Gov of the specific service requested and
allows us to establish fees that are more in proportion with the service offered.
By reviewing our current processes, we have realized the existence of numerous permits and
services that currently are without established fees. This process has also allowed us to utilize
time and motion studies to assess current fees to determine where adjustments are required. In
addition, a fee study of Texas municipalities with similar populations was completed to compare
our current fee schedules. As a result of these reviews, modifications to our current fee schedule
are proposed for updating. The proposed fees will more accurately cover operational costs,
shifting more, but not all of the costs directly to those receiving the specialized services and
diminishing the burden on the general taxpayer.
This proposal covers our Community Development Building Permitting and Planning & Zoning
Department, Public Works Department, Fire Marshal Department, and Engineering Department
Fees. We would recommend annual or at least biennial review of this fee schedule to ensure the
fee structure remains appropriate and within industry standards.
The City Council can choose to approve all proposed fee changes, some of the proposed fee
changes, none of the proposed fee changes, or request additional information and/or edits.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS, AMENDING APPENDIX A, "FEE SCHEDULE," OF THE CODE
OF ORDINANCES RELATING TO CONSTRUCTION AND
DEVELOPMENT FEES; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A
SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE;
AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the Appendix A of the City of Paris Code of Ordinances provides a fee
schedule for city permits and services, including those related to construction and
development; and
WHEREAS, the city has not conducted a comprehensive review of those fees in
several years, and the cost of providing the services reflected therein has increased over
time; and
WHEREAS, the City Council finds it desirable to revise these fee schedules so as to
allow the city to perform the services related to said permits and related work on a break
even basis, thus avoiding having to subsidize those services from the taxes of those not
directly benefitting from the development;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in
all things approved.
Section 2. That Appendix A, Article A3.000 of the Code of Ordinances of the City of
Paris shall be and is hereby renamed "DEVELOPMENT AND RELATED PERMIT FEES."
Section 3. That Appendix A, Section A3.002, "General construction and planning
permit fees," shall be and is hereby amended to be renamed and to read in its entirety as
follows:

Section 4. Sections A3.002 -A3.008 shall be and are hereby amended by deleting
them in their entirety.
Section 5. Appendix A, Article A5.000, "FIRE PREVENTION AND RELATED FEES,"
Section A5-001, "Permit and plan review fees," shall be and is hereby amended by deleting it
in its entirety, and Section A5.002, "Fire and rescue service fees," shall be renumbered
accordingly.
Section 6. That all provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 7. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any
penalty accruing or to accrue, or as affecting any rights of the municipality under any section
or provisions of any ordinance at the time of passage of this ordinance.
Section 8. That it is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 9. That any person violating any provision of this ordinance shall be guilty
of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with
provisions of Sec. 1-6 of Chapter One of the City of Paris Code of Ordinances, and each and
every day's continuance of any violation of the above -enumerated sections shall constitute
and be deemed a separate offense.
Section 9. That this ordinance shall become effective from and after its passage and
publication as required by law.
