session at 5:30 p.m. on Monday, March 23, 2026. The meeting will be held at the City
Council Chamber, 107 E. Kaufman Street, in Paris, Texas. One or all Council Members
may be attending remotely, but the feed will be available for live viewing at
https://paristexas.gov/public. The matters to be discussed and acted upon are as follows:

consent agenda for discussion. There being none, a Motion to approve the consent agenda was
made by Council Member Norment and seconded by Council Member Moore. Motion carried,

Regular Agenda
10. Receive an update from Garver LLC about the Wastewater Treatment Plan Phase I and II
Improvement Projects.
Utilities Director Danny Rowell said this was the third project update from Garver, and
that Justin Rackley would be giving them the update.
Mr. Rackley from Garver reviewed Phase I and II timelines. He reported that substantial
completion was scheduled for May 2026 and final completion for June 2026 for Phase L He
depicted slides reflecting the proposed overview, Next, Mr. Rackley moved to Phase II
explaining that it would begin May 2027 and should be completed August 2027. He reviewed
the pre -construction FEB site and showed a short video.

I I . Discuss and possibly act on a Resolution accepting for filing a Petition of Creation of the
BelleVue Estates Public Improvement District No. 1, calling a public hearing on the
advisability of the creation of said district and authorizing the issuance of notice by the
City Clerk regarding the public hearing.
City Attorney Stephanie Harris explained that on December 19, 2025, Thomas Haynes,
manager of Haynes, Haynes & Jones, LLC filed a petition for creation of the BelleVue Estates
Public Improvement District No. I on approximately 120 acres. She said they planned to develop
a residential subdivision consisting of over 600 homes.
Ms. Harris said if the Council chose to create the new PID, this would be the City's second
PID, as Council created the Forestbrook PID No I in late 2024 related to a residential subdivision.
She explained that a PID was the vehicle by which a developer could access the public bonding
process to help defray the costs of design and construction of public improvements within the
district, and that PID bonds were repaid through yearly assessments on the lots within the district,
over and above each lot's property tax burden. Ms. Harris stated the City was not liable for bond
repayment but would be obligated to foreclose on properties whose owners fail to pay their
assessments. Ms. Harris reviewed with the Council the options at this point, which were to
approve the resolution to accept the petition and set a public hearing or decline to accept the
petition.
Mayor Pankaj said he wanted to see development, but they had to be careful in how they
proceed. He also said he did not think the timing was right to take on a second PID, and he
thought they should see how the Forestbrook PID works out. Mayor Pro -Tem Savage said he
totally agreed and they needed to complete what they had already started. Council Member
Moore and Council Member Atteberry also agreed. Council Member Norment said she was
excited about looking at development, but they needed to ensure the success of the first PID.
A Motion to decline the PID petition was made by Council Member Norment and
seconded by Mayor Pro -Tem Savage. Motion carried, 5 ayes 0 nays.
12. Receive presentation from City Planner Osei Amo-Mensah about the planning
department.
City Planner Osei Amo-Mensah gave a presentation to City Council focusing on the
Repair Affair and said this would be an annual event that would be initiated by the City of Paris.
He explained this was a program that would recruit volunteers and donors to perform repairs on
qualifying homeowners that live within the City limits. He said the homeowner must be elderly,
disabled or low income to qualify for the program. Mr. Amo-Mensah also said the focus would
be on home safety, security, healthy living environments, and neighborhood stability, and was
not an emergency repair program, nor centered upon decorating or remodeling.

Mayor Pro -Tem Savage said this seemed to be a low cost high return program and would
help eliminate code enforcement complaints. Council Member Norment inquired about liability
for the City. Ms. Harris said releases would be required to be executed prior to performing the
repairs.
13. Convene into Executive Session pursuant to Section 551.072 of the Texas Government
Code, to deliberate the purchase, exchange, lease, or value of real property if deliberation
in an open meeting would have a detrimental effect on the position of the governmental
body in negotiations with a third person.
Mayor Pankaj convened City Council into open session at 6:19 p.m.
14. Reconvene into open session and possibly take action on matters discussed in executive
session.
Mayor Pankaj reconvened City Council into open session at 6:33 p.m. and announced
there was no action to be taken.
15. Consider and approve future events for City Council and/or City Staff pursuant to
Resolution No. 2004-081.
Mayor Pankaj announced that yesterday was International Woman's Day and expressed
appreciation to female City Council Members and Staff.

A Workplan Updates from Committee Members:
Kim Kalina- attended the city council meeting regarding city-wide strategic planning.
Shared the evaluation with Cheri on our progress of transformational goals. Currently
involved in Paris Art Movement Meetings to discuss the Fair. As far as the Wine Festival,
she will continue to assist with social media.
Mary Hart- Made rounds with Cheri Bedford to discuss WineFest and any downtown issues
with local downtown businesses. Also working on the Paris Area Arts Alliance Art Fair.
Main Street is a partner for this event.
Tyrone Hayden- nothing to report
Glee Emmite- Busy signing up wineries for the WineFest in April. 85% successful. Contacted
the 8th and 9th today.
Historic Preservation Commission: have not met for 2 months, but the next meeting is
scheduled for tomorrow with the new commissioner and they plan to approve grants. Paris
Downtown Association- Misti Scott, president, discussed a successful season for
downtown businesses. They recently hosted the Chocolate Stroll. In February, there will
be officer's meetings to get events for the year out on social media earlier so they can have
a larger crowd. March 14th- mini golf event planned that is family friendly. The downtown
merchant of the month program is going strong. They receive a sandwich board for the
month advertising that they are the business of the month as well as a 100.00 gift certificate
from their business to give away. PDA is partnering with Main Street for the WineFest.
Chamber/VCC- Karen Dougherty shared an update on events. Indoor archery was a big
success with 7 states, 123 shooters over 2 days with 53 kids for the kid shoot. Tower City
comedy festival was rescheduled due to the ice storm. Feb. 24th is the Kayak
Championship at Bois D'Arc Lake. 2/27 is Pancake Days for Kiwanis. 3/28 is Pump track
Classic. We now have lights at the Pump.]ack Track.
5. Coordinator's Report- Cheri Bedford
Inquired Karen Daugherty from the Paris Visitors and Convention Council about what
they do to bring people downtown when there are events around town. Karen shared that
events can be added to the Visit Paris TX Facebook page. They have QR Codes that they
share at their events that let attendees know of what is around town.
WineFest-Cheri has confirmed the Gibraltar Hotel for the VIP Event during WineFest.
Walt Reep and Greg Kee will host the VIP Event. We plan to offer different bags and a
wine -tasting experience for up to 75 people (up from 50 last year). VIP attendees will
not have to check in to attend the 6-9 event. She is working on the artwork for
WineFest. LCH Association promotes the history of Paris and has a committee of
people for America 250. We are all in agreement to use the America 250 Logo this year
on our wine glasses. Ticket sales start tomorrow. Cheri has secured 10 businesses for
the WineFest. We need 3 more foodies.
Placer Al- have input all business addresses downtown for the local businesses to obtain
good data as far as who is downtown, when and for how long.
BIG Grants- We paid out $132,950. We will take pictures with the recent recipients. If you
are available, please attend.
First St.- concrete footers are being installed. Second set of pavers have been ordered.

