MINUTES OF THE BOARD OF ADJUSTMENT MEETING
OF THE CITY OF PARIS, TEXAS
JANUARY 2, 2024
The Board of Adjustment of the City of Paris met for a regular session at 12 p.m. on January
2, 2024, at the City of Paris- City Hall, Council Chambers located at 107 E Kaufinan St.
Present: Board Members: David Hamilton, Alix Putnam, Ben Vaughan, alternate
Larry Walker and Carlton Cooper.
City Representatives: Robert Vine, Duke McGee, Jacie Sparks and
Stephanie Harris.
Absent: Lydia Fitzgerald
The Board of Adjustment meeting was called to order by Alix Putnam, Vice Chairperson,
at 12: 01 p.m.
2. Approval of minutes from previous meeting. (November 7, 2023)
Motion was made by Larry Walker, seconded by Ben Vaughan to approve minutes for the
November 7, 2023 meeting. Motion carried 5 ayes — 0 nays.
3. Staff presentation and recommendation on Agenda item 4.
Duke McGee, Building Official; Assistant Director of Community Development,
presented the case, the City Staff's recommendation for approval of the lot width variance.
4. Public hearing to consider and take action on the petition of D. Wayne Brown, regarding
variances to the City of Paris Lot Width Requirements, Section 9-201(1) on Lot 1, Block A,
of the Culbertson Park Addition being located at 1532 E Hearon.
Mrs. Putnam opened the public hearing.
D. Wayne Brown of 3732 Lamar Avenue, Paris TX 75460, spoke in favor of the request.
Mr. Brown also presented a photograph of the residential structure that was on the property
previously. There was discussion amongst the Board, Mr. Brown, and City Staff regarding
parking, required set -backs and the building structure.
No one else spoke in favor or opposition of the request.
Public hearing was declared closed.
Motion was made to approve the variance to the City of Paris Lot Width Requirements,
Sections 9-201(1), by Larry Walker, seconded by David Hamilton. Motion carried 5 ayes
— 0 nays.

Board Recommended Conditions
1. All structure set -backs shall be met.
2. All other development, construction and building standards shall be met.

1. The request for variance is in harmony with the general purposes and intent of site
improvement regulations contained in the Zoning Ordinance 1710 Exhibit 9B and the
Subdivision Ordinance 1315 Exhibit 9A; and will protect the character of the immediate
vicinity of the area.
2. The approval of the variance for lot width will allow the plat to be approved without a condition
for variance allowing a single-family residence to be constructed.
3. There are special and unique condition(s) of existing sub -standard lot width which are not
applicable to all other existing parcels of land in the SF -2 Zoning District, and which cause
unusual and practical difficulty or unnecessary hardship to the use of the property with site
improvements permitted by the ordinance with the provision sought here to be varied. The
residential lot was previously created, consistent with the adjoining residential lots, but was
not officially platted.
4. The hardship sought to be avoided is not the result of (a) the applicant's own actions (self-
imposed or self-created), but rather it is based upon existing site parcel dimensions to support
new construction.
5. The provision of the ordinance regulation that are sought to be varied, deprive the applicant of
reasonable rights to use the property that are commonly enjoyed by other older residential
properties in the SF -2 Residential Zoning District which are required to comply with these
same ordinance provisions.
