10/03/2023 MinutesBoard of Adjustment Meeting October 3, 2023 Page 1 MINUTES OF THE BOARD OF ADJUSTMENT MEETING OF THE CITY OF PARIS, 'TEXAS OCTOBER 3, 2023 The Board of Adjustment of the City of Paris met for a regular session at 12 p.m. on October 3, 2023, at the City of Paris- City Hall, Council Chambers located at 107 E Kaufman St. Present: Board Members: David Hamilton, Lydia Fitzgerald, Alix Putnam and alternate Larry Walker. City Representatives: Andrew Mack, Robert Vine, Stephanie Harris and Council Member Rudy Kessel. Absent: Board Members: Carlton Cooper and Ben Vaughan. The Board of Adjustment meeting was called to order by David Hamilton at 12:02 p.m. 2. Approval of minutes from previous meeting. (September S, 2023) Motion was made by Lydia Fitzgerald, seconded by Larry Walker to approve minutes for the September 5, 2023 meeting. Motion carried 4 ayes — 0 nays. 3. Staff presentation and recommendation on Agenda item 4. Andrew Mack, Director of Planning & Zoning, presented the case, the City's neutral position and the options for approval or denial with conditions to the board. 4. Public hearing to consider and take action on the petition of Bailey Asay, on behalf of James Martinez, regarding variances to the City of Paris Area Regulations, on Lot 12, Block 6, of the Springlake Addition being located at 2801 E Price Street, Sections and variances as follows: 1) 10' variance to the front yard setback on E Price Street, Section 9-501(1). 2) 40' variance to lot depth, Section 9-301(1). Mr. Hamilton opened the public hearing. James Martinez of 820 SE 47'x' St, property owner, spoke in favor of the request. Mr. Martinez stated that by building the home facing E Price Street it would create a nicer frontage for the bank and other businesses that are on Price. Mr. Martinez continued to explain that by having a smaller backyard for a duplex it would eliminate the accumulation of junk and rubbish to keep the area nice. Lastly, Mr. Martinez stated that he has no opposition to putting up a privacy fence or extending the driveways to accommodate more parking and eliminate parking on the street. There was discussion amongst the board, staff and the applicant about fencing requirements. Board of Adjustment Meeting October 3, 2023 Page 2 No one else spoke in favor or opposition of the request. Public hearing was declared closed. Staff member Paige Unger made note of one input submitted by phone. Yvonne Bowers of 214 NE 28t' St, in favor. Motion was made by Lydia Fitzgerald, seconded by Alix Putnam to approve the variances to the City of Paris Area Regulations, Sections 9-501(1) and 9-301(1) to allow construction of a duplex on a 60' deep lot and with a 15' front yard setback on E Price Street based on the following conditions and findings. Motion carried 4 ayes- 0 nays. Board Recommended Conditions 1. Beginning at the 25' build line on NE 28th Street, 128' of privacy fence must be installed along the northern property line running east and west, with a maximum height of 7'. 2. Mature trees in right of way along E Price and NE 28' Street must be preserved. 3. Off-street parking must be located entirely on the property. Board Recommended Findins 1. The request for variance is in harmony with the general purposes and intent of site improvement regulations contained in the Zoning Ordinance 1710 Exhibit 9B and the Subdivision Ordinance 1315 Exhibit 9A; and will protect the character of the immediate vicinity of the area. 2. The approval of the variance for lot depth and front yard setback will allow the site plan to be approved to permit a residence to be constructed given the narrow lot dimensions and the corner lot configuration. 3. There are special and unique condition(s) of existing sub -standard lot width which are not applicable to all other existing parcels of land in the 2F Zoning District, and which cause unusual and practical difficulty or unnecessary hardship to the use of the property with site improvements permitted by the ordinance with the provision sought here to be varied. 4. The hardship sought to be avoided is the result of (a) the applicant's own actions (self-imposed or self-created), but rather it is not based upon existing site parcel dimensions to support new construction. 5. The provision of the ordinance regulation that are sought to be varied, deprive the applicant of reasonable rights to use the property that are commonly enjoyed by other older residential properties in the 2F Residential Zoning District which are required to comply with these same ordinance provisions. 6.