Beverly Ables workshop to discuss strategic planning training will be March 16 or 30.

4. Discussion and possible action on the following Minor Certificate of Appropriateness (26000005)
27 Clarksville, Canopy improvements, Michelle Scribner.
Ms. Scribner was present to address the concerns ofthe commission at the previous meeting.
She clarified the existing canopy is 6 inches tall, and she is proposing adding a facia to make
it look 18 inches tall. She provided additional photos and identified the drainage of the
Chairman Turk reviewed design standards on canopies. Canopies should be appropriate scale
and location on the building, and the most canopies scale is determined by the space that
exists. The commission expressed concern with the requested height of the proposed addition
to the face ofthe canopy, expressing that at 18 inches it would appear dipropionate in size
compared to the area between the transom windows and lintel portion on the storefront. They
also expressed concern setting Hallowed this would set a precedentfor otherproper@' owners.
After discussion and evaluation ofexisting conditions, Chairman Turk askedfor a decision
from the board. A motion was made by Commissioner Kee to approve the addition ofa
fauxfacia to change the existing canopy height to a maximum of 16 inches. The motion was
seconded by Chairman Turk, Motion carried 5 ayes, 0 nays.
5. Discussion and possible action on the following Certificate of Appropriateness COA (26000006)
for property located in the HD -I Downtown Historic District- 443 1 "ST SW, David Logan
David Logan returned to the commission for a minor change to his Certificate of
Appropriateness issued and was approved at the February 11, 2026, meeting. The COA
issued was to approve the bollards being powder coated black or dark green. After doing
research, Mr. Logan found the powder coating cost prohibitive and came back to the
commission to request permission to paint the bollards and chains with industrial Sher -Chem
high -gloss enamel paint black in lieu Qfpowder coating. He has had good luck with the paint
in past projects andfbund it 10 stand up to the weather quite well and made it easier to touch
up scratches and chips. Chairman Turk reviewed the 2018fencing standard, and it was his
opinion the concern Q/lhe commission at this time this amendment was adopted was to have
afinish that would match the district and last.
A motion was made by Commissioner Emmite to approve the painting the decorative
bollards and chains with the She- Chem black enamel paint. Motion was seconded by
Chairman Turk. Motion carried, 5 Ayes and 0 nays.

inspectors to be in violation of Article III of Chapter 7 of the Code of Ordinances of the City of

National Register of Historic Places, as a recorded Texas Historic Landmark, or as historic
property as designated by the City Council of the City of Paris.

National Alliance QfPreservation Commissionforum is in Minneapolis. Cheri Bedford
appliedfor a grantfor the commission. Chairman Turk is attending and there is an option for
one more commissioner, and preference will be given to those who are new or not going to

Background: Section 69 (3) of the Paris City Charter requires the Financial Director to submit
to the City Council through the City Manager a monthly statement of receipts and

the month and year to date. The financial package includes the following:
1. The revenue and expenditure totals for the General Fund, Water Fund and the Airport
Fund include the approved budget, current month, year-to-date results with comparison
of the previous year to date. Over 99% of all the City's operations activities take place in
these three funds. If the circumstance merits, the financial report would highlight any
other fund in the monthly report.
2. A staffing report showing by department, by fund, the approved staffing for the month.
Included are the current level and open positions.
3. A detailed revenue and expenditure report for the General Fund is included, with
highlights for the month.
4. Revenue graphs are included for Municipal Sales Tax revenue and EMS revenue for the
current year along with the previous two years.
5. A detailed revenue and expenditure report for the Water and Sewer Fund, with highlights
for the month.
6. Water Sales and Sewer fee revenue graphs are included for the current year and two
previous years.
7. Detailed revenue and expenditures for Cox Field Airport are included, with highlights for

