No. 1315, Subdivision regulations of the City of Paris, regarding design of improvementsORDINANCE NO. go?s - o?6 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS, AMENDING CITY ORDINANCE NO. 1315, SUBDIVISION REGULATIONS OF THE CITY OF PARIS, AS HERETOFORE AMENDED, REGARDING DESIGN OF IMPROVEMENTS; PROVIDING A REPEALER CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY CLAUSE; AND DECLARING AN EFFECTIVE DATE. WHEREAS, by city Ordinance No. 1315, the City Council of the City of Paris enacted a Subdivision Ordinance to regulate subdivision and development of land located inside the corporate City limits and the extraterritorial jurisdiction of the City of Paris, Texas; and, WHEREAS, the City Engineer, has recommended changes to Section IX, "Design of Improvements," to the Subdivision Ordinance to require future development to abide by heightened standards to improve drainage, the integrity and longevity of streets, and water distribution in the city; and WHEREAS, at its November 3, 2025 meeting, following notice and publication as required by law, the Planning and Zoning Commission conducted a public hearing on the proposed amendments contained in this ordinance, and, following said hearing made formal recommendation to the City Council to approve same; and WHEREAS, on November 10, 2025, following notice and publication as required by law, the City Council of the City of Paris conducted a public hearing on the proposed amendments, and having considered the recommendations of the Planning and Zoning Commission and the testimony and evidence introduced at said public hearing, found and determined that the proposed changes to the City's Subdivision Ordinance, as set out below, are in the best interest of the public health, safety, and welfare of the citizens of the City of Paris by a vote of 6 ayes and 0 nays. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved and are incorporated herein by reference for all purposes. Section 2. That City Ordinance No. 1315 (Exhibit 9A to Chapter 9 of the City of Paris Code of Ordinance) Section IX, "Design of Improvements," Subsections General Requirements; Thoroughfare Plan," subsections A., G., and E., shall be amended to read as set forth in Exhibit A attached hereto and incorporated by reference. Section 3. That the remainder of Section IX shall remain as currently written. Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict with the provisions of this ordinance are hereby repealed, and all other provisions of the ordinances of the City of Paris not in conflict with the provisions of this ordinance shall remain in full force and effect. Section 5. That the repeal of any ordinance or part of ordinances affected by the enactment of this ordinance shall not be construed as abandoning any action now pending under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering any penalty accruing or to accrue, or as affecting any rights of the municipality under any section or provisions of any ordinance at the time of passage of this ordinance. Section 6. That it is the intention of the City Council of the City of Paris that this ordinance, and every provision hereof, shall be considered severable, and the invalidity or partial invalidity of any section, clause, or provisions of this ordinance shall not affect the validity of any other portion of this ordinance. Section 7. That any person violating any provision of this ordinance shall be guilty of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and every day's continuance of any violation of the above -enumerated sections shall constitute and be deemed a separate offense. Exhibit 9A, Subdivision Ordinance, IX Design of Improvements. D. Street Pavement. (1) All local streets shall be constructed of six (6) inches of continuously reinforced Portland cement concrete with No. 43 Grade 60 deformed bars spaced at 8) inches in each direction. (2) All collector streets shall be constructed of seven (7) inches of continuously reinforced portland cement concrete with No. 4 Grade 60 deformed bars spaced een (4 �3") inches in each direction. (4) The concrete mix will be designed to produce a minimum compressive strength of thousand (,3j 000) psi at twenty-eight (28) days and shall contain not less than six sacks of cement per cubic yard of concrete. The water cement ratio (net gallons of water per sack of ninety-four (94) pounds of cement) shall not exceed six and one fourth (6-1/4) gallons/sack unje,s oth, bv i,Jr)ec'r. The gradation requirements for the course and fine aggregates shall be as required by Item 360 of the TxDOT Standard Specifications for Construction and Maintenance of Highways, Streets, and I e e I Y E. Drainage. Storm sewers, bridges, culverts, inlets, and drainage channels or ditches of a permanent design adequate to carry off such rainfall shall be installed by the subdivider throughout the entire length of the drainage area where the surface drainage traverses the subdivision. The subdivider may construct in lieu of storm sewers suitable drainage channels which shall be of sufficient width, depth and shape to carry off the surface drainage and allow for maintenance operations in keeping such ditches open. All drainage ditches so constructed shall have their sides sloped so as to retard erosions; the flow line of said ditches shall be permanently established by small low flow concrete sections, and the banks of all curves or bends shall be permanently protected to prevent erosion. No open drainage channels shall be constructed within the areas dedicated as public streets and alleys in said subdivision; provided, however, that in cases where utilization of the land of the improved development warrants otherwise, such ditches may be located in the center portion of the street (except at street intersections where culverts or bridges of a permanent design shall be constructed) where a right-of-way not less than eighty (80) feet in width, plus width, for drainage channel, is provided. G. Water Distribution System. The water distribution system shall be based on a design adequate to furnish the anticipated water consumption within the subdivision, including proper fire protection. Water mains less than t,.�Jgh t (8) yak G (6) inches in diameter shall be considered substandard and will not be allowed, except that any deviation to a lesser diameter may be considered as recommended by the city engineer. Fire hydrants shall be located so that every lot within the addition will be within five hundred (500) feet of same and further said hydrants shall be located so as to conform to the overall plan of the City. Gate valves shall be installed on leads between fire hydrants and water mains, 011.�-, A S wod,°, The City of Paris may require larger water mains and branches than are necessary to serve the addition or subdivision in order to provide for future development of the area. In the event that said larger lines are required, then the subdivider shall be entitled to participating aid from the City on said oversized lines.
