2024-042 - Amend Section 8 Use of Land and Buildings to provide definitions for Recycling Processing Facility - Recycling Transfer Station and Indoor Shooting RangeORDINANCE NO. 2024-042 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS AMENDING ZONING ORDINANCE NO. 1710 OF THE CITY OF PARIS, TEXAS, AS HERETOFORE AMENDED, SEC. 8, "USE OF LAND AND BUILDINGS," TO PROVIDE DEFINITIONS FOR "RECYCLING PROCESSING FACILITY," "RECYCLING TRANSFER STATION,' AND "SHOOTING RANGE—INDOOR" AND TO DESIGNATE ZONING DISTRICTS IN WHICH SAME MAY BE LOCATED; PROVIDING A REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, the City of Paris adopted a temporary Zoning Ordinance in 1942, and ordinances amending the Zoning Ordinance were passed by the City Council in 1945, 1957, and 1965; and WHEREAS, additional amendments were added to Zoning Ordinance No. 1710 (April 12, 1965) during 1971 through 1987 and 2012 and in 2016-2024; and WHEREAS, portions of the Paris Zoning Ordinance are outdated, and therefore do not, in certain instances, reflect current and appropriate American zoning practice; and WHEREAS, the City of Paris staff and officials desire to partially update and amend portions of Zoning Ordinance No. 1710 to aid in the more efficient growth and development of the City of Paris, Texas; and WHEREAS, in order to foster said growth, from time to time it is desirable to add new approved uses to said Zoning Ordinance; and WHEREAS, the city has been approached by various parties wishing to develop projects in the categories of recycling processing facility, recycling transfer station, and indoor shooting range, none of which are currently provided for in the Zoning Ordinance; and WHEREAS, on October 7, 2024, following notice and publication as required by law, the Planning and Zoning Commission conducted a public hearing on proposed text amendments to Zoning Ordinance No. 1710 providing definitions for "Recycling Processing Facility," "Recycling Transfer Station," and "Shooting Range—Indoor" and designating zoning districts for the locations thereof, and following said hearing, made formal recommendation to the City Council to approve the requested amendments; and WHEREAS, on October 28, 2024, following notice and publication as required by law, the City Council of the City of Paris conducted a public hearing on the proposed amendments to Zoning Ordinance No. 1710 and the Code of Ordinances, and having considered the recommendation of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that approving the aforesaid amendments would be consistent with Zoning Ordinance No. 1710 and the City Code of Ordinances, and in the best interests of the public health, safety, and welfare of the citizens of the City of Paris by a vote of ? ayes and 0 nays. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved and are incorporated herein for all purposes. Section 2. That City of Paris Zoning Ordinance No. 1710 Sec. 8-107, "Commercial & Service Uses," shall be amended to add "Shooting Range—Indoor" as a permitted use (P) in the Light Industrial (LI) and Heavy Industrial (HI) zoning districts and further allowed in the Agricultural (A), Commercial (C), and Public Lands & Institutions (PLI) zoning districts with a Specific Use Permit (S). Said addition shall be inserted between "Self-Storage/Mini Warehouse" and "Trailer Rental or Sales." Section 3. That City of Paris Zoning Ordinance No. 1710 Sec. 8-108, "Industrial Uses," shall be amended to add "Recycling Processing Facility' and "Recycling Transfer Station" as allowable with a Specific Use Permit (S) in the Light Industrial (LI) and Heavy Industrial (HI) zoning districts, and said addition shall be inserted between "Railroad Team Track, Freight Depot and Docks" and "Scientific and Research Laboratories." Section 4. That Section 8-201 of Zoning Ordinance No. 1710 is hereby amended to add the following new definitions, numbered as set forth herein, with existing definitions renumbered accordingly: "67. Recycling Processing Facility—A building or enclosed space for the collection and processing of recyclable materials. "Processing" means the preparation of material for efficient shipment, or to an end user's specifications, by such means as baling, briquetting, compacting, flattening, grinding, crushing, shredding, mechanical sorting, cleaning, and re -manufacturing. Processing facilities include light processing facilities and heavy processing facilities. "68. Recycling Transfer Station—A facility that receives recyclable materials, typically from small collection facilities and commercial vehicles for the purpose of storing, handling, batching and baling, or sorting prior to transferring to another facility. Such a facility may be involved with recycling -related collection activities not allowed at small collection facilities." PA "73. Shooting Range—Indoor—A structure specifically designed for the safe discharge and use of rifles, shotguns, pistols, archer devices, and other types of firearms for the purpose of sport shooting, target practice, competitions, firearms education, or military or law enforcement training, entirely enclosed within a building. The term may include, as an accessory use, the sales of handguns and other firearms, ammunition, sport shooting and hunting supplies. A facility falling under this definition must follow all state and federal laws." Section 5. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 6. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 7. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section B. That any person violating any provision of this ordinance shall be guilty of a misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above -enumerated sections shall constitute and be deemed a separate offense. Section 9. This ordinance shall become effective on from and after its passage and publication as required by law.
