Discuss, conduct a public hearing, and act on an Ordinance regarding the petition of Madeline Knecht on behalf of Phan T. Nguygen for a zoning change from General Retail (GR) to Commercial (C) in the City of Paris, Block 315, Lot 13, LCAD 50943, located at 4225 Lamar Avenue. 14. Discuss, conduct a public hearing and act on a Resolution of the City Council Re- authorizing the City to become eligible to participate in Residential Tax Abatements and Approving Guidelines and Criteria for the Residential Tax Abatement Program. (Prior to discussion, a Motion to remove this item from the table is required) 15. Discuss and act on a Resolution stating the intent of the City of Paris, pursuant to Section 7 of the City Charter and Section 43.142 of the Local Government Code, to disannex approximately 71.20 acres of land forming a portion of the current southwestern boundary of the City located along and South of State Highway 271 South; establishing hearing date; providing for personal and published notice; making other findings and provisions related to the subject; and providing an effective date. 16. Receive the Paris Economic Development Corporation 2024 Annual Report. 17. Discuss and act on an Ordinance declaring Mihir Pankaj as unopposed in Council District 4, Rebecca Norment as unopposed in Council District 5 and Tracy Attebury as unopposed in District 7; cancelling the General Election in Districts 4, 5 & 7; and declaring the unopposed candidates as elected to office pursuant to Election Code Section 2.053. 18. Discuss and authorize the City Manager to execute grant documents for funds and forward to TxDOT for the upcoming fuel farm project scheduled for 2026. (This project was budgeted for $120,000.00 and $60,000.00 will be expended). 19. Discuss a strategic plan for the City of Paris, receive bids, and possibly act on consulting services for strategic plan services. 20. Convene into executive session pursuant to Section 551.071 of the Texas Government Code, Consultation with Attorney, to receive legal advice from the City Attorney about (1) pending or contemplated litigation and/or (2) on matters in which the duty of an attorney to her client under the Texas Disciplinary Rules of Professional Conduct of the State Bar of Texas clearly conflict with this chapter, two -wit: litigation and pending litigation update. 21. Reconvene into open session and possibly take action on those matters discussed in executive session. 22. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. 23. Adjournment. Main — he said he had called Council Member Norment about the train that goes through the Historic District at 3:00 a.m. sounding its horn. Main — she also referenced the train and said they laid on the horns and they were loud. She said maybe something could be done. Alvin Atwood, 2419 Bonham — he said the train horns had awaken him many times. He also said their water bills were too high right now and people could not afford it. Consent Anda Mayor Pankaj said item 7 was to have been posted for a public hearing, so he needed a Motion to pull it and table it to the next meeting. Regular Council Meeting February 10, 2025 Page 3 11. Approve Liberty National Bank to serve as the City of Paris depository bank for the period March 1, 2025, through February 28, 2027. Re alar A Benda 12. Receive presentation of summary of findings on review of Paris TIRZ #1 and overview of training to be presented to the TIRZ Board of Directors. Director of Planning & Community Development Osei Amo-Mensah said the TIRZ Board hired consultant, Forked Pine, LLC, to assist the board with possibly amending the project and financing plans for TIRZ No. 1. He introduced Consultants Joseph and Cheryl Denny who gave a summary of the project, which included the boundaries, funds collected and what the funds could be spent on. Council Member Putnam inquired about the duration of the 50% increment. Mr. Denny said the timeframe was 2019-2049. Council Member Putnam asked if private investors could use the TIRZ money and Mr. Denny said yes. Council Member Putnam asked which zone the money could be spent. Mr. Denny said Zone 2, which was the downtown area because that is how it was currently set up. 13. Discuss and act on a Resolution approving and authorizing an Economic Development Agreement and Tax Abatement Agreement with Invest Lamar, LLC pursuant to the 5 in 5 Housing Infill Development Program. Mayor Pankaj said Staff learned earlier in the day that Invest Lamar, LLC had withdrawn their application. 14. Discuss and act on the appointment of Paula Portugal to fill the unexpired term of Tylesha Moseley on the Planning and Zoning Commission. City Clerk Janice Ellis said staff had been advertising this vacancy for several months and they had received an application from Paula Portugal. A Motion to appoint Paula Portugal to the Planning and Zoning Commission was made by Council Member Putnam and seconded by Council Member Norment. Motion carried, 6 ayes — 0 nays. 15. Receive applications for disannexation and provide direction to Staff. City Attorney Stephanie Harris said the City had received applications for disannexation from three property owners and grounds cited were lack of access to city water or sewer. She explained that Dr. Kraft's existing building had both water and sewer service. She also said the property was subject to imminent domain because of the 271 South widening project. Ms. Harris explained that the petitions met the criteria for the City to grant disannexation and if the Council wanted to proceed with doing so, public hearings would be required. She also said the agenda posting did not allow for action but for direction. Regular Council Meeting February 10, 2025 Page 4 Dr. Wally Kraft addressed the City Council and said he was going to have to tear down his veterinarian clinic and build another clinic further back on the property. Ms. Harris said if it was a consensus to move forward with disannexation, she could bring back a resolution to the next meeting. Council Member Putnam said she understood these were special circumstances but that she was opposed for the City to disannex any property. It was a consensus of the remainder of the City Council to move forward with disannexation. 16. Receive an update on the Fuel Farm Project, discuss and provide direction to Staff. Deputy City Manager Rob Vine explained that Lamar County had designed a fuel farm, and the total cost of the fuel farm was approximately $800,000.00. He reported that discussions had continued to take place regarding a potential partnership between the City and County to construct, manage and maintain a share fuel farm with the most recent meeting taking place last week. Mr. Vine said the next step was to enter into an Interlocal Agreement and the County was proposing a 50/50 split of the initial investment. Mr. Vine said Staff was looking for direction. Mayor Pankaj inquired if there would be a joint meeting prior to approval of the agreement. Mr. Vine answered in the affirmative. Mayor Pro -Tem Savage said they would need enough advance notice so that everyone would be able to attend the meeting. 