Kaufman, Paris, Texas. Present: Mayor: Reginald B. Call meeting to order. Mayor Hughes called the meeting to order at 5:30 p.m. 2. Citizens' forum. No one spoke during citizens' forum. 3. Discuss and ratify the property tax increase reflected in the budget as required by Chapter 26 of the Texas Tax Code. Finance Director Gene Anderson said the City Council was required to take a separate vote to ratify any property tax increase reflected in the 2023-24 Budget, pursuant to Local Government Code Section 102.007. A Motion to approve this item was made by Council Member Savage and seconded by Council Member Pilgrim. Motion carried, 6 ayes — 0 nays. 4. Discuss and act on ORDINANCE NO. 2023-055: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, FIXING THE TAX RATE AND THE TAX LEVY AND LEVYING AD VALOREM TAXES FOR THE CITY OF PARIS FOR THE CALENDAR YEAR 2023 UPON ALL TAXABLE PROPERTY WITHIN THE CITY OF PARIS IN CONFORMITY WITH THE CHARTER PROVISIONS AND ORDINANCES OF THE CITY; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; REPEALING ALL ORDINANCES OR PARTS OF Special Meeting September 13, 2023 Page 2 ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Anderson explained that each year the City Council must adopt a property tax rate sufficient to fund the city budget as adopted by the Council. He said the City Council had adopted the 2023-24 budget and the property tax rate of .47782 per $100 valuation must be adopted. Council Member Pilgrim confirmed that the O&M rate would remain flat. A Motion to approve this item was made by Council Member Kessel and seconded by Council Member Pilgrim. Mayor Hughes said this item required an individual record vote and that Ms. Ellis would take the record vote. Those voting in favor were Mayor Hughes, Council Member Moore, Council Member Savage, Council Member Norment, Council Member Pilgrim, and Council Member Kessel. Mayor Pro -Tem Pankaj was absent from the meeting. 5. Receive presentations from non-profit agencies requesting funding for public purpose; rank agencies for priority; discuss and act on requests. Assistant City Manager Robert Vine said a total of $100,000.00 was budgeted and the total amount requested was $150,000.00. He explained there were three organizations considered not eligible because they turned in their reports after the due date. Mr. Vine said the policy allowed them to present and it would be the City Council's decision if they considered them eligible. He also said the Mayor had a list of the organizations in alphabetical order and would call upon them. Mayor Hughes inquired of Ms. Harris if a Council Member sitting on the board of an organization would be required to recuse him or herself due a conflict. Ms. Harris said they could go forward with the presentations and prior to voting, she would have an answer for them. He said the second point was whether to include the organization that did not present. Mr. Vine explained the policy did not mandate the organization give a presentation, but the Council make a statement to mandate such. A Motion to accept everyone's application although late with reports, was made by Council Member Norment and seconded by Council Member Savage. Motion carried, 6 ayes — 0 nays. A Motion to include the organization that did not present was made by Council Member Savage and seconded by Council Member Moore. Motion carried, 6 ayes — 0 nays. City Attorney Stephanie Harris said any Council Member that was on a board did not need to recuse him or herself but would need not to score the organizations for which he or she served. Council Member Pilgrim inquired if Option D was the weighted option. Mr. Vine said under Option D, all of the organizations would be awarded 64.516% of their initial request. Council Member Pilgrim confirmed with Mr. Vine that is what they typically did, and said he was in favor of Option D. City Manager Grayson Path said if Council wanted to proceed in that direction, that Mr. Vine had already calculated the numbers and they were ready to moved forward. A Motion to approve the Option D as presented in the excel spreadsheet (see attachment) was made by Council Member Pilgrim and seconded by Council Member Savage. Motion carried, 6 ayes — 0 nays. 6. Planning Director Andrew Mack explained that at the City Council meeting of August 28, 2023, the City heard from Wayne Kirby regarding the effect of the proposed changes regarding drainage to the homes on the West side of N.E. 30''. Mr. Mack said the item was tabled