Main StreetItem No. 17 Memorandum TO: Mayor, Mayor Pro -Tem and City Council Grayson Path, City Manager FROM: Triniti Frazier, Community Development Coordinator SUBJECT: Conduct a public hearing and take action regarding the petition of John Mark Spencer for a zoning change from an Agricultural District (A) to a Commercial District (C) in the City of Paris, Block 306-C, Lot 1, LCAD 50105, located at 4010 N Main St. MTG. DATE: December 11, 2023 BACKGROUND The applicant is requesting a zoning change from Agricultural to Commercial. The proposed use of the property is for retail sales of RV parts & accessories. The subject property is 1.539 acres along HWY US 27I N Main Street. The property is guided for Commercial. Therefore, this action will be in accordance with the city's comprehensive plan. The developer has completed a pre - development meeting with city staff. ANALYSIS • The land to the North is zoned Agricultural and Commercial, consists of commercial businesses, and is guided for Commercial. • The land to the South is zoned Agricultural, consists of undeveloped land, and is guided for Commercial • The land to the East is in the County and lies within the City of Paris Extraterrestrial Jurisdiction (ETJ), the City's Zoning Ordinance does not apply, and surrounding properties consist of an existing RV Park, single-family homes and undeveloped agricultural land. • The land to the West is zoned Commercial and Agricultural, consists of Self -Storage facilities and other commercial establishments, and is guided for Commercial. The proposed use is prohibited in the Agricultural District, hence the requested change for a use that is permitted by right in the Commercial District. The owner plans to remodel the old Spencer RV dealership that his father built in the 1970's for retail sales of RV parts and accessories. All improvements to the site shall conform to the standards required by the City of Paris. It can be expected that any surrounding vacant land will be developed with Commercial characteristics similar to other uses along the major thoroughfare/arterial roadway. The Planning & Zoning Commission recommended approval of the zoning change at its December 4, 2023 meeting. Motion carried, 5 ayes ® 0 nays. PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. OrdinanceSection 2. That the Official Zoning Map of the City of Paris, Texas and Zoning rezone City of Paris Block 306-C, Lot 1, LCAD 50105, located in the 4000 Block BuildingStreet from an Agricultural District (A) to a Commercial District (C). Section 3. That the Chief Official directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes set forth ordinance. Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section S. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 6. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 7. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above -enumerated sections shall constitute and be deemed a separate offense. Section 8. This ordinance shall become effective from and after its passage and publication as required by law.
