Recognition of Deputy City Clerk Skylar Unger for completion of the Texas Municipal Clerk's Certification Program. City Council recognized Deputy City Clerk Skylar Unger for completing the Texas Municipal Clerks Certification Program at the University of North Texas. Mayor Hughes, City Manager Grayson Path, and City Clerk Janice Ellis presented an achievement award to Ms. Unger. B. Citizens' Forum. Regular Council Meeting January 22, 2024 Page 2 Kenny Kammer, 1728 Maple Avenue — he spoke about character commitment for 2024 and referenced 49 essential character qualities for a successful community. Consent Agenda Mayor Hughes inquired of Council Members if they wished to pull any items from the consent agenda for discussion. Approve Amendment No. 3 to the 2007 Professional Services Agreement between the City of Paris and Computer Information Systems Inc., in the amount of $71,294.66, for procurement of the Saltus E -Ticket System through a contractual Amendment No. 3; and authorize the City Manager to execute all necessary documents. 17. Approve an Easement and Right -of -Way and the Oncor Discretionary Service Agreement for the purpose of relocation of power lines and poles. 18. Award parks mowing bids and approve contracts to 1) Adams Lawn Service in the amount of $49,530.00 (49.64 acres), and 2) Green's Lawn Service in the amount of $39,205.00 (34.35 acres). Discuss, conduct a public hearing and act on ORDINANCE NO. 2024-001: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND ADOPTING REVISIONS TO THE COMPREHENSIVE PLAN AMENDMENT AND FUTURE LAND USE MAP FOR THE CITY OF PARIS FROM A SPLIT LAND USE OF LOW DENSITY RESIDENTIAL (LDR) AND MEDIUM DENSITY RESIDENTIAL (MDR) TO COMMERCIAL (C) IN THE CITY OF PARIS BLOCK 351, PART OF LOT 9 AND 10 (A 9.32 ACRE TRACT), LCAD #18903, LOCATED IN THE 4000 BLOCK OF SOUTHEAST LOOP 286; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, AND A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. Building Official Duke McGee explained that Nathan Spaulding for Lone Star Planned Developments, on behalf of Covenant Church was seeking a minor amendment to the Comprehensive Plan to provide for a commercial use of the property located in the 4000 Block of SE Loop 286. He said the site directly abuts 286 Loop to the East and was currently guided for Medium and Low Density Residential. He also said the land use directly across was zoned and Regular Council Meeting January 22, 2024 Page 4 guided for commercial use. Mr. McGee said the Planning and Zoning Commission recommended approval, as did City Staff. Mayor Hughes opened the public hearing and asked for anyone wishing to speak about this item, to please come forward. With no one speaking, Mayor Hughes closed the public hearing. Discuss, conduct a public hearing and act on ORDINANCE NO. 2024-002: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE CITY OF PARIS BLOCK 351 PART OF LOT 9 AND 10 (A 9.32 ACRE TRACT), LCAD #18903, LOCATED IN THE 4000 BLOCK OF SOUTHEAST LOOP 286, FROM AN AGRICULTURAL DISTRICT (A) TO A COMMERCIAL DISTRICT (C); DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Discuss, conduct a public hearing and act on ORDINANCE NO. 2024-004: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE CITY OF PARIS BLOCK 352 PART OF LOT 7, LCAD #110221 AND GIBSON VALLEY ESTATES, BLOCK A, LOT 1 LCAD #101305, LOCATED IN THE 4200 BLOCK OF SOUTHEAST LOOP 286, FROM AN AGRICULTURAL DISTRICT (A) TO A COMMERCIAL DISTRICT (C); DIRECTING A CHANGE ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. McGee said this item was in conjunction with the two previous items. He also said the request for the zoning change was from Agriculture to Commercial and Planning and Zoning recommended approval, as did City Staff. Discuss, provide direction to City Staff, and act on RESOLUTION NO. 2024-009: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, INITIATING THE DISANNEXATION PROCESS FOR PROPERTY LOCATED AT 3197 FM 1497 (LOAD #103254) WITHIN THE CITY LIMITS OF THE CITY OF PARIS AND SETTING PUBLIC HEARINGS REGARDING THE SAME; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. City Attorney Stephanie Harris said the City received an application for disannexation for property located on FM 1497, from the Pentecostal Church of Paris. She said the reasons stated in the application did not fall within any valid reason for disannexation under the City's policy or state law. She also said the annexation that occurred in 1999 moved on a fairly a straight line until it got to the church's property then jagged around to take in the church property and parcel directly to the north. She said staff could find no reason as to why the annexation line was drawn as such. She also said disannexation of the property would not create any impermissible islands or keyholes. Ms. Harris reported that the Church was not on city water or sewer and the City did not receive ad valorem taxes on the property because the church was tax exempt. Ms. Harris outlined one option as being to deny the request and the other option was to pass a resolution authorizing the disannexation process. After Ms. Harris answered questions from City Council, Regular Council Meeting January 22, 2024 Page 6 Pastor Chad McQueen addressed the City Council. He said he had lived on the property since 1996 and had no idea that it was annexed until the church recently purchased a building they were going to put on the property, and were informed they had to first obtain a city permit. He also said that when there was an accident on the road to the property, the police were called but turned it over to the Sheriff s Department because they said the property was in the county. A Motion to initiate the proceeds to disannex the property was made by Mayor Pro -Tem Pankaj and seconded by Council Member Moore. Motion carried, 5 ayes — 0 nays. 24. Receive a presentation about temporary placement of flags at the Paris Historic Downtown Plaza during the month of February honoring Black History Month; and provide direction to staff. Paris Police Department Community Outreach Coordinator Kimmie Snowton explained that every February, the United States celebrates the achievement and history of African Americans as part of Black History Month. In preparation for the upcoming Black History month, he said the police department and NAACP sought the Council's approval for temporary placement of eight flags at the Paris Historic Downtown Plaza, that four flags would be placed for two weeks followed by four new flags for the remaining two weeks of February. Mr. Snowton said these flags would be used to provide a brief recognition of eight local individuals who had played a positive and key role for African Americans in Paris. It was a consensus of City Council to move forward with temporary placement of the flags. 