17. Consider and approve future events for City Council and/or City Staff pursuant to Resolution No. 2004-081. With regard to item 13, Council Member Putnam said she wanted to have a discussion about what the houses look like that were being built and were going into this program. She said she would like a Council Member to be involved. She referenced building materials. Ms. Harris inquired if she wanted a future item or if she wanted ideas from staff. Council Member Putnam said ideas from Staff would be fine and asked that they find out what other cities were doing. 18. Adjournment. Motion passed. 4. Coordinators Report - Coordinator Bedford led the board through each of the 6 standards of the Annual Assessment to achieve accreditation. We are a city funded and city supported Main Street Program. Collectively the board recommended a #3 average score. Bedford also gave a 2024 Year in Review including all the successful events and major upgrades that Downtown Paris has had. 5. Committee Reports Transforming Strategies: Hart reported that an Artist Meet and Greet is set for Friday, January 24th. Gathering local artists and networking is the goal. PDA Report: Emmite reported that PDA had a 2025 planning meeting. Chamber Report: Karen D. reported that the Tower City Comedy tour is the week of January 23rd. Ms. Hammond arrived at 4:03. 4, Receive presentation of Phase 1 from Forked Pine Consulting. Joseph Denny from Forked Pine Consulting gave a presentation about the status of Phase 1. He stated that City staff as well as the staff at the Lamar County Appraisal District office have been extremely helpful. Some data quality issues took a while to resolve, causing the timeline to be shifted just a little bit. He wrapped up his presentation by stating that the analysis is ongoing, and they are getting very close to completing that portion. Chairman Head asked for clarification that Mr. Denny had everything he needed to complete the project. Mr. Denny stated that he believed so, the questions now were just figuring out where the numbers he was given came from and Ms. Harris was helping him with this. Ms. Harris stated that the Council did a "clean up" ordinance a couple years ago to clarify the boundaries. She mentioned that it came up today whether that process deleted or added new properties, and if it did -it shouldn't make a big difference in the numbers, but she will chase it down. Mr. Denny stated that he and Ms. Denny are planning to attend the January 9t1i meeting to provide some educational training, and again in February to do a presentation to the City Council, the full Financial and Compliance Report and potentially public outreach if the board is interested. Mr. Denny said they were very flexible and were willing to work with the board however worked best for them. Following further discussion, Mr. Denny stated that he was optimistic and looked forward to seeing everybody. Mr. Denny Page 1 of 2 left the meeting at 4:20 P.M. 5. Request future agenda items. It appears that there may be a buyer interested in rehabilitating the structure and some discussion followed as to how the structure can be removed from the demolition list if purchased. STATUS OF ISSUE: This report updates the City Council on the City's financial activities through the month stated in the subject line. BUDGET: Not affected by this report. RECOMMENDATION: Motion to receive the monthly financial report. City of Paris January 2025 Financial Report Comments Net to Date Comparison of Revenues: 1. The operations and maintenance property tax and related collections reported are 23.84% less than what was reported in 2024. This large difference is a timing issue between when the Lamar County Appraisal District collects taxes and when they distribute those collections to the entities. Current tax collections this year are 62.96% of the tax levy vs. 86.04% last year. 2. Sales taxes are up 0.97% from last year ($34,489). 3. Hotel occupancy taxes are up 20.47% compared to last year ($112,473). 4. Franchise fees are up 6.54% compared to last year ($68,949). 5. Permit fees are down 53.55% from last year ($164,092). Building permit fees for new construction were unusually high last year. 6. Municipal Court fines and related fees are up 22.67% compared to last year ($9,116). 7. Other revenue includes leases, interest, copy fees, birth & death certificates, library fees, mixed beverage tax, and other minor revenues. This revenue is up 21.24% ($55,238). 8. Sanitation fees are up 647.23% ($439,373). This large increase is due to the closing of the Sanitation Fund and redirecting the funding to pay for CARDS services and other sanitation efforts in the general fund. 9. EMS fees are up 52.17% compared to last year ($639,491). Our 3`d party collection agency had issues in the first quarter of last year. Collections were well below what they should have been. The company addressed the issue and collections picked up. 10. Lamar County EMS contributions are up 5.58% ($8,296) compared to last year. 11. Interest revenues are down 28.94% ($116,367). Interest rates have dropped somewhat from their peak, but the timing of interest payments also impacts this revenue. 12. W&S Admin Fees are up 8.33% ($33,333). This increase was expected and allowed for in the budget. 13. Other revenue sources were up 14.46% (43,964). 14. Total General Fund revenues are down 3.92% compared to last year ($598,175). This is due to the slow reporting of property tax revenues. General Fund revenues equal 50.58% of the budget with the City being 33.33% through the budget year. 15. Total General Fund expenditures are up 15.53% ($1,401,659) compared to last year. General Fund expenditures to date equal 29.09% of budget with the City being 33.33% through the budget year. 16. Sewer revenue was up 4.58% ($167,112). 17. Water revenue was up 7.65% ($225,862). 18. Other revenue sources are down 9.27% ($25,435). 19. Total Water & Sewer revenues, ignoring transfers and adjustments, are 5.35% above last year ($367,539) and represent 32.63% of the total budget. 