00 - Amended AgendaAMENDED CITY COUNCIL AGENDA Notice is hereby given that the City Council of the City of Paris shall meet in regular session at 5:30 p.m. on Monday, August 14, 2023. The meeting will be held at the City Council Chamber, 107 E. Kaufman Street, in Paris, Texas. Due to the CoVID outbreak facemasks are encouraged for those in attendance of the meeting in the City Council Chamber. Due to the pandemic concerns, one or all Council Members may be attending remotely, but the feed will be available for live viewing at [ii 1Aarj st�ma,�isY gy/ptnblic. The matters to be discussed and acted upon are as follows: Opening Agenda 1. Call meeting to order. 2. Invocation. 3. United States Pledge of Allegiance & Texas Pledge of Allegiance. 4. Citizens' forum. (Persons desiring to address the Council must limit their presentation to no more than two minutes. Unless an item is posted on the Agenda, the Texas Open Meetings Act prohibits the Council from responding to any comments other than to refer the matter to a future agenda, to an existing policy, or to a staff person with specific factual information. Claims against the City, Council Members, or employees, as well as individual personal appeals are not appropriate for citizens' forum.) If necessary, the City Council may convene into Executive Session under Chapter 551 of the Texas Government Code regarding any item on this agenda. Consent Agenda Items on the Consent Agenda are approved by a single action of the Council, with such approval applicable to all items appearing on the Consent Agenda. A Council Member may request any item to be removed from the Consent Agenda and considered as a separate item. 5. Approve minutes from the meetings of July 24 and August 8, 2023. 6. Receive reports and/or minutes from the following boards and commissions: a. Love Civic Center Quarterly Reports b. VC&C Quarterly Reports c. Paris Economic Development Corporation (6-15-2023) d. Love Civic Center Board (5-11-2023) e. Housing Authority (7-18-2023) f. Board of Adjustment (7-5-2023) g. Traffic Commission (7-5-2023) h. Planning & Zoning Commission (7-6-2023) 7. Accept the approved PEDC budget for FY 2023-2024. 8. Accept the approved PEDC Plan of Work for 2023-2025. 9. Receive the 2023 tax appraisal roll from the Lamar County Appraisal District. 10. Receive the 2023 tax rate calculations. 11. Approve an Amended Hotel Occupancy Tax Agreement between the City of Paris and the Lamar County Chamber of Commerce. 12. Approve a Resolution of the City of Paris, Texas, finding that Oncor Electric Delivery Company LLC's application to amend its distribution cost recovery factor and update generation riders to increase distribution rates within the City should be denied; authorizing participation with the Steering Committee of Cities served by Oncor; authorizing hiring of legal counsel; finding that the City's reasonable rate case expenses shall be reimbursed by the company; finding that the meeting at which this Resolution is passed is open to the public as required by law; requiring notice of this Resolution to the Company and legal counsel. Regular Agenda 13. Approve an Ordinance approving a Negotiated Settlement between the Atmos Cities Steering Committee ("ACSC") and Atmos Energy Corp., Mid -Tex Division regarding the Company's 2023 Rate Review Mechanism Filing; declaring existing rates to be unreasonable; adopting Tariffs that reflect rate adjustments consistent with the Negotiated Settlement; finding the rates to be set by the attached Settlement Tariffs to be just and reasonable and in the public interest; approving an attachment establishing a benchmark for pensions and retiree medical benefits; requiring the Company to reimburse ACSC's reasonable ratemaking expenses; determining that this Resolution was passed in accordance with the requirements of the Texas Open Meetings Act; adopting a Savings Clause; declaring an effective date; and requiring delivery of this Ordinance to the Company and the ACSC's legal counsel. 14. Discuss and act on a Resolution approving a Tax Abatement Agreement with Huhtamaki, Inc. Pursuant to the 2020 Census, the subject Property located within City of Paris, Lamar County, Texas, is included within an Enterprise Zone, which pursuant to the Texas Enterprise Zone Act (Texas Government Code Chapter 2303) and the Redevelopment and Tax Abatement Act (Texas Tax Code Sec. 312.2011) also constitutes designation of the area as a reinvestment zone. The Reinvestment Zone is inside Northwest Loop 286 in Northwest Paris, Census Block Group 482770006001032, for a planned investment to include $55 million in real property improvements and $30 million in personal property for expansion of current operations. 15. Receive presentation from Mayor Hughes about the West Paris Town Hall Project. 16. Discuss and act on an Ordinance providing for the Repeal of Chapter 8, Article 8.02, "Curfew for Children," including Sections 8.02.031 through 8.02.039 of the Code of Ordinance of the City of Paris, Texas, and declaring the same to be null and void and of no effect; repealing all Ordinances or parts of Ordinances in conflict herewith; making other findings and provisions and providing an effective date. 17. Discuss and act on an Ordinance of the City Council of the City of Paris, Texas, removing the no parking zone on the East side of 2nd Street S.W. from Austin Street to Sherman Street. 18. Discuss and act on an Ordinance of the City Council of the City of Paris, Texas, reducing the speed limit from 30 MPH to 20 MPH on East Sherman Street between 12a' S.E. to 14a' S.E. Streets. 19. Receive presentation on the Drainage Analysis of the upper basis of Tributaries 4 and 6, Big Sandy Creek. 20. Discuss and appoint three members to the Tax Increment Reinvestment Zone Board (TIRZ), and appoint one Council Member to serve as the Council liaison. 21. Convene into executive session pursuant to: A. Section 551.071 of the Texas Government code, Consultation with Attorney, to receive legal advice from the City Attorney about (1) pending or contemplated litigation and/or (2) on matters in which the duty of an attorney to her client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflict with this chapter. B. Section 551.072 of the Texas Government Code, to deliberate the purchase, exchange, lease, or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person. 22. Reconvene into open session and possibly take action on those matters discussed in executive session. 23. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. 24. Adjournment.
