20 - Amend Zoning from One Family to Multiple Family - 410 N.W. 20th StreetItem No. 20 Memorandum TO: Mayor, Mayor Pro Tem, City Council Grayson Path, City Manager FROM: Andrew Mack, AICP Director Planning & Community Development SUBJECT: Conduct a public hearing and take action regarding the petition P -Town Property Holdings LLC for a zoning change from a One -Family Dwelling District No. 2 (SF -2) to a Multiple -Family Dwelling District No. 1 (MF -1) in the City of Paris, Block 258-A, Lot 2A, located at 410 NE 201h Street- LCAD 18256. MTG. DATE: February 27, 2023 BACKGROUND The applicant has requested a rezoning change from SF -2 to MF -1. There are plans to develop the site for duplex apartments. The existing house on the site has recently been demolished. In initial discussion with the applicant, there are definite plans for entering the 5 In 5 Infill Housing Program. The P&Z recommended approval. ANALYSIS The subject property is zoned SF -2, is now guided for Neighborhood Service and is a vacant lot following demolition of the previous single-family home on the lot. • The land to the West is zoned Neighborhood Service (NS), is guided for Low Density Residential, and is single family residential. • The land to the North is zoned MF -1, is guided for Low Density Residential, and is a vacant lot, single family fronting NE 21St Street and duplex residential fronting NE 20' Street • The land to the East is zoned 2F, is guided for Low Density Residential and are single- family homes and duplexes fronting on NE 21St Street. • The land to the South is zoned NS & SF -2, is guided for Low Density Residential and are single-family homes fronting on NE 201h & 21" Streets. The change in zoning will be consistent with the previous FLUM amendment. The proposed medium density residential use of the property will serve as an appropriate transitional land use at a major street intersection and is afforded excellent access fronting on 3 streets. The proposed development will also further the City's goals for construction of new 5 In 5 Infill Development. Page 1 of 2 INPUTS Input was received from two citizens that utilized our online "Request Tracker" system through MyGov. In addition, at its 2/6/23 meeting and public hearing, the Planning and Zoning (P&Z) Commission received considerable testimony citing concerns regarding storm water and drainage from Cherry Street to Lamar Avenue (south and east of the item on tonight's agenda). Citizens are concerned about the additional drainage this project will add to the existing system through the creation of additional impermeable surfaces. While City Staff do not dispute that drainage concerns further south are connected to development considerations north, given the creation of additional impermeable surfaces is a natural part of development, our existing subdivision ordinances are designed to address Drainage (Exhibit 9A(IX)(E)), specifically the rate at which it flows from / exits the property, and will be enforced during the preliminary plat process and reviewed by the P&Z Commission before work can begin. In addition, we would submit to the City Council that the overall issue of drainage is a standalone issue for us to review at a future time. To this point, the City Manager has directed staff to conduct a review of available information on drainage concerns along this tributary with the intent and goal of looking for opportunities to try and reasonably address concerns within the current City funding capacity. RECOMMENDATION The Planning and Zoning Commission and Staff recommends approval for the rezoning from Two - Family Dwelling District (SF -2) to a Multi -Family Dwelling District No. 1 (MF -1). AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ZONING ORDINANCE NO.1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO CHANGE THE ZONING FROM A ONE -FAMILY DWELLING DISTRICT NO.2 (SF -2) TO A MULTIPLE -FAMILY DWELLING DISTRICT NO. 1(MF-1) IN THE CITY OF PARIS, BLOCK 258-A, LOT 2A, LOCATED AT 410 NE 20TH STREET (LCAD 18256); DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY, PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Planning and Zoning Commission received a request for an amendment to the Zoning Ordinance of the City of Paris to change the zoning from a One - Family Dwelling District No. 2 (SF -2) to a Multiple -Family Dwelling District No. 1 (MF -1) in the City of Paris, Block 258-A, Lot 2A, located at 410 NE 20th Street (LCAD 18256), and recommended to the City Council approval of same; and WHEREAS, on February 6, 2023 following notice and publication as required bylaw, the Planning and Zoning Commission conducted a public hearing on the proposed amendment to the City Zoning Ordinance and, following said hearing, made formal recommendation to the City Council to approve the requested zoning; and, WHEREAS, on February 27, 2023, following notice and publication as required by law, the City Council of the City of Paris conducted a public hearing on the proposed amendment to the City Zoning Ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the Comprehensive Future Land Use Plan of the City of Paris, consistent with the City Zoning Ordinance, and in the best interests of the public health, safety, and welfare of the citizens of the City of Paris by a vote of ayes and nays. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Official Zoning Map of the City of Paris, Texas and Zoning Ordinance No. 1710 of the City of Paris as heretofore amended is hereby further amended to change the Zoning from a One -Family Dwelling District No. 2 (SF -2) to a Multiple -Family Dwelling District No. 1 (MF -1) in the City of Paris, Block 258-A, Lot 2A, located at 410 NE 20th Street (LCAD 18256), in the City of Paris, Texas. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes set forth in this ordinance. Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 6. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 7. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above -enumerated sections shall constitute and be deemed a separate offense. Section 8. This ordinance shall become effective from and after its passage and publication as required by law.