20. Total Water & Sewer expenses are 10.25% above last year ($392,264) at this point and represent 19.09% of the total budget (38.32% adjusted for debt payments.) while the City is 33.33% through the budget year. 21. The Airport Fund revenues are up 15.39% ($44,469) compared to last year. Expenditures are up 3.53% ($12,215) compared to last year. This leaves the airport with a $24,579 operating deficit after four months of operation and a $7,975 cash deficit. Departmental Expenditure Summary: At this point the City is four months or 33.33% through the budget year. It is important to remember that expenditures do not occur equally throughout the year. For example, capital expenditures and association memberships are one-time expenditures that if made early in the fiscal year can produce a distorted expenditure percentage. Within the General, Water & Sewer, and Airport Funds there were seven departments whose expenditures were over 33.33%. 1. City Council -52.02%. The overage amounts to $29,546 and was due to the City Manager search and the annual insurance payment. 2. Public Works -34.27%. The overage amounts to $2,487 and was due to insurance expense. 3. Traffic & Public Lighting -35.61%. The overage amounts to $12,225 and was due to the construction of bus stops. 4. Library -37.18%. The overage amounts to $34,319 and was caused by insurance expenses and upgrade to children's area. S. Water Billing -33.45%. The overage amounts to $3,892 and was due to software payments, annual insurance payment, and incorrect posting of a charge to this department. 6. Wastewater Treatment Plant -34.37%. The overage amounts to $28,315 and was due to insurance, permits, and audit fees. 7. Airport -33.58%. The overage amounts to $2,662 and was caused by the annual insurance payment, the ground power unit, and building maintenance. General comments to the City Council: Over 99% of all the City operational activity takes place in the General Fund, the Water & Sewer Fund, and the Airport Fund. The other funds are special purpose funds with limited activity and usually with legal restrictions on what their money can be spent on. For that reason, I normally only comment on the activity of the General Fund, Water & Sewer Fund, and Airport Fund. However, if circumstances merited it, I would make comment on activity in one of the other funds. I attempt to anticipate questions you might have about the report and comment on those points. After you receive your packet and review the monthly report, if you have questions about the report, please let me know before the Council meeting, if possible, in case I must research the answer to your question. That does not prevent you from asking the question at the meeting if you wish to make a point, but it does help prevent questions coming up that I can't answer on the spot and possibly delay the Council in making a decision. DATE: February 24, 2025 BACKGROUND The applicant Madeline Knecht on behalf of property owner Phan T. Nguygen is seeking a minor amendment to the Comprehensive Plan being a High Density Residential (HDR) to provide for a Commercial Density (C) for Future Land Use Map of the property. The lot is currently zoned General Retail (GR) District, in the City of Paris, Block 315, Lot 13, LCAD 50943, (1.745 acres) located at 4225 Lamar Ave. Also, on this agenda (Item 2) is a zoning change request from General Retail (GR) to Commercial (C). Good access and connections to utilities are available at this location. Commercial development in this location will provide conformity and will serve the immediate and long-term needs of the vicinity. However, an appropriate buffer must be provided to the northwest portion of adjacent residential zoning district to minimize incompatible uses between Residential and Automobile repair noise or nuisance. ANALYSIS • The land to the North is part undeveloped, zoned part Agricultural (A) District and Single Family (SF -2) District to the northwest (and is guided for High Density Residential -HDR). • The land directly across from Lamar Avenue to the South is zoned Commercial (C) District, which is guided for Retail (R) and developed as commercial businesses such as carwash and gas station. • The land to the East is zoned Planned Development (PD) District and guided for Low Density Residential (LDR) and is currently being developed for senior apartments. • The land to the West is zoned General Retail (GR) District at the lower portion toward Lamar Avenue with Jewelry store which is guided for Retail (R) while the upper portion is zoned Single Family Dwelling SF -2 District and guided for Low Density Residential (LDR) which is currently developed as single-family dwellings. ISSUE: The application for the zoning change at this site location from General Retail (GR) to Commercial (C) is the reason for the request for a minor amendment to the Comprehensive Plan being a High Density Residential (HDR) to provide for a Commercial Density (C) for the Future Land Use Map. AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, APPROVING AND ADOPTING AMENDMENTS TO THE COMPREHENSIVE PLAN AND FUTURE LAND USE MAP FOR THE CITY OF PARIS FROM HIGH DENSITY RESIDENTIAL (HDR) TO COMMERCIAL (C) IN THE CITY OF PARIS, BLOCK 315, LOT 13, LCAD NO. 50943, LOCATED AT 4225 LAMAR AVE.; MAKING OTHER FINDINGS AND PROVISIONS RELEATED TO THE SUBJECT; PROVIDING A REPEALER CLAUSE, A SEVERABILITY CLAUSE, AND A SAVINGS CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, Section 211.004 of the Texas Local Government Code requires that all zoning regulations must be adopted in accordance with a comprehensive plan and must be designed to lessen congestion in the streets; secure safety from fire, panic, and other dangers; promote health and the general welfare; provide adequate light and air; prevent the overcrowding of land; avoid undue concentration of population; or facilitate the adequate provision of transportation, water, sewers, schools, parks, and other public requirements; and, WHEREAS, Chapter 213, of the Texas Local Government Code empowers municipalities for the purpose of promoting sound development and promoting public health, safety, and welfare to adopt a comprehensive plan for the long range development of said municipalities; and, WHEREAS, Chapter 213 of the Local Government Code empowers a municipality to define the content and design of a comprehensive plan; and, WHEREAS, Chapter 213 of the Local Government Code provides that a comprehensive plan may: 1. Include but is not limited to provisions on land use, transportation, and public facilities; 2. Consist of a single plan or a coordinated set of plans organized by subject and geographic areas; and 3. Be used to coordinate and guide the establishment of development regulations; and, WHEREAS, the adoption of the proposed Comprehensive Plan shall not, in accordance with Section 213.004 of the Local Government Code, limit