"ZONING DISTRICTS ESTABLISHED"; AMENDING THE OFFICIAL LAND
USE MATRIX TO ALLOW INDIVIDUAL HUD -CODE MANUFACTURED HOMES
IN THE MH DISTRICT AND THE SF -3 ONE -FAMILY DWELLING DISTRICT,
ESTABLISHING DISTRICT AND SUPPLEMENTAL DEVELOPMENT
STANDARDS; AMENDING CHAPTER 4, SECTION 4.08.003, "ALLOWABLE
LOCATIONS FOR MANUFACTURED HOMES AND MOBILE HOMES," TO
REMOVE THE PROHIBITION AGAINST AUTHORIZED INDIVIDUAL HUD -
CODE MANUFACTURED HOMES; EXPRESSLY PRESERVING THE
EXISTING REGULATIONS FOR MANUFACTURED HOME PARKS,
MANUFACTURED HOME SUBDIVISIONS, RECREATIONAL VEHICLES,
TRAILERS, AND OTHER SPECIAL VEHICLES; PROVIDING A REPEALER
CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY
CLAUSE; PROVIDING A PENALTY CLAUSE; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the City of Paris is a home -rule municipality operating under the
Constitution and laws of the State of Texas and possesses authority to regulate zoning, land
use, development, public infrastructure, subdivision, utilities, construction, fire safety, and
related matters within its jurisdiction to protect the public health, safety, and welfare; and
WHEREAS, the City has adopted Zoning Ordinance No. 1710, codified as Chapter 9,
Exhibit 9B, "Zoning Ordinance," of the Code of Ordinances of the City of Paris, Texas, which
regulate the use of land, buildings, structures, and premises within the City; and
WHEREAS, HUD -code manufactured homes constructed on or after June 15, 1976, are
regulated under federal manufactured housing construction and safety standards and constitute
a distinct form of residential housing; and
WHEREAS, the City Council finds that individual HUD -code manufactured homes
provide an important housing option and should be allowed in appropriate residential districts
subject to objective zoning, installation, appearance, parking, utility, and occupancy standards;
and
WHEREAS, the City Council desires to establish the MH Manufactured Housing District
for individually owned residential lots and to allow individual HUD -code manufactured homes in
the SF -3 One -Family Dwelling District; and
WHEREAS, the City Council intends at this time to preserve, without substantive
amendment, the City's existing regulations governing manufactured home parks, manufactured
home subdivisions, recreational vehicles, trailers, and other special vehicles pending the
adoption of the Paris Development Code; and
WHEREAS, on August 19, 2026, following notice and publication as required by law, the
Planning and Zoning Commission conducted a public hearing on the proposed amendments to
the City Zoning Ordinance, and following said hearing, made formal recommendation to the City
Council to approve the requested amendments; and
WHEREAS, on August 24, 2026, following notice and publication as required by law, the
City Council of the City of Paris conducted a public hearing on the proposed amendments to the
City Zoning Ordinance and the City Code of Ordinances, and having considered the
recommendation of the Planning and Zoning Commission and the testimony and evidence
introduced at said public hearing, found and determined that approving the aforesaid
amendments would be consistent with the City Zoning Ordinance and the City Code of
Ordinances, and in the best interests of the public health, safety, and welfare of the citizens of
the City of Paris by a vote of 6 ayes and 0 nays.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS,
TEXAS:
SECTION 1. Findings Incorporated.
The findings and recitals set forth above are hereby found to be true and correct and are
incorporated into this Ordinance for all purposes.
SECTION 2. Section 3-100 Amended — MH District Established.
Section 3-100, "Zoning Districts Established," of Zoning Ordinance No. 1710 is amended as
follows:
(a) The phrase "nineteen (19) zoning districts" is amended to read "twenty (20) zoning districts."
(b) The following district is added to the table of zoning districts in its appropriate location:

SECTION 3. Manufactured Homes (MH) Zoning District Regulations:
Zoning Ordinance No. 1710 is hereby amended by adding the following MH Manufactured
Housing District regulations. The City Secretary and codifier are authorized to assign the
regulations an appropriate permanent section number:
MH MANUFACTURED HOUSING DISTRICT
(a) Purpose and intent.
The MH Manufactured Housing District is established to provide appropriate locations for
individual HUD -code manufactured homes on individually platted lots or lawful tracts. The
district is intended to expand residential housing opportunities while requiring development
that is compatible with surrounding neighborhoods and supported by adequate streets,
utilities, drainage, and emergency access.
(b) Permitted principalUSe.
One individual HUD -code manufactured home may be placed on each individually platted
lot orlawful tract in the MH District. NO manufactured home park, manufactured housing

(c}Accessory uses and structures.

