BACKGROUND: In 2017, the City of Paris updated the City Building Codes by repealing the 2006 edition, and
adopting the 2015 edition of the International Building Code (IBC), International Residential Code (IRC),
International Plumbing Code (IPC), International Mechanical Code (IMC), International Existing Building Code
(IEBC), International Fuel Gas Code (IFGC) and the 2014 National Electrical Code (hereinafter referred to as the
ICC Family of Codes). The ICC Family of Codes provide the jurisdiction an enforceable set of regulations
governing the safeguarding of life and property. It provides the City provisions for the issuance of permits and
collection of fees. The ICC Family of Codes became the official Building Codes for the City of Paris in 2010,
and is still the adopted Building Codes today.
The ICC codes are drafted and updated by building professionals, code enforcing officials, industry
representatives, design professionals and other interested parties every three years. The ICC Codes are recognized
as minimal construction standards. Code updates and revisions take into account all aspects of construction best
practices and methods. As new products, methods, technology and safety practices are introduced, evaluation
and standardizing of these are required to insure proper application and safety. Existing regulation need to be
evaluated to insure their purposes are still relevant and applicable. By keeping current with minimum building
safety requirements we maintain best practices and help insure safe and lasting structures. Local government
agencies are encouraged to keep current with code adoptions to maintain relevance in code enforcement and
training. Keeping current with Code adoption will improve insurance ratings provided by the Insurance Service
Office (ISO).
The ISO is responsible for evaluating the effectiveness of code enforcement agencies, and assigning a Building
Code Effectiveness Grading Schedule (BCEGS) rating that is used by insurance providers when setting policy
premiums with appropriate risk. The ratings range from 1 to 10, with a rating classification of 1 being exemplary
and 10 being deficient. The City of Paris was evaluated by the ISO in June of 2016 and received a rating of 9 for
one and two family dwellings (Res) and 9 for industrial and commercial (Com). During the evaluation, the ISO
representative indicated that in order to improve the rating from a 9, the City would need to adopt, enforce and
maintain a code that is within 5 years of its release. This was one of the reasons the City updated to the 2015 ICC
codes in 2017. The City was re-evaluated in 2021 and was rated 6 (Res) 6 (Com). Today 2023 we are in the same
position as 2016, with our adopted 2015 codes being 8 years post release.
STATUS OF ISSUE: Many municipalities, counties, and jurisdictional authorities in Texas have adopted, or
plan to adopt the 2021 ICC codes as their official codes. In Texas' current 88th Legislative Session HB 2409
would make the 2021 IBC & IRC the Municipal Commercial and Residential Building Codes for the State of
Texas (Effective date September 1, 2023). Updating the model codes will keep the City of Paris current with
applicable State laws and with construction standards, advance the safety of building systems, and promote a
common code interpretation between communities.
The primary mission of the Building Department is to protect the lives and safety of the residents and visitors of
the city of Paris, preserve the quality of life and contribute to lasting economic development. Keeping current by
updating the Building Codes will improve the Building Department's ability to complete these tasks and assist
the City's ability to promote safety, protect life, health, and wellbeing, for both our citizens and guests while
keeping current our knowledge and methods in the safeguarding of life and property.
As with all adopted codes in Texas, local jurisdictions can adopt amendments to better suit the community's
needs, population, resources and response capabilities. The North Central Texas Council of Governments
(NCTCOG) has a code committee and five advisory boards dedicated to the review and analysis of newly released
codes. NCTCOG board then makes recommendations for amendments to the model codes, multiple jurisdictions
throughout the State use the NCTOG recommendations in their Code adoption and amendment process.
City Staff, mindful of our community's needs, growth, and emergency response capabilities, have reviewed the
NTCOG recommendations; and after meeting with local general contractors, developers and trade contractors
have developed a comprehensive list of amendments to the ICC Family of Codes that will reinforce consistent
application and enforcement, while improving the City in the areas of public safety, health, welfare and
development.
BUDGET: This ordinance has no fiscal impact. Resource materials and training are included in the 2022-2023
budget.
STAFFS RECOMMENDATION: In order to protect the public health, safety, and welfare of the City of Paris
and its citizenry, we recommend you would approve the adoption of the 2021 International Building Code, 2021
International Residential Code (IRC), 2021 International Existing Building Code (IEBC), 2021 International
Mechanical Code (IMC), 2021 International Plumbing Code (IPC), 2021 International Fuel Gas Code (IFGC)
and the 2020 National Electrical Code (NEC), along with the local amendments and appendixes as presented.

