25 - Master Thoroughfare Plan AmendmentItem No. 25 TO: Mayor, Mayor Pro -Tem and City Council Grayson Path, City Manager FROM: Andrew Mack, AICP Director Planning & Community Development SUBJECT: Conduct a public hearing and take action regarding the petition of the City of Paris for a Master Thoroughfare Plan Amendment as adopted on October 8, 2018 as follows: • C-8 to be amended in part • C-8 (a) to be added • C-8 (b) to be added • C-8 (c) to be added • C-8 (d) to be added • A-8 to be amended in part DATE: January 23, 2023 BACKGROUND At its 10/3/22 and 11/7/22 meetings the Planning & Zoning Commission held discussions regarding updating and amendments to the Master Thoroughfare Plan. The last action to be approved by the P&Z and Council was to delete the planned future arterial roadway (4 lane highway) shown between FM 195 and Lamar Avenue (TH 82). It 'was deemed unrealistic as originally drawn in relation what has been constructed over several decades. Since this time Staff has continued to work on analyzing areas in the Northeast Quadrant of the City where continued new development interest is occurring. This area studied includes proposed revisions for the area between Main Street North (TH 271) and the Stillhouse Road area midpoint between FM 195. A slight revision is proposed with the future arterial roadway A-8 that would intersect with Lake Crook Road to better align with the intersection and continuing straight East until its intersection with Stillhouse Road. This would remove impacts on large lot constructed home sites in this vicinity. Further analysis will need to be conducted over the coming year to determine how best to continue this future route further beyond to the East portion of the City. There is also a series of slight adjustments shown to the collector roadways shown through this area C-8 a thru d. In this regard, an initial draft map was produced for the hearing notices that was dated 12/15/22. Since that time a revision was completed to the drawing which was the previous map that was considered for the hearing at the P&Z meeting on 1/3/23. A portion of this roadway, now known as NL Parkway has recently been Page 1 of 2 completed for the new North Lamar Elementary School. These lines shown on the map are intended only to show the approximate location of where the roadway may be constructed when development occurs. Each time a property is planned for development the Future Thoroughfare Plan will be used as a guide for the City to work with developers to determine what will actually be the best route for the roadway to be constructed within the development in order to make sure it functions well for the development, yet still provides for continuity with the remainder of the planned roadway network. No planned acquisition of property is considered a part of the plan update. No roadway construction by the City is planned as a part of this plan update. The plan is used, however, to determine required ROW dedication each and every time a plat is presented to the City for approval. INPUTS During the public hearing conducted by the P&Z on 1/3/23 there was considerable discussion and questions answered about the purpose and intent of the City having a Master Thoroughfare Plan. In initiating these changes Staff determined, based upon past input given by property owners, it was best to provide property owner notifications of the parcels which are affected by the proposed changes. This allows the City to remain proactive when working with its citizens concerning future planning in the community. A prime example in this situation is the input that was received from Ryan and Shanna Schmidt. They provided a very articulate response in objection to the plan. I was able to have a conversation with them in advance of the meeting which is what resulted in our Development Review Team responding with a slight re -drawing of the original plan map. The change that resulted eliminates a portion of the North- South C -8b line route through large lot homes sites while being able to rely on the Stillhouse Road segment for connectivity. During the hearing there was also further discussion about making further changes to the revised New Line C-8 to further lessen impacts upon land owned by John Curvino who testified with objections at the hearing. This is the 2„ d revision to the original map sent out to the land owners now before the City Council on the map dated 1/4/23. All other feedback received from the public, including Tommy Hannes whose family owns large tracts of land West of Stillhouse Road and Bobby Smallwood with a large rural lot on Stillhouse Road expressed strong support for the proposed changes. A meeting was also held with North Lamar ISD representatives on 1/3/23 the morning of the hearing to brief them on the proposed changes as well. They were in full support of the City's initiative, but did express concerns about the condition and capacity of Stillhouse road to handle continued development in the area, including their plans for continued new school construction in the future. These will be important discussions the City will have to have with developers over time in this area. RECOMMENDATION Staff and the P&Z recommends approval of the above described amendments to the Master Thoroughfare Plan as shown in the attached revised plan map dated 1/4/23. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AMENDMENTS TO THE MASTER THOROUGHFARE PLAN IN THE NORTHEAST QUADRANT OF THE CITY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, city staff has reviewed the proposed Master Thoroughfare Plan in relation to the area between Main Street (Texas Hwy 271) and the Stillhouse Road area midpoint between FM 195; and WHEREAS, staff undertook this review in connection with and in anticipation of new development in this area; and WHEREAS, staff has recommended to the Planning and Zoning Commission slight changes to the Master Thoroughfare Plan set forth in the Map contained in Exhibit A attached hereto and incorporated herein by reference; and WHEREAS, at its January 3, 2023 meeting, after conducting a public hearing, the Planning and Zoning Commission recommended approval of same; and WHEREAS, at the January 23, 2023 meeting of the Paris City Council, the City Council, after conducting a public hearing, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing approved the Amendments to the Master Thoroughfare Plan set forth in Exhibit A hereto, by a vote of yeas and nays; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That Amendments to the Master Thoroughfare Plan as shown in Exhibit A hereto are hereby approved. Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section S. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. This ordinance shall become effective from and after its passage and publication as required by law.