the ability of the City of Paris to prepare other plans, policies, or strategies related to land use and land use planning as required; and, WHEREAS, in September 2001, the City Council adopted a City of Paris, Texas Comprehensive Plan and Future Land Use Map; and, WHEREAS, said 2001 Comprehensive Plan and Future Land Use Plan and said Land Use Plan Definitions were amended and adopted in May, 2008, and, WHEREAS, in October of 2018, the City Council adopted significant revisions to the Comprehensive Plan and the Future Land Use Plan; and WHEREAS, the City Council of the City of Paris, Texas, received a petition for amendments to the Comprehensive Plan and Future Land Use Map for the City of Paris from High Density Residential (HDR) to commercial (C) in the City of Paris, Block 315, Lot 13, LCAD No. 50943, located at 4225 Lamar Ave.; and WHEREAS, analysis of the existing conditions of the neighborhood supports such a change to the Comprehensive Plan and the Future Land Use Map; and WHEREAS, on February 3, 2025, the Planning and Zoning Commission conducted a public hearing on said proposed amendment after notice and publication as required by law, and, following said hearing, made formal recommendation to the City Council in favor of said proposed Comprehensive Plan and Future Land Use Map Amendments; and WHEREAS, on February 24, 2025, after notice and publication as required by law, the City Council of the City of Paris held a public hearing to receive input from the citizens of the City of Paris regarding the proposed amendment to the Future Land Use Map and the City Council determined that this amendment would be in the best interest of the City of Paris and its citizens, and the same should be approved. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. ANALYSIS • The land to the North is part undeveloped, zoned part Agriculture (A) District and Single Family (SF -2) District to the northwest (and is guided for High Density Residential -HDR). • The land directly across from Lamar Avenue to the South is zoned Commercial (C) District, which is guided for Retail (R) and developed as commercial businesses such as carwash and gas station. • The land to the East is zoned Planned Development (PD) District and guided for Low Density Residential (LDR) and is currently undeveloped. • The land to the West is zoned General Retail (GR) District at the lower portion toward Lamar Avenue with Jewelry store which is guided for Retail (R) while the upper portion is zoned Single Family Dwelling SF -2 District and guided for Low Density Residential (LDR) which is currently developed as single-family dwellings. ISSUE: The application for the zoning change is because the proposed use which is to provide brakes and rotor service is not permitted under the current zoning district that is General Retail District (GR). This reinvestment zone included all areas inside Council districts 1-5. At the same time, Council adopted Resolution No. 2013-23, which adopted guidelines and criteria for such residential tax abatements. On February 9, 2015, Council passed Ordinance No. 2015-002 amending Reinvestment Zone 2013-1 to expand it to include all Council districts in the city and designated the new reinvestment zone as 2015-1. On April 22, 2019, Council approved Resolution No. 2019-013 readopting the guidelines and criteria for residential tax abatements. Council reauthorized Reinvestment Zone No. 2015-002, renaming it as Reinvestment Zone No. 2020-1, and reauthorized it again on January 27, 2025 as Reinvestment Zone No. 2025-1. STATUS OF ISSUE: To be eligible to participate in a residential tax abatement program, the city must adopt guidelines and criterial every two years. The current guidelines and criteria expire in April of this year. The guidelines apply to single family homes and cover new construction and residential improvements in a minimum amount of 20% of an existing home's appraised value. The abatements are for 5 years, and are de-escalating, from 100% to 40% over the 5 years. BUDGET: N/A OPTIONS: 1. Approve the attached resolution. 2. GENERAL PURPOSE AND OBJECTIVES The City of Paris will offer residential tax abatement as a stimulus for economic development in designated reinvestment zones located within the corporate city limits of the City of Paris, Texas. The policy of the City is to grant residential tax abatement for new residential structures and modernization, rehabilitation or expansion of existing residential structures that meet minimum investment threshold and comply with these Guidelines and Criteria. All applicants shall be considered on a case-by-case basis. II. DEFINITION OF TERMS Act -means the Property Redevelopment and Tax Abatement Act, Texas Tax Code Ann. 312.001 et. seq., as amended from time to time. Agreement -means a contractual agreement between an applicant and the City of Paris for the purposes of tax abatement. Applicant -means an owner of real property or his authorized agent located in a reinvestment zone or proposed reinvestment zone who requests tax abatement in accordance with these guidelines. Base Year Value — means the assessed value of eligible property on January 1, preceding the date of execution. Eligible Property - means new structure or residential improvements located in a designated Reinvestment Zone. Modernization — means the replacement, expansion and/or upgrading of single-family residential improvements for the purpose of reconditioning, refurbishing or expanding a single-family residence. New Structure - means residential improvements made to a property previously undeveloped which is placed into use by means other than or in conjunction with expansion or modernization. Reinvestment Zone - means an area designated in accordance with the Act by the City of Paris. Only property in a Reinvestment Zone may be eligible for tax abatement. Residential Improvements - means the construction of new single-family residential structures and all the appurtenances thereto, and includes modernization of existing structures. This term does not include duplexes or multi -family structures. Total Facility - means all improvements constructed. Page 1 of 5 Value of Improvements — means the appraised value of the residential improvements as determined by the Lamar County Appraisal District and as described in the tax abatement agreement. III. ELIGIBILITY AND GUIDELINES Any real property located within a designated reinvestment zone and zoned by the City of Paris for single-family residential development is eligible and may apply for residential tax abatement. As provided in the Act, abatement may only be granted for the value of the Residential Improvements which exceed the base year value