PARISTEXAS.GOV General Fund Highlights for the Month of February
1. Overall Revenue was $19,579,525 or 55% of the annual Budget.
2. Property Tax Revenue is $8,287,511, 3% more than previous year. Majority of Property
Tax Revenue is received between December and February each year.
3. Sales Tax revenue is more than last year by $345,179 or 7%; however, January and
February collections were less than last year. Continue to be optimistically cautious as
sales tax can be volatile and a decrease was anticipated for the 2026 budget.
4. Hotel Occupancy tax revenue has decreased by $70,627 or 11% from 2025 fiscal year.
Fluctuation in the carrying balance is due to the allocation to the Chamber of
Commerce, a hotelier rebate, and a portion that covers the debt issued to pay for the
Civic Center.
5. EMS Fees are down $436,430 or 17% compared to last year. EMS collections are
down due to the fourth ambulance for transfers not in service due to staff shortages.
6. Interest revenue is down by $17,696 or 5% from last year. The Fed Fund rates
decreased
25 basis points at the end of October with an additional 25 basis points reduction in
December. One to two more rates cuts are anticipated in 2026 to bring the fed funds
rate closer to a "neutral rate" of 3.00% that neither stimulates nor restricts economic
growth. As a result, interest revenue is expected to be less in fiscal year 2026 than
2025.
7. The year-to-date expenditures in the General fund are $13,626,468 or 36% of budget
for the 2026 fiscal year. In comparison to last year, the overall 2026 fiscal year
expenditures have increased by $576,418. Majority of the increase is attributable to the
following:
➢ Fiscal year 2026 includes a 2% cost of living adjustment for all full-time positions.
> One-time technology infrastructure renewals recorded in November 2025. ➢
Stipends for EMS, Fire, Public Works, and Dispatch personnel.

Cox Field Airport highlights for February 2026
1. The YTD Revenue is below budget at 23%; however, Hangar rentals are exceeding budget at 54%. Fuel sales are down from last year
due to reduced activity. Last fiscal year nine ground leases were billed and paid in full for the year during the first quarter.
2. The YTD Expenditures was 28% of budget. The Insurance & Bonds inlcudes the annual payment to TML for General Liability and
Worker's Compensation insurance.

This report presents an overview of the CitVs investment portfolio. It shows how the portfolio is structured
and how it performed during the reporting period with the primary objectives in priority order of safety,
liquidity, and return on investments.
SAFETY
The City of Paris will diversify its investments by security type and institution. Except for obligations of the
United States or its agencies and authorized pools, no more than 50% of the City of Paris total investment
portfolio will be invested in a single financial institution except for its local depository. Money Market and
Certificate of Deposit are held by the City's local depository. No other institution has more than 50% of the
total investment portfolio.

SUBJECT: 2026 ANNUAL GROUNDS MAINTENANCE BID
DATE: March 23, 2026
BACKGROUND: The City of Paris Public Works Department sent out a request for bids for
grounds maintenance per property. This is contracted mowing of City Parks. Bids were for
individual properties, benefitting the city with more properties. Per budget allowance, 64.47 acres
are recommended to contractors, leaving 186.65 acres for the parks department to maintain. The
bid tabulation sheet is attached for details of the bids.
STATUS OF ISSUE: The City received sealed bids for grounds maintenance on March 4, 2026,
and would like to award the bids accordingly. The contract period is April 1, 2026, through March
31, 2027.
BUDGET: Funding is budgeted in the Parks Department.
RECOMMENDATION: Award one bid for 24 properties, for a total of 64.47 acres, to Greens
Lawn Service in the amount of $99,970.00 as indicated on the attached bid tabs.

SUBJECT: 2026 ART FAIR AGREEMENT WITH TEXAS DEPARTMENT OF
TRANSPORTATION
DATE: March 12, 2026
BACKGROUND: The Paris Main Street Advisory Board is partnering with the Paris Area Arts
Alliance, and the Plaza Artist Guild, and the Paris Public Libraw to reestablish the Paris Art Fair on May
1 5-16, 2026, in Bywaters Park. This special event will begin with an artist reception andjuried art show
at the Gibraltar Hotel on Friday May 15, 2026, and continue on Saturday May 16 from 9:00 a.m. 4:00
p.m. with a community art show, artist booths, poetry, music, free games for children at the library, food
trucks, and fun for the family. There will be community wide participation with schools, volunteers,
board members, organizations and the artist guild. The committee is planning on utilizing the Bywaters
Park, Library parking lot, and the stage behind the library and the Farmers Market. Excitement for this
event is being built, and the committee anticipates a good turnout from the public. TXDOT agreement is
needed to close S. Main Street between Sherman and Austin for this event.
STATUS OF ISSUE: Art Fair committee is requesting permission from the Council to enter into
an agreement with the State to close the SH 19/24 during art fair hours. As requested by the
TxDOT Paris Area Engineer Noel Paramanantham, RE, City Council must approve a resolution
for street closure so we can begin the process of the agreement. The Art fair committee requests
a closure for one year on their application to see how it goes, then depending on the success of
the event, will request a 5 year agreement in 2027.
Hours requested are: 6:00 AM -6:00 PM, Saturday May 16, 2026 South Main Street between
Sherman and Austin.
BUDGET: NA
RECOMMENDATION: Approve a resolution (attached) agreeing to enter in a multi-year
agreement for street closure with TxDOT for Festival of Pumpkins
RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS,
APPROVING AND AUTHORIZING THE EXECUTION OF AN AGREEMENT
WITH THE TEXAS DEPARTMENT OF TRANSPORTATION (TxDOT) FOR
THE TEMPORARY CLOSURE OF STATE RIGHT- OF- WAY IN SUPPORT OF
THE 2026 PARIS ART FAIR; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, by Ordinance No. 96-023, the City Council of the City of Paris created
a special event permit for temporary events which require the closure of public streets; and,
WHEREAS, in connection with the 2026 Paris Art Fair, the city has been asked to
close State Highway 19/ 24B in Lamar County, Texas on May 16, 2026 from 6:00 am to
6:00 pm as described in the attached Exhibit "A"; and,
WHEREAS, allowing the use of north bound State Highway 19/ 24B to be closed
from Sherman Street to Austin Street for the 2026 Paris Art Fair which serves a public
purpose in that such an event will bring a substantial amount of business and tourism to
the City of Paris, and to the downtown area in particular, and it is deemed appropriate that
the temporary closure of said streets be authorized, subject to final approval of detailed
plans by both the Special Events Committee and the State of Texas; and
WHEREAS, the temporary closure will be from:
1. 6:00 AM Saturday, March 16, 2026, to 6:00 PM Saturday, May 16, 2026, Event Date

