10/07/2025 MinutesBoard of Adjustment Meeting October 7,. 2025 Page I MINUTES OF THE BOARD OF ADJUSTMENT MEETING OF THE CITY OF PARIS, TEXAS OCTOBER 7, 2025 The Board of Adjustment of the City of Paris met for a regular session at 12 p.m. on October 7, 2025, at the City of Paris- City Hall, Council Chambers located at 107 E Kaufman St. Present.- Board Members: David Hamilton, Harley Draven, Ben Vaughan, Bill Sanders and Richard Thompson. Alternate Jerry Williams was present, but he just observed the meeting, City Representative: Stephanie Harris and Osei Amo-Mensah. Absent: None. 1. The Board ofAdjustment meeting was called to order b David Tlamilton, at'12.-00P.M. y 2. Approval of minutesftom previous meeting. (August 5, 2025) Motion was made by Ben Vaughan, seconded by Richard Thompson to approve minutes for the August 5, 2025 meeting. Motion carried 5 ayes — 0 nays. 3. Public hearing to consider and take action on the petition ofInvest Fannin LLC, on behalf' of Johnn Miles regarding a 15' variance to the Build Line that ftonts SE 6 1h Street, on y Lot 1, Block A, qf the J.0 Miles Subdivision being located at Parcel 129233. David Hamilton opened the public hearing. Director of Planning and Zoning, Osei Amo-Mensah presented the case to the board and gave City recommendation. Andrew Mack,, on behalf of Invest Fannin LLC, spoke in favor of the request stating that they cannot make the required 25' setback on SE 61h street, but can make 10' or more. Motion was made by Harley Draven, seconded by Richard Thompson to approve the 15' variance to the 25' Build Line indicated on the plat, based on the following findings. Theproposed residential structure of 1,440 square feet in the Two -Family Dwelling -(H) creates a hardship to meet the required minimum, street front setbacks of 25 SF each per City of Paris Area Regulations, Section -501(1). 3. Invariably, the Zoning Ordinance 1710 Section 9-602. (5) makes provision for such variance situation and request to meet the minimum required front and side yards setback per the code. The request, if approved will be in harmony with the general purposes and intent of area regulations for residential buildings and lot regulations in Two -Family Dwelling -(2F) contained in and will protect the character of the immediate vicinity of the area. 4. There are no special or unique condition(s) of restricted area, such as the utility easement that exists on the subject parcel of land that causes unusual and practical difficulty or unnecessary hardship in compliance with the provisions sought here to be varied,, other than a comer lot that requires two front yard setbacks issue that cannot be met, irrespectively. 5. The hardship sought to be avoided is not necessarily the result of (a) the applicant's own actions (self-imposed or self-created) and may cause (b) economic or financial "hardship" should the application be denied. 6. The provision of the ordinance regulation that is sought to be varied will deprive the applicant of reasonable rights to use property that are commonly enjoyed by other 61 properties such as comer lot variance on front yard setback in the Single- and Two -Family Dwelling Zoning District which are required to comply with these same ordinance provisions. 4. Public hearing to consider and take action on the petition ofInvest Fannin LLC, on beha�f of JohnnMiles, regarding a 15' variance to the Build Line that fronts E 8th Street, on Y Lot 10, Block A, of the J C Miles Subdivision being located at Parcel 129243, David Hamilton opened the public hearing. Director of Planning and Zoning, Osei Amo-Mensah presented the case to the board and gave City recommendation. Andrew Mack, on behalf of Invest Fannin LLC, spoke in favor of the request and answered Ms. Draven'squestion about the location of the electrical utilities. Mr. Mack clarified that the electrical would run across the front of the properties on Sycamore. Staff member, Paige Unger, made note of the one input received in opposition of the request. No one else spoke in favor or opposition of the request. Public hearing was declared closed.