AMENDING CHAPTER 4, ARTICLE 4.02, "CONSTRUCTION CODES AND
STANDARDS," TO REPEAL THE ADOPTION OF THE 2015 EDITIONS OF
THE INTERNATIONAL BUILDING CODE, THE INTERNATIONAL
RESIDENTIAL CODE, THE INTERNATIONAL EXISTING BUILDING CODE,
THE INTERNATIONAL PLUMBING CODE, THE INTERNATIONAL FUEL GAS
CODE, AND THE INTERNATIONAL MECHANICAL CODE AND ADOPTING
THE 2021 EDITIONS OF SAME; TO REPEAL THE ADOPTION OF THE 2014
NATIONAL ELECTRICAL CODE; TO ADOPT THE 2021 EDITIONS OF THE
INTERNATIONAL BUILDING CODE, INTERNATINAL EXISTING BUILDING
CODE, INTERNATIONAL RESIDENTIAL CODE, THE INTERNATIONAL

MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT;
PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS
CLAUSE, A PENALTY CLAUSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City of Paris has previously adopted the 2015 Editions of the
International Building Code, the International Residential Code, the International Existing
Building Code, the International Plumbing Code, the International Fuel Gas Code, and the
International Mechanical Code as well as the 2014 National Electrical Code; and
WHEREAS, the City Council has adopted the 2021 International Property
Maintenance Code for properties in the downtown Historic District; and
WHEREAS, the International Code Council updates its uniform International Codes
every three years, the last such update occurring in 2021; and
WHEREAS, new and updated construction and fire codes are necessary to properly
regulate and govern the conditions and maintenance of all property, buildings, and
structures; to provide the standards for supplied utilities and facilities and other physical
things and conditions essential to ensure that structures are safe, sanitary and fit for
occupation and use; and to provide for the condemnation of buildings and structures unfit
for human occupancy and use and the demolition of such structures in the City of Paris; and,
WHEREAS, the City Engineer and Building Inspector hereby recommend the 2021
International Building Code, the International Residential Code, the International Existing
Building Code, the International Plumbing Code, the International Fuel Gas Code, the

International Mechanical Code and the 2020 National Electrical Code as the best uniform
building and electrical codes to provide uniform guidelines and regulations for all property,
buildings and structures by providing the standards for supplied utilities and facilities and
other physical things and conditions essential to ensure that structures are safe, sanitary and
fit for occupation and use and the condemnation of buildings and structures unfit for human
occupancy and use and the demolition of such structures in the City of Paris, Texas; and,
WHEREAS, on April 10, 2023, the City Council held public hearings on proposed
adoption of amendments to said codes; and
WHEREAS, after considering testimony from the public hearings referenced above,
the City Council deems it to be in the best interest of the City of Paris and its citizens to repeal
the existing 2015 Editions of International Building Code, the International Residential Code,
the International Existing Building Code, the International Plumbing Code, the International
Fuel Gas Code, and the International Mechanical Code and to adopt the 2021 Editions of
same; and to repeal the 2014 Edition of the National Electrical Code and adopt the 2020
Edition of same; and to make certain amendments to the 2021 International Property
Maintenance Code as amended with local amendments as set out below.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in
all things approved.
Section 2. That Chapter 4, "Building Regulations," Article 4.02, "Construction
Codes," Division 2, "Building Code," as it now exists shall be and is hereby repealed and
replaced with the following text:
"Division 3
Building Code
§ 4.02.031 Building Code Adopted.
(a) Definition. For purposes of this division, the I'^111-ev. �9 de f4 itie shall apply:
`Building
code" shall mean the 2019 2021 International Building Code (sometimes referred to as
IBC including any and all amendments, revisions, or revised additions to the 201.5
2021 International Building Code.
(b) Adoption. In conformance with Texas Local Government Code, chapter 214, subchapter
G, sections 214.211 through 214.214, the r 2021 International Building Code,
including appendices C, E, F, G, and J, is hereafter adopted as the municipal building code
for the city. The r 2021 International Building Code shall apply to the conditions and
maintenance of all property, buildings and structures by providing the standards for

(c) Copies on file. Copies of the 2019 2021 International Building Code will be maintained
on file in the office of the city planning and development department and may be viewed
online at htt s://codes.iccsafe.or codes i-codes/2021-icode, and the provisions
thereof shall be controlling as set out herein in the construction of all buildings and
other structures within the corporate limits of the city.
§ 4.02.032 Amendments.
The following sections, paragraphs, and sentences of the 2021 International Building
Code adopted by � 4.02. 031 are hereby amended as follows:

