24 - Amendments to the Future Land Use MapItem No. 24 Memorandum TO: Mayor, Mayor Pro -Tem and City Council Grayson Path, City Manager FROM: Andrew Mack, AICP Director Planning & Community Development SUBJECT: Conduct a public hearing and take action regarding the petition of the City of Paris to amend the Future Land Use Map in the City of Paris, Block 281 for the following LCAD parcels as indicated: • A minor Comprehensive Plan amendment from Low Density Residential (LDR) to Medium Density Residential (MDR) on LCAD Parcel 18408. • A minor Comprehensive Plan amendment from Low Density Residential (LDR) to Commercial (C) on LCAD Parcels 18392, 39576, and 18406. • A minor Comprehensive Plan amendment from Part of Low Density Residential (LDR) to Commercial (C) on LCAD Parcels 119049, 18402, 39538, and 38005. • A minor Comprehensive Plan amendment from Low Density Residential to Public Lands and Institutions (PLI) on LCAD Parcel 121817. • A minor Comprehensive Plan amendment from split Commercial (C) and Low Density Residential (LDR) to Public Lands and Institutions (PLI) on LCAD Parcel 101196. DATE: January 23, 2023 BACKGROUND & ANALYSIS As follow up to the Milam requests, the City has initiated a minor amendment to the Future Land Use Map (FLUM) to provide for the current zoning and existing land uses to be consistent with the City's Comprehensive Plan. Essentially the proposed changes are a housekeeping corrections to the FLUM map to allow the City's Comprehensive Plan to be consistent with current uses of the properties. The request was approved by the P&Z on 1/3/23. Most of the properties associated with proposed changes have a split parcel designation for Commercial and Low Density Residential along Clement Ave and 17th St. NE. Some are absent the designation based upon the actual commercial use of the site such as the commercial businesses along 17th St. NE. Some of this may be a result of mapping errors at the parcel level which become more evident with the increased level of accuracy in the City's GIS system. In the other instance such as for the cemetery, it may have been unknown for the land use mapping Page 1 of 2 as to the fact that a cemetery actually exists on the property. Further research and action on the land use and zoning designations for all cemeteries in the City may also be undertaken. INPUTS A number of inputs were received on this case by surrounding land owners in opposition without any stated reasons. It would appear that the individuals may not have been clear as to the intent of the changes in the plan. No one appeared in person at the hearing. RECOMMENDATION Staff and the P&Z recommends approval of a Minor Comprehensive Plan Amendment amending the FLUM as specified above. Page 2 of 2 WHEREAS, Texasoc regulationszoning a designed o lessen congestion dangers;general1adequate" the overcrowding of land; avoidundue concentration ofpopulation,- or facilitate the adequate provision of transportation, water, sewers, schools, parks, and other public requirements; and, WHEREAS, Chapter 213, of the Texas Local Government Code empowers municipalities for the purpose of promoting sound development sai ! 1" and, empowersWHEREAS, Chapter 213 of the Local Government Code 4 define the content and design of a comprehensive plan; and, WHEREAS, Chapter 213 of the Local Government Code provides that a comprehensive plan may: 1m Include but is not limited to provisions on land use, transportation, and public facilities; 2m Consist of a single plan or a coordinated set of plans organized by subject and geographic areas; and 3. Be used to coordinate and guide the establishment of development regulations; and, WHEREAS, the adoption of the proposed Comprehensive Plan shall not, in *. prepareof Paris to other plans, required;planning as WHEREAS, in September for 2001, the City Council adopted a City of Paris, Texas Comprehensive Plan i Future Land Use Map;, 1', 2001 Comprehensive Plan and Future Land Use Plan d said Land Use ♦, Definitions were amendedadopted in May, 2008, and, WHEREAS, in October of 2018, the City Council adopted significant revisions to the Comprehensive Plan and the Future Land Use Plan; and WHEREAS, on January 3, 2023 the Planning and Zoning Commission held a public hearing to review and consider a request to make the following minor Comprehensive Plan amendments to the Future Land Use Plan Map as set forth on Exhibit A attached hereto and incorporated herein by reference and recommended to the City Council approval of same: • A Minor Comprehensive Plan Amendment from Low Density Residential (LDR) to Medium Density Residential (MDR) on LCAD parcel 18408; • A Minor Comprehensive Plan Amendment from Low Density Residential (LDR) to Commercial (C) on LCAD parcels 18392, 39576, and 18406; • A Minor Comprehensive Plan Amendment from part of Low Density Residential (LDR) to Commercial (C) on LCAD parcels 119049, 18402, 39538, and 38005; • A Minor Comprehensive Plan Amendment from Low Density Residential (LDR) to Public Land And Institutions (PLI) on LCAD parcel 121817; • A Minor Comprehensive Plan Amendment from Split Commercial (C) and Low Density Residential (LDR) to Public Lands And Institutions (PLI); and, WHEREAS, on January 23, 2023, the City Council of the City of Paris held a public hearing to receive input from the citizens of the City of Paris regarding the proposed minor amendments to the Comprehensive Plan the Future Land Use Map; and, WHEREAS, following the public hearing and consideration of the proposed amendments to the Comprehensive Plan Future Land Use Map for the City of Paris and the recommendation of the Planning and Zoning Commission, the City Council determined that these amendments would be in the best interest of the City of Paris and its citizens, and the same should be approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Future Land Use Plan Map of the City's Comprehensive Plan be amended as follows as set forth on Exhibit A attached hereto and incorporated herein by reference: A Minor Comprehensive Plan Amendment from Low Density Residential (LDR) to Medium Density Residential (MDR) on LCAD parcel 18408; A Minor Comprehensive Plan Amendment from Low Density Residential (LDR) to Commercial (C) on LCAD parcels 18392, 39576, and 18406; A Minor Comprehensive Plan Amendment from part of Low Density Residential (LDR) to Commercial (C) on LCAD parcels 119049, 18402, 39538, and 38005; A Minor Comprehensive Plan Amendment from Low Density Residential (LDR) to Public Land And Institutions (PLI) on LCAD parcel 121817; and A Minor Comprehensive Plan Amendment from Split Commercial (C) and Low Density Residential (LDR) to Public Lands And Institutions (PLI); Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section S. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That this ordinance shall become effective from and after its passage. PASSED AND ADOPTED on this 23rd day of January 23, 2023.