of the property and which are listed in an Abatement Agreement between the City of Paris and the property owner, subject to such limitations as the City of Paris may require. Minimum Investment — To be eligible for residential tax abatement, an applicant must construct a new structure on their property or make residential improvements to an existing structure in a minimum amount of twenty percent (20%) of the appraised value of the property as of January Pt of the year that the tax abatement agreement between the applicant and the City is signed. Term and Percenta a of Abatement - An applicant who has satisfied all the criteria and guidelines for residential tax abatement as set out herein, will be eligible for tax abatement in accordance with the schedule below. Abatement will become effective in the tax year following the date of completion of the improvements and appraisal of the improvements by Lamar County Appraisal District (LCAD). IV. V. APPLICATION PROCEDURES Applications for residential tax abatement shall be reviewed for completeness. City staff shall determine whether the application satisfies guidelines and criteria and Staff may request additional information or documents from Applicant. City Staff will make final recommendations on each application to City Council. Any person, partnership, organization, corporation or other entity desiring a residential tax abatement to encourage development within a designated Reinvestment Zone shall comply with the following procedural guidelines. All tax abatement applications shall be evaluated on their own merits within the parameters of these Guidelines and Criteria. 1. Preliminary Application Steps A. Applicant or applicant's agent shall submit an "Application for Residential Tax Abatement" contemporaneously with the application for a building permit. If the building permit is for new single family residential construction or expansion or Page 2 of 5 remodeling of a single-family residential structure in an amount that would make the owner eligible for residential tax abatement, then staff will provide applicant with a form application for residential tax abatement. If the applicant for the building permit is not the owner of the real estate and does not make application for residential tax abatement on behalf of the owner, the city staff shall notify the owner (according to Lamar County Appraisal District records) by certified mail, return receipt requested, that residential tax abatement must be filed with the City within ten (10) business days of receipt of the notice. B. If applicant chooses not to apply for residential tax abatement at the time that the building permit is issued, or if the owner fails to respond to the written notice of availability for residential tax abatement, the opportunity for residential tax abatement is waived. City staff shall make a record to reflect owner's election not to participate in the program or to document that owner did not respond to City's notice of opportunity to participate in the residential tax abatement program. The refusal or waiver to participate in residential tax abatement by the owner or applicant shall be binding on subsequent owners of the real property. C. A complete legal description shall be provided. D. Applicant shall complete all forms and information detailed above and submit all forms to the City of Paris Building Official. 2. All information in the application package detailed above will be reviewed for completeness and accuracy. Additional information may be requested as needed. If necessary, applicant will meet with City staff to discuss details of the application and to prepare presentation of the application to the City Council. 3. The application shall designate whether the structure is new or an existing structure and provide an estimate of the value of improvements. 4. If Application for residential tax abatement is approved by staff, Applicant must enter into a tax abatement agreement with the City of Paris and as prepared by the City Attorney. 5. If the Applicant's property is not located within a designated reinvestment zone the application will be rejected and returned to Applicant. 6. The City Council reserves the right to amend the boundaries of a reinvestment zone or to designate new reinvestment zones. 7. The City Council reserves the right to amend these policies and guidelines as needed. VI. LEGAL DOCUMENTATION PREPARATION The City Attorney will be responsible for drafting the Residential Tax Abatement Agreement in accordance with state law and these Guidelines and Criteria. Kraft, Il 4200 Clarksville St., LCAD No. 21148, 24.78 acres. This property is the Dr. Kraft's large and small animal hospital. The State of Texas has purchased a portion of the property for the expansion of HWY 271 S, including a portion of the property on which the structure sits necessitation demolition and reconstruction further back on the parcel. Cobb Testamentary Trust 6125 Old Clarksville Rd., LCAD Nos. 400656, 400657, and 400659, 44.42 acres. The property is undeveloped. Paul and Chelli Morrison 1900 Cobb Ranch Rd., LCAD No. 125594, 2 acres. This property is part of a larger tract that the Morrison's own on which there is a large residence with shop building and in ground pool. The 2 acre parcel is behind the residence. The parcel at issue is inside the city limits; the 5.04 parcel with the residence is outside of the city limits, having been disannexed as a part of a larger disannexation around Cobb Ranch Road in 2008 (Ordinance No. 2008-035). Solid yellow line is current city limits; dotted yellow line would be the new city limits if city disannexes all three petitions. Each applicant lists lack of access to city water or sewer. Dr. Kraft's existing building has both water and sewer service. Then water and sewer lines nearest to the five parcels are located as follows: Water lines are in blue; sewer lines are in green. The yellow line is the current city limits line. Dr. Kraft has provided information regarding leaks in the water line running through the woods; this line, however, is the private line tapping into the city's line. The city neither installed nor maintains the private line. STATUS OF ISSUE: The city's annexation/disannexation policy (see attached Exhibit B) provides that "the City will consider disannexation of any area within its corporate limits if so requested by a majority of property owner(s) and if the area fails to meet at least one of the above seven criteria, and if ...the proposed disannexation is part of an identifiable, logical whole (versus individual parcels) which neither creates `holes' inside the existing corporate city limits, nor forces any other area of