WHEREAS, in order to effect said closure, it is necessary for the City of Paris to
enter into an Agreement for the Temporary Closure of State Right-of-way Agreement with
the State of Texas, and the form of said agreement, attached hereto as Exhibit "A", should,
in all things, be approved, and the Mayor should be authorized to execute the same;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS:
Section 1. That the findings set out in the preamble to this resolution are hereby in
all things approved and are incorporated herein by reference.
Section 2. That it is determined that the use of State Highway 19/ 24B North Bound
between Sherman Street and Austin Street shall be closed on May 16, 2026 to allow for the
Paris Art Fair that serves a public purpose; therefore, the temporary closure of said streets
for such event be, and the same is hereby, authorized, subject to final approval of detailed
plans by both the Special Events Committee and the State of Texas.
Section 3. That the form of the Agreement for the Temporary Closure of State Right -
of -Way, attached hereto as "Exhibit A", be, and the same is hereby, approved.
Section 4. That the Mayor of the City Council be, and he is hereby, authorized and
directed to execute, on behalf of the City of Paris, the Agreement for the Temporary
Closure of State Agreement, under the terms and conditions and in the form shown in
"Exhibit A", attached hereto.
Section 5. That this resolution shall be effective from and after its date of passage.

AGREEMENT FOR THE TEMPORARY CLOSURE
OF STATE RIGHT OF WAY
THIS AGREEMENT is made by and between the State of Texas, acting by and through the
Texas Department of Transportation, hereinafter called the "State," and the City of
, a municipal corporation, acting by and through its
duly authorized officers, hereinafter called the "local government."
WITNESS ETH
WHEREAS, the State owns and operates a system of highways for public use and benefit,
including, in, County; and
WHEREAS, the local government has requested the temporary closure of

"Event;" and
WHEREAS, the Event will be located within the local government's incorporated area; and
WHEREAS, the State, in recognition of the public purpose of the Event, wishes to cooperate

the closure of the State's right of way will be performed within the State's requirements; and
WHEREAS, on

WHEREAS, this agreement has been developed in accordance with the rules and
procedures of 43 TAC, Section 22.12;
NOW, THEREFORE, in consideration of the premises and of the mutual covenants and
agreements of the parties hereto, to be by them respectively kept and performed as
hereinafter set forth, it is agreed as follows:
AGREEMENT
Article 1. CONTRACT PERIOD
This agreement becomes effective upon final execution by the State and shall terminate upon
completion of the Event or unless terminated or modified as hereinafter provided.
Agreement
Article 2. EVENT DESCRIPTION
The physical description of the limits of the Event, including county names and highway
numbers, the number of lanes the highway has and the number of lanes to be used, the
proposed schedule of start and stop times and dates at each location, a brief description of
the proposed activities involved, approximate number of people attending the Event, the
number and types of animals and equipment, planned physical modifications of any
manmade or natural features in or adjacent to the right of way involved shall be attached
hereto along with a location map and identified as "Exhibit C."
Article 3. OPERATIONS OF THE EVENT
A. The local government shall assume all costs for the operations associated with the
Event, to include but not limited to, plan development, materials, labor, public notification,
providing protective barriers and barricades, protection of highway traffic and highway
facilities, and all traffic control and temporary signing.
B. The local government shall submit to the State for review and approval the
construction plans, if construction or modifications to the State's right of way is required, the
traffic control and signing plans, traffic enforcement plans, and all other plans deemed
necessary by the State. The State may require that any traffic control plans of sufficient
complexity be signed, sealed and dated by a registered professional engineer. The traffic
control plan shall be in accordance with the latest edition of the Texas Manual on Uniform
Traffic Control Devices. All temporary traffic control devices used on state highway right of
way must be included in the State's Compliant Work Zone Traffic Control Devices List. The
State reserves the right to inspect the implementation of the traffic control plan and if it is
found to be inadequate, the local government will bring the traffic control into compliance
with the originally submitted plan, upon written notice from the State noting the required
changes, prior to the event. The State may request changes to the traffic control plan in order
to ensure public safety due to changing or unforeseen circumstances regarding the closure.
C. The local government will ensure that the appropriate law enforcement agency has
reviewed the traffic control for the closures and that the agency has deemed them to be

adequate. If the law enforcement agency is unsure as to the adequacy of the traffic control, it
will contact the State for consultation no less than 10 workdays prior to the closure.
D. The local government will complete all revisions to the traffic control plan as requested
by the State within the required timeframe or that the agreement will be terminated upon
written notice from the State to the local government. The local government hereby agrees
that any failure to cooperate with the State may constitute reckless endangerment of the
public and that the Texas Department of Public Safety may be notified of the situation as soon
as possible for the appropriate action, and failing to follow the traffic control plan or State
instructions may result in a denial of future use of the right of way for three years. E. The local
government will not initiate closure prior to 24 hours before the scheduled Event and all
barriers and barricades will be removed and the highway reopened to traffic within 24 hours
after the completion of the Event.
F. The local government will provide adequate enforcement personnel to prevent vehicles
from stopping and parking along the main lanes of highway right of way and otherwise prevent
interference with the main lane traffic by both vehicles and pedestrians. The local government
will prepare a traffic enforcement plan, to be approved by the State in writing at least 48 hours
prior to the scheduled Event. Additionally, the local government shall provide to the State a
letter of certification from the law enforcement agency that will be providing traffic control for
the Event, certifying that they agree with the enforcement plan and will be able to meet its
requirements.
G. The local government hereby assures the State that there will be appropriate passage
allowance for emergency vehicle travel and adequate access for abutting property owners
during construction and closure of the highway facility. These allowances and accesses will be
included in the local government's traffic control plan.
H. The local government will avoid or minimize damage, and will, at its own expense,
restore or repair damage occurring outside the State's right of way and restore or repair the
State's right of way, including, but not limited to, roadway and drainage structures, signs,
overhead signs, pavement markings, traffic signals, power poles and pavement, etc. to a
condition equal to that existing before the closure, and, to the extent practicable, restore the
natural and cultural environment in accordance with federal and state law, including landscape
and historical features.
Article 4. OWNERSHIP OF DOCUMENTS
Upon completion or termination of this agreement, all documents prepared by the local
government will remain the property of the local government. All data prepared under this
agreement shall be made available to the State without restriction or limitation on their further
use. At the request of the State, the Local Government shall submit any information required
by the State in the format directed by the State.
Article 5. TERMINATION
A. This agreement may be terminated by any of the following conditions:
(1) By mutual written agreement and consent of both parties.

