at 8:55 a.m. on Wednesday, November 20, 2024. The meeting will be held at the City Council
Chamber, 107 E. Kaufman Street, in Paris, Texas. One or all Council Members may be
attending remotely, but the feed will be available for live viewing at

Opening Agenda
1. Call meeting to order.

3. United States Pledge of Allegiance & Texas Pledge of Allegiance.

SUBJECT: Atmos Gas Easement on City Hall Property

BACKGROUND:
The developer of a new restaurant at 138 Clarksville Street (the old Ludwick Grocery building) is
requesting a utility easement for natural gas service across the City Hall parking lot to the private
alley behind the 138 Clarskville. This building will be a new restaurant, and needs natural gas
service. The gas line would extend from near the intersection of Kaufinan Street and Church,
across the eastern edge of the parking lot, across the alley to the new restaurant.
STATUS OF ISSUE:
The closest gas line to the new business is on East Kaufinan Street. In order to keep open road
cuts on Church Street to a minimum, the best location for the gas service line is just inside the
sidewalk adjacent to Church Street. This is the most efficient way to service this location.
The underground utility easement would come from Kaufinan Street, just inside the City Hall
parking lot, to the back of the 138 Clarskville building. The parking lot, fence, and/or sidewalk
will be restored to as good or better condition than previous to excavation.
Exhibit A shows this 5'easement.
BUDGET:
This activity will occur at no cost to the city.
OPTIONS:
1. Authorize the Mayor to sign the Utility Easement with Atmos.
2. Request additional information and/or deny authorization to sign the Utility Easement.

Being 0.0123 acre of land situated within the corporate limits of the City of Paris, being part of the Larkin Rattan
Survey, Abstract Number 778, and being part of a tract of land conveyed from Dorothy Fowler Gibbons to the City of Paris
on April 22, 1925 by Warranty Deed recorded in Volume 208, Page 285 of the Deed Records of Lamar County, Texas. The
said 0.0123 acre tract of land fully described by metes and bounds as follows:
Beginning at a 1001) nail set at the Northeast corner the aforementioned City of Paris tract and at the Southeast
comer of an "Open Alley" shown and recorded in Envelope 110-A of the Plat Records of Lamar County, and conveyed from
Edward G. Gibbons to Kate Gibbons on March 22, 1917 by Warranty Deed recorded in Volume 160, Page 562 of the Deed
Records of Lamar County, and said nail also being located in the West right of way line of Church Street (40 foot right of
way width as per the plat of the Original Donation of the City of Paris recorded in Deed Records Volume G, Page 299);
Thence South 01'37'44" East, along the East boundary line of the aforementioned City of Paris tract and the West

The developer of a new restaurant at 138 Clarksville Street (the old Ludwick Grocery building) is
requesting an aerial power easement from the existing power pole in the City Hall parking lot to
the private alley behind the 138 Clarskville. This building will be a new restaurant, and needs new
3 phase power service.
STATUS OF ISSUE:
In order to keep the number of new power poles to a minimum, especially along the sidewalk
adjacent to Church Street, an aerial 3 phase power service from the existing pole in the city hall
parking lot is the most efficient way to service this location.
The new aerial power service would come from the pole on the left center of the photo, to the right
of the trash dumpster, to a new private pole in the alley.
Exhibit A shows this 10' aerial easement.

That City of Paris, hereinafter called "Grantor," whether one or more, for and in
consideration of Ten Dollars ($10.00) and other valuable consideration to Grantor in hand paid by
Oncor Electric Delivery Company LLC, a Delaware limited liability company, 1616 Woodall
Rodgers Freeway, Dallas, Texas 75202-1234, hereinafter referred to as "Grantee," has granted,
sold and conveyed and by these presents does grant, sell and convey unto said Grantee, its
successors and assigns, an easement and right-of-way for overhead and/or underground electric
supply and communications facilities, consisting of a variable number of wires and cables,
supporting structures, surface mounted equipment, conduits and all necessary or desirable
appurtenances over, under, through, across and upon Grantor's land described as follows:

Grantor recognizes that the general course of said lines, or the metes and bounds as
described above, is based on preliminary surveys only, and Grantor hereby agrees that the
easement and right-of-way and its general dimensions hereby granted shall apply to the actual
location of said lines when constructed.
Together with the right of ingress and egress along and upon said easement and right-of-
way and over and across Grantor's adjoining properties for the purpose of and with the right to
construct, maintain, operate, repair, remove, replace, reconstruct, abandon in place, and to
change the size and capacity of said facilities; the right to relocate said facilities in the same
relative direction of said facilities; the right to relocate said facilities in the same relative position to
any adjacent road if and as such is widened in the future; the right to lease wire space for the
purpose of permitting others to string or lay wire or cable along said facilities; the right to prevent
excavation within the easement area; the right to prevent construction of, within the easement
area, any and all buildings, structures or other obstructions which, in the solejudgment of Grantee,
may endanger or interfere with the efficiency, safety, and/or convenient operation of said facilities
and their appurtenances and the right to trim or remove trees or shrubbery within, but not limited
to, said easement area, including by use of herbicides or other similar chemicals approved by the
U.S. Environmental Protection Agency, to the extent in the sole judgment of Grantee, as may be
necessary to prevent possible interference with the operation of said facilities or to remove
possible hazard thereto. Grantor shall not make changes in grade, elevation or contour of the land
or impound water within the easement area as described above without prior written consent of
Grantee.

Grantor reserves the right to use the land within the above described easement area for
purposes not inconsistent with Grantee's use of such property, provided such use shall not, in the

Being 0.0144 acre of land situated within the corporate limits of the City of Paris, being part of the Larkin Rattan
Survey, Abstract Number 778, and being part of a tract of land conveyed from Dorothy Fowler Gibbons to the City of Paris
on April 22, 1925 by Warranty Deed recorded in Volume 208, Page 285 of the Deed Records of Lamar County, Texas. The
said 0.0144 acre tract of land fully described by metes and bounds as follows:
Beginning at a point for easement corner in the North boundary line of the aforementioned City of Paris tract and
in the South boundary line of an "Open Alley" shown and recorded in 110-A of the Plat Records of Lamar County, conveyed
from Edward G. Gibbons to Kate Gibbons on March 22, 1917 by Warranty Deed recorded in Volume 160, Page 562 of the
Deed Records of Lamar County, from said point a 100D nail set at the Northwest corner of said City of Paris tract bears
South 89°21'07" West a distance of 7.10 feet, and from said nail a '/2 inch capped [EST] iron rod found (Controlling
Monument, hereafter referred to as CM) as reference bears North O1 °46'32" West a distance of 8.00 feet
Thence North 89°21'07" East, along the common boundary line of the aforementioned City of Paris tract and the
aforementioned Alley, a distance of 10.00 feet to a point for easement corner, from said point a I OOD nail set at the Northeast
corner of said City of Paris tract bears North 89°21'07" East a distance of 33.90 feet;
Thence South 00°03'50" East, a distance of 62.62 feet to a point for easement corner;
Thence South 89'56'10" West, a distance of 10.00 feet to a point for easement corner;
Thence North 00°03'50" West, a distance of 62.52 feet to the place of beginning and containing 0.0144 acre of land.