and staff was directed to revise the proposed revisions by removing properties fronting on Regular Council Meeting September 25, 2023 Page 4 the West side of the 300i Street. He also said those properties had been reduced to 5 1/2 blocks and the 15 acre tract was reduced to 11.1 acres. Mayor Hughes continued the public hearing and asked for anyone wishing to speak in favor or opposition of this item to please come forward. Wayne Kirby, 3930-306, N.E., expressed appreciation to the City Council and City Staff for listening to the citizens and making the revised changes. Discuss, conduct a public hearing and act on an ORDINANCE NO. 2023-057: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE CITY OF PARIS BLOCK 112, LOT 25A, LOCATED AT 1355-1357 EAST SHERMAN STREET (LCAD 15752), FROM A GENERAL RETAIL DISTRICT (GR) TO A TWO-FAMILY DWELLING DISTRICT NO. 2(2F); DIRECTING A CHANGE ACCORDINGLY IN THE ORIGINAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Mack said the Planning and Zoning Commission recommended approval of the rezoning and final plat at their meeting on September 70i. He also said the Board of Adjustment granted lot depth and front yard setback variances on September 51h with two conditions, as follows: 1) all minimum required off-street parking spaces in the driveway areas shall be met and such dimensions shall be located entirely upon and the lot; and 2) there shall be no on -street resident or visitor parking allowed along the West side of 1401 St. S.E. nor the North side of Sherman Street East, and subject to approval by the City of a "No -Parking" zone at this location and signage posted at the expense of the applicant. Mayor Hughes opened the public hearing and asked for anyone wishing to speak in favor or opposition of this item to please come forward. Mr. Mack said the request for a zoning change was in order to construct one new duplex. He said the property was in the flood plain but would be elevated enough to remove it from the flood plain. He also said the Planning and Zoning Commission recommended approval of this zoning change, as did City Staff. Discuss, conduct a public hearing and act on ORDINANCE NO. 2023-059: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO ALLOW A SPECIFIC USE PERMIT (SUP) FOR TRAILER SALES AND A CORPORATE OFFICE IN A COMMERCIAL DISTRICT (C) IN THE CITY OF PARIS BLOCK 250, LOT E. PART OF 16 AND LOT E PART OF 17 (LCAD 108849) LOCATED IN THE 800 BLOCK OF N.E. LOOP 286; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Mack explained that Mr. Enns requested an SUP to locate a trailer sales and corporate offices building, along with an exterior storage and display of equipment in a Commercial District on N.E. Loop 286. Mr. Mack said that the Planning and Zoning Commission, as did City Staff recommended approval of a Specific Use Permit for Trailer Sales and a corporate office in a Commercial District, subject to the following conditions: 1) Approval of the site civil construction improvements by the City Engineer, Fire Marshal and Planning & Community Development Director prior to issuance of site civil and building permits; 2) Approval of a new driveway access permit by TX DOT prior to all permit approvals for construction and 3) Full conformity with all other requirements of the Zoning Ordinance, including Section 12-101, the Subdivision Ordinance, and all applicable City Development Guideline Standards. Mayor Hughes opened the public hearing and asked for anyone wishing to speak in favor or opposition of this item to please come forward. Ronnie Enns spoke in favor of this item citing he wanted to utilize the property as corporate offices. With no one else speaking, Mayor Hughes closed the public hearing. Regular Council Meeting September 25, 2023 Page 6 Council Member Pilgrim said the spoke with Maureen Hammond who was very happy about having this company in Paris, and that they would be providing additional jobs. Subject to the conditions set out by P&Z and City Staff, a Motion to approve this item was made by Council Member Savage and seconded by Council Member Kessel. Motion carried, 6 ayes — 0 nays. 26. Discuss and consider all matters incident and related to the issuance and sale of City of Paris, Texas, General Obligation Refunding Bonds, Series 2023, including the adoption of ORDINANCE NO. 2023-060: AN ORDINANCE AUTHORIZING THE ISSUANCE OF CITY OF PARIS, TEXAS GENERAL OBLIGATION REFUNDING BONDS, SERIES 2023, ESTABLISHING SALE PARAMETERS, PROVIDING FOR THE SECURITY