(2) By the State upon determination that use of the State's right of way is not feasible or
is not in the best interest of the State and the traveling public.
(3) By either party, upon the failure of the other party to fulfill the obligations as set forth
herein.
(4) By satisfactory completion of all services and obligations as set forth herein. B. The
termination of this agreement shall extinguish all rights, duties, obligations, and
liabilities of the State and local government under this agreement. If the potential
termination of this agreement is due to the failure of the local government to fulfill
its contractual obligations as set forth herein, the State will notify the local
government that possible breach of contract has occurred. The local government
must remedy the breach as outlined by the State within ten (10) days from receipt of
the State's notification. In the event the local government does not remedy the
breach to the satisfaction of the State, the local government shall be liable to the
State for the costs of remedying the breach and any additional costs occasioned by
the State.
Article 6. DISPUTES
Should disputes arise as to the parties' responsibilities or additional work under this agreement,
the State's decision shall be final and binding.
Article 7. RESPONSIBILITIES OF THE PARTIES
The State and the Local Government agree that neither party is an agent, servant, or employee
of the other party and each party agrees it is responsible for its individual acts and deeds as
well as the acts and deeds of its contractors, employees, representatives, and agents.
Article 8. INSURANCE
A. Prior to beginning any work upon the State's right of way, the local government and/or its
contractors shall furnish to the State a completed "Certificate of Insurance" (TxDOT Form 1
560, latest edition) and shall maintain the insurance in full force and effect during the period

that the local government and/or its contractors are encroaching upon the State right of way.
B. In the event the local government is a self-insured entity, the local government shall
provide the State proof of its self-insurance. The local government agrees to pay any and all
claims and damages that may occur during the period of this closing of the highway in
accordance with the terms of this agreement.
Article 9. AMENDMENTS
Any changes in the time frame, character, agreement provisions or obligations of the parties
hereto shall be enacted by written amendment executed by both the local government and
the State.
Article 10. COMPLIANCE WITH LAWS
The local government shall comply with all applicable federal, state and local environmental
laws, regulations, ordinances and any conditions or restrictions required by the State to
protect the natural environment and cultural resources of the State's right of way.
Article 11. LEGAL CONSTRUCTION
In case one or more of the provisions contained in this agreement shall for any reason be
held invalid, illegal or unenforceable in any respect, such invalidity, illegality or
unenforceability shall not affect any other provisions hereof and this agreement shall be
construed as if such invalid, illegal or unenforceable provision had never been contained
herein.
Article 12. NOTICES
All notices to either party by the other required under this agreement shall be delivered
personally or sent by certified U.S. mail, postage prepaid, addressed to such party at the
following respective addresses:

BACKGROUND:
The proposed tax note will fund two critical projects. The first is the replacement of the Police
Department roof. The overall condition of the roof is a significant concern, and staff has been
aware of the need for replacement for some time. Immediate action is necessary, as the most
compromised area is located above the evidence storage area. A structural failure in this location
would have catastrophic consequences for police department operations.
Second, the tax note will fund the purchase of a new heavy rescue fire truck. This will allow us
to remain aligned with the Fire Department's Capital Improvement Plan. The truck will have an
estimated delivery timeline of approximately four years and will replace a unit that is over 15
years old. This unit operates countywide and has already required significant investment,
including a new engine ($25,000) and two transmission replacements ($15,000 each). In
addition, more than $10,000 was spent on general repairs last year alone. As our fleet continues
to age, maintenance costs increase while reliability declines.
STATUS OF ISSUE:
The following items are proposed to be funded with the tax notes:

BUDGET:

Authorize City staff to proceed with the plan to obtain a 2026 tax note to purchase a heavy rescue
fire truck and replace the Police Department roof.

BACKGROUND:
The applicant is seeking a Zoning Change from an Agricultural District (A) to a Commercial
District (C). A quarter of the lot to the northwest comer is an existing building occupied by Rhino's
Ammo, LLC, a retailer of firearms, ammo, bows, etc. The rest of the lot is vacant and proposed to
be used as a trailer rental or sales to the existing business. To establish a trailer rental or sales
business, it is only allowed in a commercial zoning district with a Specific Use permit. This
requirement has necessitated the need for a zoning change to allow for the proposed use for a trailer
rental or sales business. The lot size is 1.03 acres. Furthermore, the Future Land Use Map for this
lot is guided by Commercial (C) hence there is no need for a Comprehensive Plan Amendment of
the said property.
Access and connection to utilities are available at this location. Commercial development in this
location will provide conformity and will serve the immediate and long-term needs of the vicinity.
However, an appropriate measure must be provided to the south portions of adjacent residential
zoning districts to minimize incompatible uses between residential and retail uses, to minimize
noise or nuisance.

