2024-027 - Amend Zoning Historic Overlay District No. 2 Church Street to Single-Family Dwelling District No. 1ORDINANCE NO. 2024-027 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS AMENDING ZONING ORDINANCE NO.1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SO AS TO REZONE PROPERTIES LOCATED WITHIN HISTORIC OVERLAY DISTRICT NO. 2 (HD -2), OTHERWISE KNOWN AS THE CHURCH STREET HISTORIC DISTRICT TO SINGLE- FAMILY DWELLING DISTRICT NO. 1 (SF -1); DIRECTING CHANGES ACCORDINGLY IN THE OFFICIAL ZONING MAP OF THE CITY; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, A SAVINGS CLAUSE, A PENALTY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, on September 1, 2004, the City Council of the City of Paris passed Ordinance No. 2004-021 creating Historic Overlay District No. 2 (HD -2) for a portion of the city generally bounded by E. Kaufman Street on the north, 34th Street S.E. on the east, a distance north of Hearne Avenue on the south, and 1St St. S.W extending to a distance of 3rd Street S.W. on the west; and WHEREAS, HD -2 is often also referred to as the Church Street Historic District; and WHEREAS, Ordinance No. 2004-021 specifically "preserv[ed] the respective existing use and zoning designations of the property included" in the new historic overlay district; and WHEREAS, HD -2 contains properties zoned in various zoning classifications including Central Area (CA), Two -Family Dwelling District (217), Multiple Family Dwelling District No. 1 (MF -1), Planned Development (PD), Public Lands and Institutions (PLI), and Commercial District (C); and WHEREAS, at its regular meeting on June 24, 2024, City Council directed staff to initiate a zoning petition to rezone all properties within HD -2 which are not already zoned SF -1 to SF -1 to better preserve the character of HD -2; and WHEREAS, on August 5, 2024, following notice and publication as required by law, the Planning and Zoning Commission conducted a public hearing on the proposed amendments to the City Zoning Ordinance and, following said hearing, made formal recommendation to the City Council to approve the requested zoning; and, WHEREAS, on August 25, 2024, following notice and publication as required by law, the City Council of the City of Paris conducted a public hearing on the proposed amendments to the City Zoning Ordinance, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid zoning change would be consistent with the Comprehensive Future Land Use Plan of the City of Paris, consistent with the City Zoning Ordinance, and would be in the best interests of the public health, safety, and welfare of the citizens of the City of Paris by a vote of 6 ayes and 0 nays. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved and are incorporated herein for all purposes. Section 2. That the Official Zoning Map of the City of Paris, Texas and Zoning Ordinance No. 1710 of the City of Paris as heretofore amended is hereby further amended to rezone all properties within the boundaries of Historic Overlay District No. 2 (HD -2), to Single Family Dwelling District No. 1 (SF -1), excluding those properties already classified as SF -1. The affected properties fall within the boundaries of HD -2, which are shown on Exhibit A, attached hereto and incorporated herein by reference, and which are described as follows: Starting at the intersection of W. Sherman Street and 1St Street S.W., then south along 1St Street S.W. to Hearne Avenue, then east along Hearne Avenue along South Church Street to Kaufman Street. This is the general description of the area with the following additions and exclusions: The following lots are west of 1St Street S.W. and shall be included in the area: City Block 137, Lots 6, 6A, 7, 8, 9, 10, 11 and 12; City Block 149, Lots 6, 7, 8, 9, 10, 11, and 12; City Block 156, Lots, 7, 8, 9, 10, 11, 12, and 13. The following lots are east of S. Church Street and are excluded: City Block 181, Lots 1, 2, 3, 5, 6, and 9; City Block 140, Lots 1, 2, 3, 4, 4A, 5, 7, 8, 9, 10, 11, 12, 13, 14, and 15; City Block 159, Lots 1, 2, 3, 4, 7, 8, 9, 10, 11, 12, 15, 15B, 16, 17, and 18A. The following lots are north of Hearn Avenue and shall be excluded: City Block 157, Lots 18, 19, 20, and 21; City Block 158-A, Lot 3. Section 3. That the Chief Building Official of the City of Paris be, and he is hereby, directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes set forth in this ordinance. Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 6. That it is the intention of the City Council of the City of Paris that this ordinance and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 7. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above -enumerated sections shall constitute and be deemed a separate offense. Section 8. This ordinance shall become effective from and after its passage and publication as required by law.