the city outside the revised boundary line (`islands' outside the revised lines)."' See Exhibit B, p. 16. The seven factors relate to: Whether the parcels form an enclave; Whether the area has developed as an urban area; Whether the area is a designated growth center; 1 Underlining is original to the text; italics are added by the authors. The policy requires only that the city consider disannexation, not that the city grant it. • Whether the retaining the area within the city limits would result in an adverse impact to the city, including adverse fiscal impacts; • Whether disannexation would present an opportunity for incorporation of the area into a new municipality or for an existing municipality to annex the area; • Whether the area is populated with residential development; and • Whether the area is proposed for long-term development. See Exhibit B, pp. 15-16 for the full text of the policy.2 Each of these criteria also contains a requirement relating to the provision of city services. In this instance, the Council may consider the property for disannexation because (a) the area proposed to be disannexed comprises more that an individual parcel (although the fact that it is only four parcels makes this point arguable given the language of the policy); (2) the area is not populated with residential development (criteria #6); and (3) disannexation of the area will not create any keyholes or islands. The primary issue with disannexation of the proposed area as far as the city is concerned is that of lost potential property tax revenue. Dr. Kraft's parcel is now (and will be when he builds his new clinic) developed. The real question is the possibility of future development on the Cobb and Morrison properties. At present, the Cobb properties are subject to an Ag exemption that make their taxable value very low. Staff is concerned that with expansion of HWY 271 and other development in the area, these properties may become attractive for either residential or commercial development which would greatly increase their taxable values. In any event, it must be remembered that once disannexed, given current annexation law, it would be nearly impossible to reannex the property, and the city would be giving up all future property taxes forever. On February 10, 2025, Council directed me to bring back a resolution to institute disannexation proceedings, which will not obligate Council to ultimately approve a disannexation ordinance. As set out in the resolution before you, the following procedure will need to be followed: February 24, 2025—City Council Meeting—The City Council will discuss and approve the resolution instituting disannexation proceedings. The entire process must be complete within 90 days. February 24-28, 2025—The city attorney will send out notices to other taxing entities, service providers, and railroads as necessary, which must be done by 30 days before the first of two public hearings. April 3, 2025—Publish notice of first and second public hearing in the Paris News (publication of notices of hearing must be between the 20th and the 10th day out from each public hearing; because of the way the calendar falls, we can do a single publication for both which saves on publication fees). 2 The policy for disannexation is simply the inverse of the policy for annexation. Other than the prohibitions against keyholes and islands, the policy on disannexation is sparse. Likewise, state law regarding disannexation is simply that the procedures used in disannexing property must not conflict with the procedures for annexing property. RECOMMENDATION: Because the city's annexation/disannexation policy would seem to dictate that Council at least consider the petition, staff recommends that Council choose and act on the resolution instituting disannexation proceedings with the understanding that Council may ultimately choose not to approve an ordinance of disannexation. RESOLUTION NO. A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, STATING THE INTENT OF THE CITY OF PARIS, PURSUANT TO SECTION 7 OF THE CITY CHARTER AND SECTION 43.142 OF THE LOCAL GOVERNMENT CODE, TO DISANNEX APPROXIMATELY 71.20 ACRES OF LAND FORMNG A PORTION OF THE CURRENT SOUTHEASTERN BOUNDARY OF THE CITY LOCATED ALONG AND SOUTH OF STATE HIGHWAY 271 SOUTH; ESTABLISHING HEARING DATES; PROVIDING FOR PERSONAL AND PUBLISHED NOTICE; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the city staff has presented to the City Council petitions brought by Wallace E. Kraft, II, the Cobb Testamentary Trust, and Paul and Chelli Morrison for disannexation of property owned by them and currently located within the City Limits of the City of Paris; and, WHEREAS, the City Council desires to initiate proceedings pursuant to Section 7 of the City Charter and Section 43.142 of the Local Government Code to disannex a total of 71.20 acres of land located along and south of Highway 271 South between 4200 Clarksville St. and Cobb Ranch Road (LCAD Parcels 21148 (Kraft); 400656, 400657, and 400659 (Cobb); and 125594 (Morrison)); and, WHEREAS, the City Council desires to provide for notice of public hearings, establish the dates for public hearings, and establish the dates to complete said disannexation proceedings. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this resolution are hereby in all things approved and are incorporated herein by reference for all purposes. Section 2. That by adoption of this resolution, the City Council does hereby state its intent to consider the disannexation of 71.20 acres of land located along and south of Highway 271 South between 4200 Clarksville Street and Cobb Ranch Road being more specifically described in Exhibit A attached hereto and for all purposes incorporated herein. Section 3. That on or before February 28, 2025, the City shall mail actual written notice of the City's intent to consider disannexation of the aforesaid area to each property owner in said area proposed for disannexation; to each public entity, including, but not limited to Lamar County, the appropriate school districts as well as any and all other public entities which will have to assume responsibility for certain public services following the aforesaid disannexation; and to each railroad company, if any, that serves the municipality if part of the company's right-of-way is in the area proposed for disannexation. Section 4. That the first public hearing regarding said proposed disannexation shall be conducted by City Council at its regular meeting on April 14, 2025, with notice of said public hearing to be carried on the City's internet website and to be published in the Paris News on April 3, 2025 which is within the 10 day period set forth in