FOR AND PAYMENT OF SAID BONDS; AND ENACTING OTHER PROVISIONS RELATING TO THE SUBJECT. City Manager Grayson Path said the City had issued $33,925,000.00 in General Obligation Bonds in July of 2013, to replace aging water and wastewater lines in the City. He also said the term of the loan was 20 years with an option to call the loan on December 15, 2023. Mr. Path explained the most common reason to call a bond issue was when interest rates had fallen since the original bonds were issued and the new Refunding Bonds carrying lower interest rates, could replace the old Bonds. He said the lower interest rates reduced the annual debt service payment. Mr. Path further explained that another reason that bonds were called were to restructure the original debt. Mr. Path said the City Council heard a presentation from the City's financial advisor on June 12, 2023, setting out options to proceed. After hearing the options, the City Council authorized Staff to bring back documents supporting the issuance of Refunding Bonds to restructure the existing bonds by adding 10 years to the final maturity. He explained this would reduce the annual debt service by approximately $1,000,000/year through fiscal year 2033, but would increase the total debt service by approximately $4,250,000. Mr. Path said this would fund Phase II of the Waste Water Treatment Plant Project. Andrew Friedman from SAMCO Capital Markets provided a presentation to City Council, specifically addressing Section 3 of the Ordinance. A Motion to adopt an Ordinance authorizing the issuance and sale of City of Paris, Texas, General Obligation Refunding Bonds, Series 2023 was made by Council Member Pilgrim and seconded by Mayor Pro -Tem Pankaj. Motion carried, 6 ayes — 0 nays. 27. Discuss and act on a temporary waiver of the City of Paris Personnel Manual Section 14.03 in 2023 for certain Paris Police Department personnel. Mr. Path said City and Police Management had implemented strategies in an effort to attract, hire and retain personnel; however, there were currently 20 vacancies in the Patrol Division of the Police Department. He explained it was necessary for police officers to work overtime including missing scheduled vacations in order to continue to provide minimum staffing for patrol coverage in the community. Mr. Path said 40 days was the maximum number Regular Council Meeting September 25, 2023 Page 7 of vacation days that could be carried forward from one calendar year to the next and at the end of 2023, there were five employees in the Patrol Division and CID Division who would lose vacation in order to maintain the needed patrol shifts. Council Member Norment confirmed with Mr. Path that the officers would get paid for their vacation time if this were approved. Council Member Savage said it was not the fault of the police department they were short-handed, and he saw this as an incentive. He said they needed to do this. Discuss and act on ORDINANCE NO. 2023-061: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING SECTION 2.10.034(a), "SENIORITY PAY," OF CHAPTER 2, "POLICE," OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. Mr. Path said he would cover items 28 and 29 at the same time. He stated the FY23/24 Budget recently adopted included pay changes for the Police and Fire Departments, both in base pay and seniority pay. Mr. Path reported that an Ordinance was required to be approved pursuant to Texas Local Government Code Chapter 143. Discuss and act on ORDINANCE NO. 2023-062: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING SECTION 6.02.004(a), "SENIORITY PAY," OF CHAPTER 6, "FIRE PREVENTION AND PROTECTION," OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. A Motion to approve this item was made by Mayor Pankaj and seconded by Council Member Kessel. Motion carried, 6 ayes — 0 nays. 30. Discuss and act on a Resolution Nominating a person or persons to serve on the Board of the Lamar County Appraisal District for a term of office of two years beginning January 1, 2024; making other findings and provisions related to the subject; and declaring an effective date. Iii i September 25, 2023 Page 8 City Clerk Janice Ellis explained that every two years the City was asked to provide the Chief Appraiser the nominate someone as a City representative to serve on the Lamar County Appraisal District Board. She said the City had 614 votes and they could nominate more than one person but it might mean they would not get a representative on the Board. Ms. Ellis said