25. Consider adoption of RESOLUTION NO. 2024-010 A RESOLUTION DIRECTING PUBLICATION OF NOTICE OF INTENTION TO ISSUE CERTIFICATES OF OBLIGATION; AND RESOLVING OTHER MATTERS RELATING TO THE SUBJECT. Finance Director Gene Anderson said construction was ongoing and substantial completion of Phase I was scheduled for December 2024. He also said the City would soon need to receive bids on Phase 2 of the project, and the City must have the funds on hand to move forward with the project. Mr. Anderson said issuance of the certificates of obligation were needed to finance construction of the wastewater treatment plant. Mark McLiney of SAMCO presented City Council with a timeline. A Motion to approve this item was made by Council Member Kessel and seconded by Council Member Pilgrim. Motion carried, 5 ayes — 0 nays. 26. Discuss and act on RESOLUTION NO. 2024-011: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AN AMENDMENT TO THE MEMORANDUM OF UNDERSTANDING BETWEEN THE CITY OF PARIS AND THE RAM FOUNDATION DATED DECEMBER 15, 2021 RELATING TO DONATE FUNDS AND AUTHORIZING THE CITY MANAGER TO EXECUTE Regular Council Meeting January 22, 2024 Page 7 SAME; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND APPROVING AN EFFECTIVE DATE. Ms. Harris said in December 2021 the RAM Foundation made a donation of $300,000.00 to the City for use in the City's HOME Program to further RAM'S program of making affordable houses available to the City's residents. Ms. Harris explained that since the acceptance of donation and execution of the MOU, the City had not had an occasion to tap into the donated funds. She said RAM had requested a return of a portion of the donation to fund its own affordable housing project, and the portion of donated funds remaining was $191,227.84. A Motion to approve this item was made by Council Member Pilgrim and seconded by Mayor Pro -Tem Pankaj. Motion carried, 5 ayes — 0 nays. 27. Discuss and act on ORDINANCE NO. 2024-005: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING ARTICLE 5.11, "VEHICLES FOR HIRE," OF CHAPTER 5, "BUSINESS REGULATIONS;" PROVIDING A REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Deputy City Manager Rob Vine said City Council had been granting licenses to taxicab and shuttle services for years by individual ordinances, in compliance with the City Charter. He explained that the Ordinance was predated and needed a number of revisions, which included the addition of definitions, removal of permanent signs with the exception of taxi cabs, increasing the annual fee per licensed vehicle from $50.00 to $100.00, as well as several other amendments. Ms. Harris stated that one other amendment was the process of permitting would be done administratively as opposed to each company having an individual ordinance. A Motion to approve this item was made by Mayor Pro -Tem Pankaj and seconded by Council Member Pilgrim. Motion carried, 5 ayes — 0 nays. 28. Discuss and award a bid in the amount of $73,276.00 for Microsoft 365 integration service to Claro Enterprises Solutions, LLC; and authorize the City Manager to negotiate a contract in accordance with the bid and to execute same. IT Manager Celso Arrieta said the City published a request for proposals for implementation of Microsoft 365, and the City received one proposal from Claro. Discuss and act on ORDINANCE NO. 2024-006: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING SECTION APPENDIX A, "FEE SCHEDULE," ARTICLE A10.000, "UTILITY RATES AND CHARGES," Regular Council Meeting January 22, 2024 Page 8 SECTION A10.010, "RESIDENTIAL SOLID WASTE COLLECTION," AND REPEALING SECTION A10.011, "PICKUP OF BRUSH OF BULKY WASTE," OF THE CODE OF ORDINANCES OF THE CITY OF PARIS, TEXAS; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. Mr. Anderson said the City of Paris received two bids on July 10, 2023 to provide residential solid waste collection within the City, and the City Council voted August 28, 2023 to award the bid to CARDS. He said the increase would be $1.49 over what residents were currently paying. Mr. Anderson also said an ordinance would need to be adopted setting forth new rates for residential and waste collection within the City of Paris. A Motion to approve this item was made by Council Member Pilgrim and seconded by Council Member Moore. Motion carried, 5 ayes — 0 nays. 30. Convene into executive session pursuant to: A. Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about (1) pending or contemplated litigation and/or (2) on matters in which the duty of an attorney to her client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflict with this chapter, to -wit: the Belford Building. B. Section 551.072 of the Texas Government Code, to deliberate the purchase, exchange, lease, or value of real property if deliberation in an open meeting would have a detrimental effect on the position of the governmental body in negotiations with a third person. C. Section 551.074 of the Texas Government Code, to deliberate the appointment, employment, evaluation, reassignment, duties, discipline, or dismissal of a public officer or employee as follows: city manager. Mayor Hughes announced that item C would be not be discussed but would be scheduled for a later council meeting. Mayor Hughes convened City Council into executive session at 6:13 p.m. 31. Reconvene into open session and possibly take action on those matters discussed in executive session. A Motion to approve a Resolution (RESOLUTION NO. 2024-012) approving addendum number 3 to Grayson Path's Employment Agreement dated March 9, 2020, as written was made by Council Member Pilgrim and seconded by Mayor Pro -Tem Pankaj.