SPECIFIC USE PERMITS
The City Council of the City of Paris, Texas, after public hearing and proper notice to all parties
affected and after recommendations by the Planning and Zoning Commission may authorize the
issuance of specific use permits for the following types of uses in the following districts:
Trailer Rental or Sales in the Commercial (C) zoning district.
According to Section 12-101 ofthe Zoning Ordinance, "The city staff shall review and recommend
said Special Use Permit request and the Planning and Zoning Commission in considering and
determining its recommendation and the City Council on any request for a Specific Use Permit
shall require from the applicant Site plans and supportive plans, information, operating data and
expert evaluation concerning the location, function and characteristics of any building or use
proposed. The City Council may, in the interest of the public welfare and to assure compliance
with this ordinance, establish conditions of operation, location, arrangement and construction of
any use for which a permit is authorized."
STATUS OF ISSUE:
Applicant's interest is to rezone the property from Agriculture District to Commercial District to
comply with the Zoning Code - Use of Land and Building sec 8-107 Commercial & Service Uses
that will allow Trailer Rental or Sales under Special Use Permit. The request for zoning change at
this location from an Agricultural District (A) to a Commercial District (C) will be compatible with
the current zoning in surrounding areas. Moreover, the Future Land Use Map indicates that the
property and surrounding areas are guided by Commercial (C). This development trend will
conform to the current zoning and surrounding areas as zoned Agriculture projected to be
Comthercial along US 271 corridor. It is therefore appropriate to rezone the property to
Commercial (C) now. Nevertheless, it is hopeful that more of the future land uses in this area will
follow the pattern of Commercial District (C) per the Future Land Use Map. This condition allows
for the zoning change and is compatible with the zoning regulations. All improvements and
construction shall conform to the standards required by the City of Paris.

or the fifth (5th) anniversary of the date of this ordinance, whichever occurs first.
Section 3. That the Chief Building Official of the City of Paris be, and he is hereby,
directed to change the Official Zoning Map of the City of Paris, Texas to reflect the changes
set forth in this ordinance.
Section 4. That all provisions of the ordinances of the City of Paris, Texas in conflict
with the provisions of this ordinance are hereby repealed, and all other provisions of the
ordinances of the City of Paris not in conflict with the provisions of this ordinance shall
remain in full force and effect.
Section 5. That the repeal of any ordinance or part of ordinances affected by the
enactment of this ordinance shall not be construed as abandoning any action now pending
under or by virtue of such ordinance or as discontinuing, abating, modifying, or altering
any penalty accruing or to accrue, or as affecting any rights of the municipality under any
section or provisions of any ordinance at the time of passage of this ordinance.
Section 6. That it is the intention of the City Council of the City of Paris that this
ordinance and every provision hereof, shall be considered severable, and the invalidity or
partial invalidity of any section, clause, or provisions of this ordinance shall not affect the
validity of any other portion of this ordinance.
Section 7. That any person violating any provision of this ordinance shall be guilty
of a Misdemeanor, and upon conviction, shall be subject to a fine in accordance with
provisions of Sec. 1.01.009 of the City of Paris Code of Ordinances, and each and every
day's continuance of any violation of the above -enumerated sections shall constitute and
be deemed a separate offense.
Section 8. This ordinance shall become effective from and after its passage and
publication as required by law.

BACKGROUND:
The City Council heard this case on August 25, 2025, where a motion to table the case was
approved. City Council agreed to have a workshop to gain clarity and more information on the
case to make a meaningful decision. Moreover, it was recommended that the applicant, Mr. Paul
Stoll and the concerned residents have a meeting to discuss and resolve the issues to come out
with an amicable understanding relating to the Comprehensive Plan Amendment of the property.
On Monday, August 4, 2025, the City of Paris Planning & Zoning Commission held its regular
meeting and there was an extensive deliberation on the Comprehensive Plan Amendment
petition, where the Commission voted to recommend approval of the item above.
City Manager Rose Beverly held a staff meeting on Thursday, August 28, 2025, that involved
legal, Planning & Community Development, and Engineering Departments to deliberate on the
cases. It was concluded that a City Council workshop will be scheduled and that staff will have
to prepare a much more detailed presentation with visual maps of the vicinity in question for
council members to have a better understanding of the issue in question.
The concerned residents and Mr. Paul Stoll arranged for a meeting and met on September 4, 2025.
During the deliberations, it was discovered that one of the notices with the map of the proposed
zoning request was inaccurate and included a portion that was not supposed to be added. This
omission created confusion among some residents whose properties were adjoining the area in
question. Since then, staff corrected the error and updated the City Council during a workshop
session held on September 9, 2025.
The applicant and owner Paul Stoll of Plan Z development is seeking an amendment to the
Comprehensive Plan being Low Density Residential (LDR) to Retail (R) for Future Land Use Map
of the property. The lot is currently zoned a One -Family Dwelling District No. 2 (SF -2), in the City
of Paris, Block 259, Lot PT of 14, being a portion of LCAD 18277, (5.97 acres) located at N.
Collegiate Drive and Pine Mill Road. The property is currently a vacant lot. Furthermore, on this
Agenda, are zoning change requests that apply to the same and adjoining properties by Paul Stoll
of Plan Z development.
Access and connection to utilities are available at this location. Commercial development in this
location will provide conformity and will serve the immediate and long-term needs of the vicinity.
However, an appropriate buffer must be provided to the southern portion of adjacent residential
zoning district to minimize incompatible uses between Residential and commercial use noise or
nuisance.
STATUS OF ISSUE:
There is an application for a zoning change at this site location from a One -Family Dwelling
District No. 2 (SF -2) to Commercial (C), hence the reason for the request of an amendment to the
Comprehensive Plan from Low Density Residential (LDR) to Retail (R) for the Future Land Use
Map. Whereas the Future Land Use Map for the area and property is guided by retail, the zoning
application request will result in a Commercial Zoning District (C) aligning and compatible with
the current zoning in surrounding areas as commercial. Nevertheless, it is hopeful that more of the
future land uses in this area will follow the Retail District (R). Invariably, an application for a
Comprehensive Plan amendment for future land use from Low Density Residential (LDR) to Retail
(R) is appropriate.
ANALYSIS
• The land to the North is currently zoned Planned Development (PD) with a request for a zoning
change to Commercial (C) (and is guided by Retail -(R) District).
• The land to the South is zoned Single Family Dwelling District (SF -2), which is guided by Low
Density Residential (LDR) and developed as Single -Family Residential Subdivision.
• The land to the East is vacant and zoned Commercial District (C) which is guided by Retail
District-, _-, r.
• The land to the West is zoned Single Family Dwelling District (SF -2) which is guided by Low
Density Residential (LDR) and is currently developed as single-family dwellings.
BUDGET:
There are no significant budgetary implications due to this proposal.

