SUBJECT: Review and Update of Development Fee Schedule

BACKGROUND
The City maintains a Fee Schedule in Appendix A for Development -related work the City
performs in the Building, Public Works, Engineering and Fire Marshall Departments. The purpose
of these fees is to offset public tax dollar expense directed towards development projects in town.
The rationale is the development project itself, and not the tax payers, should cover expenses for
zoning, platting, permitting, etc. While no fee schedule can ever truly account for the exact cost
(above or below) for each unique project, the goal is to set a reasonable fee that covers as much of
our cost as possible to help lessen the burden on the tax payers.
STATUS
With the above goals in mind, staff attempt to review our fees annually to determine if they are
appropriate and whether they need to be decreased, increased, added or deleted. We also examine
state legislation, such as HB 222 from this last year, to determine if changes need to be made
(which is the case with some platting fees). After conducting this review, which included a
combination of examination of state law changes, reviewing fees from some similar communities,
and where needed performing our own internal calculations on what it truly costs us to perform
certain tasks (particularly in platting), we have adjusted certain fees up and down to better reflect
cost. In some situations, we have also re -categorized and moved some fees from one section to
another. Some fees are being deleted while some new ones have been added. Again, the goal is to
reasonably cover our cost to avoid raising taxes to do so.
Significant changes include:
• Increasing deposit on construction meters to actual cost of meter.
• Reducing and capping Residential Remodel Permit Fee
• Increasing the Vacant Building Registration Fee
• Reducing Name Change ONLY CO Fee
• Re -categorizing Plat Fees and adjusting to cover our cost
• Insuring Engineering Fee align with State Law
The departments with fee modification are: Building, Engineering and Public Works. Fire
Marshall has no fee modification at this time.
The proposed fee modifications have been attached to this memo. We have included "editor notes"
in red ink to provide some additional comments behind the proposed edits.
BUDGET
The proposed fee schedules should better help cover certain expenses in the identified departments.
OPTIONS
1. Approve an ordinance adjusting the development -related fee schedule as proposed.
2. Request edits to the proposed fee schedule.
3. Request additional information on any proposed fee edit, including requesting edits to fees
that staff have not identified as being changed.
4. Reject the proposed fee schedule and keep the existing schedule intact.

ORDINANCE NO.
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS, AMENDING APPENDIX A, "FEE SCHEDULE," SECTION
A3.002, "DEVELOPMENT AND GENERAL CONSTRUCTION AND
PLANNING PERMIT FEES," OF THE CODE OF ORDINANCES OF THE
CITY OF PARIS; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A
SEVERABILITY CLAUSE, AND A SAVINGS CLAUSE; AND DECLARING
AN EFFECTIVE DATE.
WHEREAS, the Appendix A of the City of Paris Code of Ordinances provides a fee
schedule for city permits and services, including those related to construction and
development; and
WHEREAS, the City Council amended the fee schedule relating to construction and
development on December 12,2022; and
WHEREAS, city staff has conducted its annual review of the fee schedule relating to
planning, development, and construction fees and has proposed certain revisions thereto to
better reflect current costs of operation so that the cost of development remains with
developers rather than being passed on to the city's taxpayers at large; and
WHEREAS, staff has proposed certain revisions to platting fees to bring those fees in
line with recent legislative changes; and
WHEREAS, the City Council finds it desirable to revise these fees as proposed by city
staff,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby in
all things approved and are incorporated herein for all purposes.
Section 2. That Appendix A, Article A3.002, "Development and general
construction and planning permit fees," of the Code of Ordinances shall be and is hereby
amended to read as set forth in Exhibit A, attached hereto and incorporated by reference as
if fully set forth herein.
Section 3. That all provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 4. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any
penalty accruing or to accrue, or as affecting any rights of the municipality under any section
or provisions of any ordinance at the time of passage of this ordinance.
Section 5. That it is the intention of the City Council of the City of Paris that this
ordinance, and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 6. That this ordinance shall become effective from and after its passage.
