30 - LCAD Board Member AppointmentItem No. 30 Memorandum TO: Mayor, Mayor Pro -Tem, & City Council Grayson Path, City Manager FROM: Janice Ellis, City Clerk SUBJECT: LAMAR COUNTY APPRAISAL DISTRICT BOARD MEMBER DATE: September 25, 2023 BACKGROUND: Every two years the City must provide the Chief Appraiser the name of its nominee to serve on the LCAD board and cast its votes accordingly. All of the taxing entities are allowed to nominate people to serve on the LCAD board. An entity's number of votes is determined by a formula: [(entity tax levy divided by total tax levy) times 1,000] times 5. This is not a straight appointment by the Council, but an election by the taxing jurisdictions based on their relative tax levies. The current board members whose terms are expiring December 31, 2023, and wish to serve again are Clifton Fendley, David Dunmon, Kenneth Kohls, and Don Biard. STATUS OF ISSUE: The City must send their nomination(s) to the Lamar County Appraisal District by October 15. The LCAD will prepare a ballot and return to the City and the City may cast votes for as many nominees as they wish or cast all votes for single nominee. The actual vote must be done by resolution in open meeting between October 31 and December 15. BUDGET: NA RECOMMENDATION: Nominate a candidate(s) for the LCAD board. As the election administrator for this process, I must notify you of the timetable, each tax unit's votes based on the 2022 tax levies and give your tax unit the right to nominate a member or members to the board. Please see that this is passed on to your Presiding Officer -a requirement of law. Per state law, we have five members of the Board of Directors. There are no staggered terms, so all board member positions are up for election. Your tax unit has the right to nominate, by resolution of your governing body, up to five people. There is no requirement for you to nominate anyone if you do not want to do so. Any person living in Lamar County and who has been a resident of this county for the past two years is eligible to serve. Employees of tax units other than elected officials are not eligible for board service. The members of the current Board are not automatically nominated so if your tax unit wishes to re -nominate them, please feel free to do so or nominate anyone else that you wish. The board members who are willing to continue to serve are: Clifton Fendley, David Dunmon, Kenneth Kohis, Don Biard. The nominations should be returned to me at the appraisal district address by October 15, 2023. 1 will prepare a ballot and return it to your tax unit. Your tax unit will then be able to cast votes for as many nominees as they wish or cast all votes for a single nominee. The successful board members will be announced by December 20 and will be sworn in at the first meeting in 2024. 1 have enclosed a resolution that you may use for the nominations process. Sincerely yours, Chief Appraiser Enclosure ELECTIONS TIMETABLE Before October 1- Deliver notice to county judge, commissioners, the presiding officer of each tax unit, city manager of each town that has one, to the city secretary, to the presiding officer and superintendent of each school district, and to the presiding officer of the board of the junior college, and the president of the college a letter giving them notice of the election for the board of directors of the appraisal district and the number of votes allocated to each tax unit. Before October 15- receive nominations from each tax units for members of the boa rd Before October 30- prepare a ballot and list the names of the nominees in alphabetical order and send the ballot to the presiding officer of each tax unit entitled to vote. Voting occurs in each tax unit by resolution (official action) of each tax unit. Those resolutions are due not later than December 15. Before December 31, the chief appraiser declares the winning board members and submits the results to the tax units.