WHEREAS, Section 211.004 ofthe Texas Local Government Code requires

comprehensive plan may:
1. Include but is not limited to provisions on land use, transportation, and
public facilities;
2. Consist of a single plan or a coordinated set of plans organized by subject
and geographic areas; and
3. Be used to coordinate and guide the establishment of development
regulations; and,
WHEREAS, the adoption of the proposed Comprehensive Plan shall not, in
accordance with Section 213.004 of the Local Government Code, limit the ability
of the City of Paris to prepare other plans, policies, or strategies related to land use
and land use planning as required; and
WHEREAS, in September 2001, the City Council adopted a City of Paris, Texas
Comprehensive Plan and Future Land Use Map; and
WHEREAS, in October of 2018, the City Council adopted the last significant
revisions to the Comprehensive Plan and the Future Land Use Plan and has since
approved minor revisions thereto; and
WHEREAS, the City Council of the City of Paris, Texas, received a petition for
amendments to the Comprehensive Plan and Future Land Use Map for the City of
Paris from Low Density Residential (LDR) to Retail (R) on LCAD Parcel No. 18277
(5.97 acres), City of Paris Block 259, Lot PT of 14, located on N. Collegiate Drive and
Pine Mill Road; and
WHEREAS, analysis of the existing conditions of the neighborhood does not
support such a change to the Comprehensive Plan and the Future Land Use Map; and
WHEREAS, on August 4, 2025, the Planning and Zoning Commission
conducted a public hearing on said proposed amendment after notice and
publication as required by law, and, following said hearing, made formal
recommendation by a 6 ayes -1 nay vote to the City Council to approve said
proposed Comprehensive Plan and Future Land Use Map Amendments; and
WHEREAS, on March 23, 2026 after notice and publication as required by
law, the City Council of the City of Paris held a public hearing to receive input from
the citizens of the City of Paris regarding the proposed amendment to the Future
Land Use Map and the City Council determined that this amendment should be
approved by a vote of with ayes and nays.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, TEXAS:
Section 1. That the findings set out in the preamble to this ordinance are hereby
in all things approved and are incorporated herein for all purposes.
Section 2. That the Comprehensive Plan and Future Land Use Map for the
City of Paris shall be amended from Low Density Residential (LDR) to Retail (R) on
LCAD Parcel No. 18277 (5.97 acres), City of Paris Block 259, Lot PT of 14, located on
N. Collegiate Drive and Pine Mill Road.
Section 3. That all provisions of the ordinances of the City of Paris, Texas in
conflict with the provisions of this ordinance are hereby repealed, and all other
provisions of the ordinances of the City of Paris not in conflict with the provisions
of this ordinance shall remain in full force and effect.
Section 4. That the repeal of any ordinance or part of ordinances affected
by the enactment of this ordinance shall not be construed as abandoning any
action now pending under or by virtue of such ordinance or as discontinuing,
abating, modifying, or altering any penalty accruing or to accrue, or as affecting
any rights of the municipality under any section or provisions of any ordinance at
the time of passage of this ordinance.
Section 5. That it is the intention of the City Council of the City of Paris that
this ordinance, and every provision hereof, shall be considered severable, and the
invalidity or partial invalidity of any section, clause, or provisions of this ordinance
shall not affect the validity of any other portion of this ordinance.
Section 6. That this ordinance shall become effective from and after its passage.

