2801 East Price Street - Variance for 10' for front yard setback, and 40' for lot depth✓ wucn✓*wr��r an ,�� r' u DECISION OF THE BOARD OF ADJUSTMENT, CITY OF PARIS, TEXAS RE: 2801 E Price St- Variance Requests James Martinez 820 SE 47t` St Paris, TX 75460 ACTION REQUESTED: 1) 10' variance to the front yard setback on E Price Street, Section 9-501(1). 2) 40' variance to lot depth, Section 9-301(1). The above -referenced requests were approved by the City of Paris Zoning Band of Adjustment ("Board") on 10/3/2023 by a vote of Cayes, nays and _ m_,,,,,,,_ abstaining. On this date, the Board found that the requests met the conditions set forth in the City of Paris Ordinance, sections mentioned above. Appeal: Any interested person wishing to appeal this Board decision is required to file a petition for Writ of Certiorari in a district court, county court or county court at law within ten (10) days of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas Local Government Code. The Board of Adjustment hereby approves the variances request based upon the following condition(s) and findings of fact. Condition Ds 1. Beginning at the 25' build line on NE 28ffi Street, 128' of privacy fence must be installed along the northern property line running east and west, with a maximum height of 7'. 2. Mature trees in right of way along E Price and NE 28h Street must be preserved. 3. Off-street parking must be located entirely on the property. Findings 1. The request for variance is in harmony with the general purposes and intent of site improvement regulations contained in the Zoning Ordinance 1710 Exhibit 9B and the Subdivision Ordinance 1315 Exhibit 9A; and will protect the character of the immediate vicinity of the area. 2. The approval of the variance for lot depth and front yard setback will allow the site plan to be approved to permit a residence to be constructed given the narrow lot dimensions and the corner lot configuration. 3. There are special and unique condition(s) of existing sub -standard lot width which are not applicable to all other existing parcels of land in the 2F Zoning District, and which cause unusual and practical difficulty or unnecessary hardship to the use of the property with site improvements permitted by the ordinance with the provision sought here to be varied. 4. The hardship sought to be avoided is not the result of (a) the applicant's own actions (self- imposed or self-created), but rather it is based upon existing site parcel dimensions to support new construction. 5. The provision of the ordinance regulation that are sought to be varied, deprive the applicant of reasonable rights to use the property that are commonly enjoyed by other older residential properties in the 2F Residential Zoning District which are required to comply with these same ordinance provisions. 6. The pre-existing home and driveway fronted E Price Street which establishes a precedent. This decision was filed in the Board's office on 11/7/2023.
