12/03/2024 MinutesBoard of Adjustment Meeting December 3, 2024 Page I MINUTES OF THE BOARD OF ADJUSTMENT MEETING OF THE CITY OF PARIS, TEXAS DECEMBER 3, 2024 The Board of Adjustment of the City of Paris met for a regular session at 12 p.m. on December 3, 2024, at the City of Paris- City Hall, Council Chambers located at 107 E Kaufman St. Present-, Board Members: David Hamilton, William Sanders, Ben Vaughan, Richard Thompson and Jerry Williams. City Representative.- Stephanie Harris SII Osei Amo-Mensah. Absent: Harlel= 1. The Board of adjustment meeting was called to order by Chairman David Hamilton, at 12:00p.m. 2. Approval of minutesfrom previous meeting. (November 5, 2024) Motion was made by Richard Thompson, seconded by Ben Vaughan to approve minutes for the November 5, 2024 meeting. Motion carried 5 ayes — 0 nays. 3. Public hearing to consider and take action on the petition of Terry Martin regarding variances to the City of Paris A ccessorBuilding and Area Regulations, on Lot 3, Block y A, of the Alorth Park Estates, being located at 3430 Vagas Drive. Sections and variances asfollows.- 1) Variance to allow a detached accessory structure in the front yard, Section 13-101 (a). 2) .13'variance to allow a detached accessory structure to be located 0,from main structure, Section 13-101 (c). 3) 20' variance to allow a detached accessory structure in the front yard creating a 5 'front setback, Section 9-501 (1). David Hamilton opened the public hearing. Director of Planning and Zoning, Osei Amo-Mensah presented case to board. Terry Martin, applicant, spoke to the board in regard to the need for the carport to accommodate his brother's vehicle. Though he has a two -car garage, you cannot easily fit two cars in there and he has tools!, his lawn -mower and generator stored in there. Tony Martin, of 3430 Vagas Drive, spoke in favor of the request. He moved in with his Board of Adjustment Meeting December 3, 2024 Page 2 brother 7 years ago and would like a place to park besides on the street where he has been parking. He would like to avoid someone crashing into his car on the street and prevent hail damage due to several storms we've had. Currently, he drives his car to the car wash when we have a storm to avoid damage. There was discussion amongst the board and the applicant about whether the proposed carport would obstruct the view of traffic on the street, conditions of existing garage and if there had been any damage to vehicles from any of the storms. David Hamilton made note of the I input received in favor of the request. No one else spoke in favor or opposition of the request. Public hearing was declared closed. Motion was made by Ben Vaughan, seconded by Richard Thompson to deny the variances to the City of Paris Area Regulations and Accessory Building Regulations based on the following findings. Motion carried 5 ayes - 0 nays. Fin 1. The carport structure setbacks cannot be met. 2. The lot is plated. 3. The request for variances is not in harmony with the general purposes and intent of area regulations for accessory buildings in residential and apartment districts contained in the Zoning Ordinance 1710 Subsection 13-101. (a & c), and will not protect the character of the 'Immediate vicinity of the area. 4. There are no special or unique condition(s) of restricted area, shape, topography, or physical features that exist on the subject parcel of land that cause unusual and practical difficulty or unnecessary hardship in compliance with the provisions sought here to be vaned. 5. The hardship sought to be avoided is the result of (a) the applicant's own actions (self- imposed or self-created), and no (b) economic or financial "hardship." 6. The provision of the ordinance regulation that are sought to be varied, does not deprive the applicant of reasonable rights to use the property that are commonly enjoyed by other residential properties in the SF -2 Residential Zoning District which are required to comply with these same ordinance provisions.
