22 - Comprehensive Plan Amendment from Low Density Residential to Medium Density Residential Springlake Addition„nwwm TEXAS Memorandum Item No. 22 TO: Mayor, Mayor Pro -Tem and City Council Grayson Path, City Manager FROM: Andrew Mack, AICP Director Planning & Community Development SUBJECT: Conduct a public hearing and take action regarding the petition of City of Paris for a Comprehensive Plan Amendment from Low Density Residential (LDR) to Medium Density Residential (MDR) in the Springlake Addition, Blocks 1-6, from East Price Street to Cherry Street, between NE 28th Street and NE 30th Street, containing approximately 14.1 acres. MTG. DATE: September 25, 2023 BACKGROUND report. The 6 block area originally included with the proposal has been reduced to 5 '/Z blocks. The 15 acre neighborhood area was also reduced to 11.1 acres. Consistent with this change, the ordinance has also been revised to specify this area as the exhibit to the FLUM Ordinance Amendment. Additional Background Several months prior, the P&Z and City Council approved a Future Land Use Map (FLUM) amendment for Mr. James Martinez at the corner of East Price and 28a' Street NE. Following direction given by the P&Z, since that time we have reviewed the possibility for further Page 1 of 2 amendments to the FLUM for the larger surrounding area. At its meeting held on August 7Ih, the P&Z approved a recommendation amending the FLUM to provide for a medium density residential land use designation for a 6 block area, now reduced to 5 1/2 blocks. This will still enable individual property owners, should they desire, to approach the City for rezoning of their properties in the future. This is strictly a FLUM amendment, actual rezoning of properties in the study area was never planned with this action. This change would simply allow individual property owners to request incremental changes in the future where and when duplex or townhome development may be appropriate. The FLUM changes would also serve to encourage redevelopment for the area on a case-by-case basis without code issue based upon market conditions. ANALYSIS The previous 6 block study area consisted of a total of 15 acres. The land use analysis at that time consisted of: - 25 Single -Family Homes, 13.86 acres (revised total 8.96) - 2 duplexes, .5 acres; (plus 1 for future construction --3; .72 ac) - 3 vacant lots, .64 acres (1 of the vacant lots are now under construction for a SF home). The 4.9 acre reduction mostly consists of single family homes fronting on the West side of 30th Street NE. This resulted in an approximate reduction of the acreage in the FLUM amendment from 13.86 to a new net total of 8.96 acres. The area newly revised FLUM area consists of a mixture of quality single-family and two-family residences, as well as a number of the structures that are in a condemned status, or vacant and in a dilapidated condition. The remaining vacant lots are also substantial in size and could easily accommodate duplexes or townhomes, except for the large lot residential uses with bigger yards which might otherwise accommodate an additional dwelling(s). In conclusion, the P&Z and Staff maintain that the analysis of the existing conditions of this neighborhood, the proximity to the surrounding shopping areas, and the previous action to rezone a single lot for construction of a duplex; supports the minor change to the Land Use Plan for this larger area as recommended with this study. RECOMMENDATION P&Z and the Staff recommends approval of a Minor Comprehensive Plan Amendment amending the FLUM from Low Density Residential (LDR) to Medium Density Residential (MDR) containing approximately 14.1 acres. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND ADOPTING REVISIONS TO THE COMPREHENSIVE PLAN AND FUTURE LAND USE MAP FOR THE CITY OF PARIS AS IT PERTAINS TO THE SPRINGLAKE ADDITION, PARTS OF LOTS 1, 2, AND 3 AND ALL OF LOTS 4, 5, AND 6, COMPRISING APPROXIMATELY 11.1 ACRES IN THE CITY OF PARIS, FROM LOW DENSITY RESIDENTIAL (LDR) TO MEDIUM DENSITY RESIDENTIAL (MDR); MAKING OTHER FINDINGS AND PROVISIONS RELEATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, AND A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, Section 211.004 of the Texas Local Government Code requires that all zoning regulations must be adopted in accordance with a comprehensive plan and must be designed to lessen congestion in the streets; secure safety from fire, panic, and other dangers; promote health and the general welfare; provide adequate light and air; prevent the overcrowding of land; avoid undue concentration of population; or facilitate the adequate provision of transportation, water, sewers, schools, parks, and other public requirements; and, WHEREAS, Chapter 213, of the Texas Local Government Code empowers municipalities for the purpose of promoting sound development and promoting public health, safety, and welfare to adopt a comprehensive plan for the long range development of said municipalities; and, WHEREAS, Chapter 213 of the Local Government Code empowers a municipality to define the content and design of a comprehensive plan; and, WHEREAS, Chapter 213 of the Local Government Code provides that a comprehensive plan may: 1. Include but is not limited to provisions on land use, transportation, and public facilities; 2. Consist of a single plan or a coordinated set of plans organized by subject and geographic areas; and 3. Be used to coordinate and guide the establishment of development regulations; and, WHEREAS, the adoption of the proposed Comprehensive Plan shall not, in accordance with Section 213.004 of the Local Government Code, limit the ability of the City of Paris to prepare other plans, policies, or strategies related to land use and land use planning as required; and, WHEREAS, in September for 2001, the City Council adopted a City of Paris, Texas Comprehensive Plan and Future Land Use Map; and, WHEREAS, said 2001 Comprehensive Plan and Future Land Use Plan and said Land Use Plan Definitions were amended and adopted in May, 2008, and, WHEREAS, in October of 2018, the City Council adopted significant revisions to the Comprehensive Plan and the Future Land Use Plan; and WHEREAS, the City Council of the City of Paris, Texas, received a request from the Planning and Zoning Commission for an amendment to the Comprehensive Plan and Future Land Use Map for Blocks 1-6 of the Springlake Addition, from East Price Street to Cherry Street, between 28th Street Northeast and 30th Street Northeast containing approximately fifteen (15) acres in the City of Paris, Texas from Low Density Residential (LDR) to Medium Density Residential (MDR); and WHEREAS, analysis of the existing conditions of the neighborhood including the proximity to surrounding retail areas and a prior rezoning action to enable construction of a duplex, supports such a change to the Comprehensive Plan and the Future Land Use Map; and WHEREAS, on August 7, 2023, the Planning and Zoning Commission conducted a public hearing on said proposed amendment after notice and publication as required by law, and, following said hearing, made formal recommendation to the City Council in favor of said proposed Comprehensive Plan and Future Land Use Map Amendment; and WHEREAS, on August 28, 2023, after notice and publication as required by law, the City Council of the City of Paris held a public hearing to receive input from the citizens of the City of Paris regarding the proposed amendment to the Future Land Use Map and continued the item with direction to staff to reduce the affected land area from 15 acres to approximately 11.1 acres; and, WHEREAS, on September 25, 2023, the City Council reconvened the public hearing originally opened on August 28, 2023; and WHEREAS, following the public hearing and consideration of the proposed amendment to the Future Land Use Map for the City of Paris, the recommendation of the Planning and Zoning Commission, and public testimony, the City Council determined that this amendment would be in the best interest of the City of Paris and its citizens, and the same should be approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That the Future Land Use Plan Map for City of Paris, Texas shall be amended to change the potential zoning classifications for the property described as parts of Blocks 1, 2, and 3, and all of Blocks 4, 5, and 6 of the Springlake Addition, comprising approximately 11.2 acres and more particularly described in Exhibit A attached hereto and incorporated herein by reference, from Low Density Residential (LDR) to Medium Density Residential (MDR). Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 4. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 5. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 6. That this ordinance shall become effective from and after its passage.
