The above -referenced requests were apEroved by the City of Pan's Zoning 'oard of Adjustment ("Board") on 11/4/2024 by a vote of.—) es, nays and abstaining. On this date the Board found that the requests met the conditions set forth in the City of P * 5 Paris Area Regulations Ordinance, Section 9-201(1). Appeal: Any interested person wishing to appeal this Board decision is required to file a petition for Writ of Certiorari in a district court,, county court or county court at law within ten (10) days of the date this decision is filed in the Board's office consistent with section 211.011 of the Texas Local Government Code. The Board of Adjustment hereby approves the variance requests based upon the following findings. STAFF RECOMMENDATION & FINDINGS Staffrecommends approval of the requested variances based upon the following staff findings of fact: 1. The proposed lots are under Re -plat. 2. The variance requests are for four proposed lots. The existing configuration are lots 3 and 4. Block 8 of the Maxey Addition. Mr. Stephens proposes to replat the two lots into four lots. The reason for the variance requests is because the platted Right -of -Way (ROW) width for NW 16th Street was 40 feet wide. A five-foot ROW dedication is required on the east side of Lot 4. If the ROW dedication had not been required, no variance request would be needed. The proposed home to be constructed on each of the four lots will be less than 30 feet wide. The narrow -width proposed house meets all the other zoning requirements. 3. Invariably, apart from the Zoning Ordinance 1710 Section 9-201. (1) that refers to lot width, the proposed lots meet the minimum required length, front and side yards setback per the code. The request, if approved will be in harmony with the general purposes and intent of area regulations for residential buildings and lot regulations in Single -Family Dwelling -(SF -3) District contained in and will protect the character of the immediate vicinity of the area. 4. There are no special or unique condition(s) of restricted area, that exists on the subject parcel of land that causes unusual and practical difficulty or unnecessary hardship in compliance with the provisions sought here to be varied, other than the five foot ROW dedication that was required on the east side of Lot 4 that has created lot width issue that cannot be met, irrespectively. 5. The hardship sought to be avoided is not necessarily the result of (a) the applicant's own actions (self-imposed. or self-created) due to the fact that the original Maxey Addition plat was approved by the City of Paris that included a 40 -foot ROW width and that the plat was approved by the City of Paris the minimum ROW width that was increased from 40 -feet to 50 feet and may cause (b) economic or financial "hardship" should the application be denied. 6.