Chapter 43 of the Texas Local Government Code for publication of such notices. Section 5. That the second public hearing regarding said proposed disannexation shall be conducted by City Council at a special meeting on April 21, 2025, with notice of said public hearing to be carried on the City's internet website and to be published in the Paris News on April 3, 2025 which is within the 10 day period set forth in Chapter 43 of the Texas Local Government Code for publication of such notices. Section 6. That City Council shall consider an ordinance calling for the disannexation of the aforesaid described land at City Council's regular meeting on May 12, 2025. Section 7. TXDOT quoted Cox Field a new fuel farm of $1.2 Million. Following the advice of TXDOT, the city budgeted $120K for this project — 10% of the project. Since then, the overall percentage for the project has been lowered to a 5% match, cutting the overall dollar amount to $60K for the City. STATUS OF ISSUE: The grant paperwork now needs to be signed and returned to TXDOT so this project can be scheduled. The airport will use fiscal years 2022, 2023, 2024, and 2025 Infrastructure Investment and Jobs Act funding to construct a new fuel farm at Cox Field. BUDGET: $120,000, 10% of overall cost for the project, was budgeted for this fiscal year in the ARPA Fund. While only $60,000.00 is now required, all ARPA funds have been expended. This situation was due to erroneously overbudgeting in the ARPA Fund. The $60,000 will now come from the Airport Fund. If this payment causes the Airport Fund to have a deficit at the end of the fiscal year, a transfer from the General Fund will be made to cover the shortfall. RECOMMENDATION: Approve the signing of the grant paperwork by the City Manager and funds to be sent to TXDOT for the upcoming fuel farm project scheduled for 2026. Vine, Deputy City Manager SUBJECT: Consultant Proposals for the Creation of a Strategic Plan DATE: February 24, 2025 BACKGROUND: Mayor Mihir Pankaj and City Council members directed staff to speak with consultants about conducting a Workshop with members of City Council for the purpose of creating a Strategic Plan for the City of Paris. Deputy City Manager Rob Vine reached out to different consultants and has obtained 2 proposals for members of Council to consider. STATUS OF ISSUE: A total of 5 consultants were contacted with two of them submitting a proposal, Engage Solutions Group and Ron Cox Consulting. Both consultants spent time with DCM Vine, on the phone and J. Shane Howard with Engage Solutions Group travelled to Paris to meet with DCM Vine to learn more about the project. City Manager Rose Beverly was also able to speak with both Howard and Cox about their individual proposals and gain some insight into their processes and individual experiences. Mr. Cox has served as City Manager in four different cities for a total of 28 years and his submission packet included information regarding his consultation business and experience with 90 other cities and many other public and nonprofit entities in Texas. This proposal consists of a 4 -hour governance session with the Council, an 8 -hour planning session with Staff and Council, and the final report with a total of $9,000.00 and, if desired, the delivery of an Implementation Plan and another 8 -hour session with the Council and Staff, for an additional $2,500.00, for a total of $11,500.00 (plus out-of-pocket expenses). J. Shane Howard with Engage Solutions has worked with public entities for nearly 20 years in both the private and public sectors in various capacities. He has managed the budget and policy process for a Texas port for over 8 years, he has worked with dozens of cities conducting feasibility and economic/fiscal impact analyses for projects, master plans, and strategic goal setting. He served as This plan consists of 3 phases and is expected to last 9-12 week from the initiation of the process. This proposal consists of an initial workshop with the Council and a follow-up workshop when the plan has been drafted. The consultant would then meet with community stakeholders and gather additional information before meeting again with City Administration and Staff to discuss his findings. The last meeting would be a Council / Staff Activity Workshop before completing the plan. This proposal is $18,000.00. BUDGET: Depending on which proposal the Council chooses, the expense would be paid for out of the General Fund, either from the City Manager's budget in full or in part with combined funds from the City Council's budget. RECOMMENDATION: After speaking with both consultants, Staff is of the opinion that both are qualified, have good reputations and come highly recommended by other City Managers, and have provided desirable proposals. The main difference between the two proposals is that one appears to be more comprehensive and allows for input from community stakeholders and has an extended timeline, which is reflected in the higher cost. I am excited about the prospect of working with your Mayor and City Council and you and your staff in facilitating a governance and planning session for Council and staff. PROJECT OBJECTIVES/DESCRIPTION: Working with the management team, Ron Cox will facilitate two sessions over a two-day period (can be reduced to one if necessary): A governance and visioning session for Mayor and City Council and you; and a planning session with the Mayor, City Council, you, and your key staff. In addition, if authorized, I can provide follow up services for you and your staff assisting in the creation of an action/implementation plan resulting from the strategies and goals prepared at the planning session. (This is budgeted separately for your convenience and information.) At the governance session, the Council will discuss and develop their governance model. The planning session will be designed to provide a time for the Council and staff working together to develop short-term and long-term strategies and goals for the city. Again, Ron Cox will also facilitate a follow up session with the staff to develop an action plan designed to address the strategies. SERVICES/DELIVERABLES: Ron Cox will provide the following services and deliverables (including estimated time for each task for the City of Paris. Task 1) Initial Meetings. Meet with the Interim City Manager and/or key staff to confirm expectations, understand issues relevant to the planning process and determine a more detailed process for the facilitations (up to three hours). Meet with the Interim City Manager and his key staff to understand key issues and challenges from the staff s perspective (up to two hours). Meet with the Mayor and each member of the