there were twelve taxing entities and only five board member positions. Council Member Pilgrim said he thought they might want to look at getting a representative on the board that knew about real estate and surveying due to the complaints received throughout about the property values. It was a consensus of City Council for Mayor Pro -Tern Pankaj and Council Meniber Pilgrim to work together to recruit a nominee and bring the name back to the Council. She explained that Pro - D and CB Rentals, LLC were both new solid waste companies to Paris, who had submitted applications and required insurance certificates. Discuss and act on ORDINANCE NO. 2023-065: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AUTHORIZING AND DIRECTING THE DIRECTOR OF FINANCE TO TRANSFER UNENCUMBERED FUNDS FROM VARIOUS DEPARTMENTS OR RESERVES TO OTHER DEPARTMENTS WHICH ARE EXPECTED TO OVER -EXPEND THEIR ORIGINAL BUDGET APPROPRIATIONS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Finance Director Gene Anderson said this was the annual year-end "housekeeping" ordinance that increase certain departmental budgets in the General Fund to cover expenditures. He said the increases were offset by decreasing other department budgets within the General Fund that had surplus funds available. He said the General Fund budget was not increasing. Discuss and act on RESOLUTION NO. 2023-043: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING ROBERT VINE AS THE DEPUTY CITY MANAGER AS RECOMMENDED BY THE CITY MANAGER IN CONFORMANCE WITH SECTION 21 OF THE CITY CHARTER; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Mr. Path said during the budget sessions and approval of the budget, the appointment of Robert Vine from Assistant City Manager to Deputy City Manager and the appointment of Doug Harris from Director of Utilities to Assistant City Manager were addressed. He said approval of items 34 and 35 were the formal steps of completing these two appointments. Council Member Savage said there was dissention throughout the City about other positions. He also said with this restructuring to benefit the City, that citizens wanted to see a better flow of work and improvements. Mayor Pankaj said he had heard from folks similar to what Council Member Savage had been told. He also said there was a lot of movement in the City as evidenced at their Council meetings, and this restructuring would be good. Council Member Savage said that was a great point and he agreed there was a lot going on in the City. He also said most citizens do not come to the meetings. Council Member Pilgrim said the City had been experiencing a lot of growth in the last two years and this restructuring gets the City in position staff wise to be ahead of future growth. Mr. Path said one department head position was being unfunded to fund one the new Assistant City Manager position. Discuss and consider the request by Waste Connections Lone Star, Inc. to increase the Landfill Services Agreement rate of payment by 5%. Mr. Path said on September 13, 2021, the City Council approved a Landfill Services Agreement with Waste Connections Lone Star, Inc. for use of the Blossom Landfill for the City's residential waste. Mr. Path said the City had received a request for a rate increase of 5.00%, which was the maximum cap allowed in the agreement. He also said the City had performed an analysis and determined that a 5% rate increase was appropriate under the terms of the agreement, and had included in Council's agenda packet a draft letter to WCLS notifying them of an error in their request, also authorizing the 5% rate increase, as well as requesting WCLS forward payment of the annual $5,000.00 donation, pursuant to Section 12 of the Agreement. Mr. Path answered questions from City Council about Section 6 and the CPI. A Motion to approve the request by Waste Connections Lone Star, Inc. to increase the Landfill Services Agreement rate of payment by 5% was made by Council Member Savage and seconded by Council Member Kessel. Motion carried, 6 ayes — 0 nays. 37. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. Mayor Hughes reminded everyone of the first West Paris Town Hall meeting to take place on Tuesday night at 6:00 p.m. at Justiss Elementary School. Mayor Pro -Tem Pankaj said the City teamed up with Paris Soccer Association to continue the soccer program, and folks were very complimentary of the City for doing this. Council Member Savage asked for an update on the Pickle Ball Courts. 38. Adjournment.