REPAIR GARAGE. A building, structure or portion thereof used for servicing or
repairing motor vehicles. This occupancy shall also include garages involved in
minor repair, modification and servicing of motor vehicles for items such as lube
changes, inspections, windshield repair or replacement, shocks, minor part
replacement and other such minor repairs.
SPECIAL INSPECTOR. A qualified person employed or retained by an approved
agency who shall prove to the satisfaction of the registered design professional in
responsible charge and approved by the Building Official as having the
competence necessary to inspect a particular type of construction requiring
special inspection.
HIGH-RISE BUILDING. A building with an occupied floor located more than 35
feet (10668 mm) above the lowest level of fire department vehicle access.

Amend Section 901.6.1. Standpipe testing, by adding Section 901.6.1.1 to read as follows:

test standpipe systems as per NFPA 25 requirements. The following additional
requirements shall be applied to the testing that is required every 5 years:
1. The piping between the Fire Department Connection (FDC) and the
standpipe shall be backflushed or inspected by approved camera when foreign
material is present or when caps are missing, and also hydrostatically tested
for all FDC's on any type of standpipe system. Hydrostatic testing shall also be
conducted in accordance with NFPA 25 requirements for the different types of
standpipe systems.
2. For any manual (dry or wet) standpipe system not having an automatic
water supply capable of flowing water through the standpipe. the tester shall
connect hose from a fire hydrant or portable pumping system (as approved by
the fire code official) to each FDC, and flow water through the standpipe
system to the roof outlet to verify that each inlet connection functions
properly. Confirm that there are no open hose valves prior to introducing
water into a dry standpipe. There is no required pressure criteria at the outlet.
Verify that check valves function properly and that there are no closed control
valves on the system.
3. Any pressure relief, reducing, or control valves shall be tested in
accordance with the requirements of NFPA 25. All hose valves shall be
exercised.
4. If the FDC is not already provided with approved caps, the contractor
shall install such caps for all FDC's as required by the fire code official.
S. Upon successful completion of standpipe test, place a blue tag (as per
Texas Administrative Code, Fire Sprinkler Rules for Inspection. Test and
Maintenance Service (ITM) Tag) at the bottom of each standpipe riser in the
building. The tag shall be check -marked as "Fifth Year" for Type of ITM. and
the note on the back of the tag shall read "S Year Standpipe Test" at a
minimum.
6. The procedures required by Texas Administrative Code Fire Sprinkler
Rules with regard to Yellow Tags and Red Tags or any deficiencies noted
during the testing, including the required notification of the local Authority
Having jurisdiction (fire code official) shall be followed.

and contractor, if applicable, as required by the State Rules mentioned above
and NFPA 25.
8. Standpipe system tests where water will be flowed external to the
building shall not be conducted during freezing conditions or during the day

from Class 11 and 111 standpipe systems where employees are not trained in the

in safe condition. If such work is not completed within the period specified by the
inspector in the notice, the inspector shall have the authority to disconnect or order the
disconnection of electric service to the dangerous equipment.
(b) If, in the judgment of the electrical inspector after inspection, any electrical installation
is unsafe or dangerous to persons or property, the inspector shall have the power to
cause such electrical installation to be disconnected from the source of electrical energy
supplying the same, in which event he shall notify Oncor of such action. Thereafter. it
shall be unlawful for any person to cause or permit electric current to be supplied to
such electrical installation until the same has been made safe and the electrical
inspector has issued a certificate of approval to that effect.
§ 4.02.214 Penalty. Persons who shall violate a provision of this code, fail to comply with
any of the requirements thereof or erect, install, alter or repair work in violation of the
approved construction documents or directive of the code official, or of a permit or certificate

factors which do not constitute substantial structural alterations.

A person who shall violate a provision of this code or who fails to comply herewith or with
any of the requirements hereof, shall be guilty of a misdemeanor and, upon conviction, shall
be fined in any some not to exceed two thousand dollars ($2.000.00). and each and every
day's continuance of any violation of the provisions of this code shall constitute and be
deemed a separate offense. Violations of this code shall be strict liability offenses."
Section 9. That all provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 10. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any
penalty accruing or to accrue, or as affecting any rights of the municipality under any section
or provisions of any ordinance at the time of passage of this ordinance.
Section 11. That it is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 12. That any person violating any provision of this ordinance shall be
guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with
provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and every day's
continuance of any violation of the above -enumerated sections shall constitute and be
deemed a separate offense.