BACKGROUND:
The City Council heard this case on August 25, 2025, where a motion to table the case was
approved. City Council agreed to have a workshop to gain clarity and more information on the
case to make a meaningful decision. Moreover, it was recommended that the applicant, Mr. Paul
Stoll and the concerned residents have a meeting to discuss and resolve the issues to come out
with an amicable understanding relating to the rezoning of the property.
On Monday, August 4, 2025, the City of Paris Planning & Zoning Commission held its regular
meeting and there was an extensive deliberation on the zoning change petition, where the
Commission voted to recommend approval of the item above.
The concerned residents and Mr. Paul Stoll arranged for a meeting and met on September 4, 2025.
During the deliberations, it was discovered that one of the notices with the map of the proposed
zoning request was inaccurate and included a portion that was not supposed to be added. This
omission created confusion among some residents whose properties were adjoining the area in
question. Since then, staff corrected the error and updated the City Council during a workshop
session held on September 9, 2025.
The applicant, Paul Stoll of Plan Z Developments is seeking a Zoning Change from a One -Family
Dwelling No. 2 (SF2) to Commercial (C). The lot is currently vacant and zoned a One -Family
Dwelling District No. 2 (SF -2), in the City of Paris, Block 259, Lot PT of 14, being a portion of
LCAD 18277, (5.97 acres) located at N. Collegiate Drive and Pine Mill Road. Furthermore, on this
Agenda (Items 4) there is an application to also amend the Future Land Use Map from Low Density
Residential (LDR) to Retail (R) of the said property.
Access and connection to utilities are available at this location. Commercial development in this
location will provide conformity and will serve the immediate and long-term needs of the vicinity.
However, an appropriate buffer must be provided to the south and west portions of adjacent
residential zone districts to minimize incompatible uses between residential and commercial uses,
probably due to noise, light or another nuisance.
STATUS OF ISSUE:
Whereas a specific land use type is not determined yet, applicant's interest is to rezone the property
to commercial use. The request for zoning change at this site location from Single Family Dwelling
(SF -2) to Commercial (C) will be compatible with the current zoning in surrounding areas.
Invariably, the Future Land Use Map indicates that the property and surrounding areas are guided
by Retal (R), however the current zoning and surrounding areas are largely zoned commercial. It
is therefore appropriate to rezone the property to commercial now. Nevertheless, it is hopeful that
more of the future land uses in this area will follow the Retail District (R) per the Future Land Use
Map. This condition allows for the zoning change and compatible with the existing surroundings.
All improvements and construction shall conform to the standards required by the City of Paris.
Engineering:
The GIS Map for the case that was sent out to property owners within the 200 ft radius of the
rezoning application was inaccurate and staff missed the change when the notices were sent out. It
included the whole LCAD parcel 18277 instead of a part or portion of LCAD 4 18277 being (5.97
acres). This situation also created confusion leading to some residents within the west side of the
Springlake Estate Subdivision complaining in opposition to the application.
Drainage and Grading Plan will have to meet city requirements during development stages.
Buffering Regulations 30-100 Required Landscaping. Property owner shall follow the zoning
regulations under the buffer requirements.
Applicant has submitted a preliminary plat of the southern portion of LCAD 18277, being phase
6 of Lot (613) Block (1) to Planning and Zoning Commission to construct 15 Single Family
Dwelling SF -2 new Homes to on the west side of Springlake Estate Subdivision.
Street Network Access: There will be no street linking or connecting the properties in question and
the existing Springlake Estate Subdivision.
ANALYSIS
• The land to the North is currently zoned Planned Development (PD) with a request for a zoning
change to Commercial (C) (and is guided by Retail -(R) District).
• The land to the South is zoned Single Family Dwelling District (SF -2), which is guided by Low
Density Residential (LDR) and developed as Single -Family Residential Subdivision.
e The land to the East is vacant and zoned Commercial District (C) which is guided by Retail
District -(R).
• The land to the West is zoned Single Family Dwelling District (SF -2) which is guided by Low
Density Residential (LDR) and currently developed as single-family dwellings.
The Planning Department has received thirty-one (3 1) input forms that are opposed to the zoning
change application from the surrounding propeny owners.
The Planning & Zoning Commission recommended approval of the zoning change at its August 4,
2025, meeting. Motion carried, 7 ayes 0 nays.
City Council on August 25, 2025, tabled the application 5 ayes -0 nays OPTIONS
1. Approve Planning & Zoning Commission's recommendation.

After an extensive public hearing on an earlier related Comprehensive Plan Amendment case
(Agenda Item No. 16) on Monday, August 25, 2025, the City Council decided to table the above
application for further review and consideration. This zoning request has no omission to it and
the application remains valid. It was, however, agreed that concerned residents and applicant Mr.
Paul Stoll should meet with the possibility of resolving their difference and agree on the
proposed Comprehensive Plan Amendment and Zoning Change applications. That meeting
happened on Thursday September 4, 2025.

this Agenda is a zoning change request that applies to the same and adjoining property to the
south by Paul Stoll of Plan Z development.

develop the property into a retail and commercial uses. The current zone for this property, that is
Planned Development (PD), will not be appropriate for the intended uses, hence the request for a
zoning change from Planned Development (PD) to Commercial (C). The request for zoning
change at this site from Planned Development (PD) to Commercial (C) will be compatible with
the current zoning in surrounding areas which is Commercial (C). Invariably, the Future Land Use
Map indicates that the property and surrounding areas are guided by Retail (R), however the
current zoning and surrounding areas are zoned commercial. It is therefore appropriate to rezone
the property to commercial now. Nevertheless, it is hopeful that more of the future land uses in
this area will follow the Retail District (R) per the Future Land Use Map. This condition allows
for the zoning change to be compatible with the existing and surrounding areas. All improvements

SUBJECT: Waiver of penalties and interest related to 1 " assessment for Forestbrook Public
Improvement District No. 1
DATE: March 23, 2026
BACKGROUND: City Council created Forestbrook Public Improvement District No. I (the "PID")
in September of 2024. Thereafter, on July 14, 2025, Council approved a service and assessment
plan for a portion of the property within the PID (Public Improvement Area No. 1) and levied
assessments on that property. Revenues from the assessments are to be used to repay PID bonds
that Council authorized on October 27, 2025. For the first year of the PID, Lone Star Planned
Developments, LLC ("Owner") was the sole owner of the properties within PIA No. I . The City
engaged a third parry contractor, TXGovSolutions ("Contractor"), to mail notice of the assessment
to the owner.
STATUS OF ISSUE: Owner failed to make the PID assessment payment in a timely manner. There
is some question as to delivery of the notice. Contractor maintains that it mailed out the notice to
owner as required; Owner asserts that it never received the notice, resulting in the missed deadline.
Penalties and interest on the assessment payment began accruing upon the missed deadline. The
PID administrator, P3, contacted me on February 23rd because it was concerned that the PID would
not receive the assessment payment prior to the March 1 deadline for the PID to make its first debt
service payment on the bond. I agreed that if Owner immediately paid the assessment (in an
approximate amount of $35,000.00), I would bring the issue of waiving the penalties and interest
to Council for your consideration. Owner agreed and made the payment. Consequently, the PID
was able to pay the bond debt service as scheduled, and any potential adverse consequences have
been mitigated. Owner now requests that you waive penalties and interest in the amount of
$13,585.17. In the event that Council declines to do so, the penalties and interest would go into the
PID bond fund, not into the city's general fund.
BUDGET: None.
RECOMMENDATION: Consider and possibly act on waiving penalties and interest in the amount
of $13,585.17 accrued as a result of the late payment of the PID assessment.