City Council to fully understand the expected issues and finalize the process and agenda for each the Council Sessions (up to eight hours). Report back to Interim City Manager to confirm expectations. Task 2) Governance Session. Prepare for (three hours) and facilitate the session with Council on governance (up to four hours) with the Mayor and City Council, Interim City Manager, and his key staff. The governance session will focus on establishing a model for council and staff to follow. Key discussions will center on leadership, communication, expectations and establishing the key elements of the vision Council has for Paris. Task 3) Council/Staff Planning Session. Prepare for (up to four hours) and facilitate the Council/Staff Planning Session (up to eight hours). This session is designed to establish a Strategic Plan prepared for 2025-26 and beyond as appropriate. This session will be designed to result in capturing the long-range strategies, or areas of emphasis of importance to the City Council, as well as identify goals for their accomplishment. Task 4) Implementation Plan. Work with the Interim City Manager and staff members to prepare an implementation plan (prepare draft document up to two hours) addressing the work product from the City Council planning session and aligning the work of the staff with the Council's plan. This phase will result in an analysis of the Council's areas of emphasis and goals and add other goals and objectives to add depth to the Council's work product. (up to two four-hour sessions, or one full day session) Task 5) Final Report. Prepare (up to three hours) and submit a final report to the Council and Interim City Manager wrapping up the process. Present the final report to the City Council for approval (up to four hours). Task 6) Additional Services. Provide any additional services that might be required by the City Manager to be billed on an hourly rate as outlined in Attachment A. OTHER SERVICES. Cox Biography Ronald E. Cox has been married to his wife, Susan, for 51 years. They have two children, daughter Emily, and son, Tim, and five grandchildren, Courtney, Ryan, Isabella, Brynlee, and Caleb. Ron received a Bachelor of Science from Abilene Christian University in 1972 and a Master of Arts from University of Texas at Tyler in 1981. Ron entered the governmental arena in 1972 with the Brazos Valley Development Council in Bryan and, after almost two years went to work for the East Texas Council of Governments (ETCOG) in Kilgore. Ron accepted his first position as City Manager in 1978 with the City of Rusk. He was the City of Rusk's first City Manager. Two years later, he became the City Manager of Center. In 1984, Ron accepted the position of City Manager of the City of Kilgore, where he served for six years. In November 1990, he became Friendswood's third City Manager and served that city until May 2006. Ron has been involved in local government for over 50 years and held the position of City Manager in four cities for 28 years. Ron remains active in many governmental organizations including the Texas Municipal League, and Texas City Management Association (TCMA). Ron served as president of TCMA Regions V and VI. He served on the Board of Directors of TCMA from 1995-1997 and served as TCMA's president in 1997-98. He continues to actively participate in various TCMA programs. In 2005, Ron was awarded TCMA's Lifetime Achievement Award, an exceptional honor, and in 2006 he was given Life Member status in TCMA. And in 2022 Ron was awarded TCMA's highest honor and became the seventh recipient of the Distinguished Service Award. Ron has regularly served on the TCMA Professional Development Committee. He has and continues to speak regularly at conferences and training sessions in Texas about issues and challenges in local government. In 1990, Ron was appointed by Governor Bill Clements to the Board of Trustees of the Texas Municipal Retirement System and served on the Board until 1993. He also served on the TMRS Advisory Board 2006-2010. He was chosen to serve on the Board of Trustees of the Texas Municipal League Intergovernmental Risk Pool in 1986 and served on the Executive Committee as Vice -Chair of the Board, 1990-91. In 2016 Ron was appointed to the newly established Friendswood Downtown Economic Development Corporation Board in his hometown and served as its initial President. He continues to serve on that Board. Since May 2006, Ron has consulted with 90 cities and many other public and nonprofit entities in Texas in a variety of areas, including strategic planning at the Council/Board and staff levels, leadership development for city staff, executive recruitment, and management services. He particularly enjoys working with smaller cities. He enjoys sharing his experiences with others in a variety of ways including public speaking at seminars and conferences. In 2020, Ron was named a Friendswood Legend by Mayor Mike Foreman for his work both during his city management career there and his volunteer work with the City of Friendswood over the past years. Each Corporation prepared a Mission statement unique to their respective mission, goals and strategies unique to their organizations. ■ Facilitated a second planning session with the Willis Economic Development Corporation (Type A) in October 2018. Gulf Coast Authority (formerly Gulf Coast Waste Disposal Authority), 2018-19 ■ Facilitated a day -long planning session with the Board. The primary goal was to establish a governance model for the Board. October 2018 ■ Facilitated a second session reviewing the governance model and setting short - and long-term goals for the Board. Bay Area Transportation Partnership, 2010 ■ Facilitated in concert with Marsh Darcy Partners a one-half day retreat with member of Bay Tran in August 2010. This retreat focused the participants in identifying transportation issues within the Bay Tran service area as a first step in preparing a Legislative Agenda for the organization. Texas Coalition for Affordable Power, 2011-12, 14 ■ Facilitated a two-day retreat with the Board and Executive Director of TCAP in September 2011. This retreat focused on organizational needs of the new organization, expectations of the Board and staff, and strategic goals designed the start the organization on the right path for success. Provided follow up services to the staff assisting in the preparation of an implementation plan for the strategies. ■ Facilitated a second one -day retreat with the Board and Executive Director of TCAP in September 2012. This retreat focused on providing follow up to the Board and staff confirming the organization and leadership expectations, guiding tenets and vision statement.