AHUD-code manufactured home inthe K8HDistrict shall comply with Section 4.O8.003ofthe
Coda of Ordinances, applicable federal and state installation requirements, the Zoning
Ordinance, adopted construction codes, utility requirements, floodplain regulations, and other
applicable law.
SECTION 4.Official Land Use Matrix Amended.
Section 8-101, "Primary Residential Uses," of the Official Land Use Matrix is hereby amended
Dwelling — Manufactured Home (HUD- P* P Added as an individual residential
Code) use; subject to § 4.08-003.
Manufactured Home Subdivision P Existing Ll authorization remains
unchanged.
Manufactured Home Park P Existing Ll authorization remains
unchanged.

to the supplemental regulations contained in Article 4.08 and all other applicable provisions of this Ordinance.

(a) The MH column shall be added to each use -schedule table. A blank entry in the MH column
means the use is prohibited unless this Ordinance or a later ordinance expressly authorizes
the use.
(b) The terms "Manufactured Home Subdivision" and "Manufactured Home Park," and their
existing authorization in the Ll District, are not amended by this Ordinance.
SECTION 5. Definitions Added.
Section 22, "General Definitions," of Zoning Ordinance No. 1710 is amended by adding the
following definitions in alphabetical order:
HUD Certification Label means the permanent label or tag affixed to each transportable
section of a HUD -Code Manufactured Home by the manufacturer, or other documentation
accepted under applicable federal or state law, certifying that the home was constructed in
compliance with the federal manufactured home construction and safety standards in effect on
the date of manufacture.
HUD -Code Manufactured Home. A structure constructed on or after June 15, 1976, according
to the rules of the United States Department of Housing and Urban Development; transportable
in one or more sections; built on a permanent chassis; designed for use as a dwelling with or
without a permanent foundation when connected to required utilities; and bearing the
certification required by applicable federal law. The term has the meaning assigned by Section
1201.003 of the Texas Occupations Code, as amended. The term does not include a mobile
home constructed before June 15, 1976, a modular or industrialized home, a recreational
vehicle, a park -model recreational vehicle, or a travel trailer.
For purposes of the Official Land Use Matrix, "Dwelling - Manufactured Home (HUD -Code)"
means one HUD -code manufactured home located on an individually platted lot or lawful tract
and used as a single-family dwelling outside a manufactured home park or manufactured home
subdivision.
Individual Manufactured Home means one HUD -Code Manufactured Home located on an
individually platted lot or lawful tract and used as a single-family dwelling outside a
Manufactured Housing Community.
This term does not include a Mobile Home, Manufactured Home Subdivision, Manufactured
Housing Community, recreational vehicle, park model recreational vehicle, travel trailer, or
modular or industrialized home.
Manufactured Home Lot means an individually platted lot within a Manufactured Home
Subdivision that is intended for the placement of one HUD -Code Manufactured Home and its
permitted accessory buildings, parking, yards, utility connections, and other improvements.
Manufactured Housing means a HUD -Code Manufactured Home or a Mobile Home, as those
terms are defined by Chapter 1201 of the Texas Occupations Code.
Where this Ordinance regulates a particular type of manufactured housing, the more specific
defined term shall be used.
Mobile Home means a structure constructed before June 15, 1976, transportable in one or
more sections, built on a permanent chassis, and designed for use as a dwelling with or without
a permanent foundation when connected to required utilities.
The term has the meaning assigned by Section 1201.003 of the Texas Occupations Code, as
amended, and does not include a HUD -Code Manufactured Home.
Mobile Home, Legacy means a Mobile Home constructed before June 15, 1976.
The term is used in the Official Land Use Matrix to distinguish a pre -HUD Mobile Home from a
HUD -Code Manufactured Home and does not establish or authorize a separate land use.
Modular Home means a residential industrialized building constructed in one or more modules
or sections at a location other than the permanent building site and designed to be installed on a
permanent foundation in accordance with the building codes applicable to site -built construction.
A Modular Home is not a HUD -Code Manufactured Home or Mobile Home.
Permanent Foundation means a foundation system designed and constructed in accordance
with applicable state installation standards, the manufacturer's approved installation
instructions, and other applicable City requirements to support and anchor a manufactured
home at its approved location.
State Installation Standards means the statutes and rules administered by the Texas
Department of Housing and Community Affairs governing the installation, anchoring, foundation
support, alteration, inspection, and related regulation of manufactured housing, as amended.
SECTION 6. Section 4.08.003 Amended.
Chapter 4, Article 4.08, Section 4.08.003, "Allowable locations for manufactured homes and
mobile homes," is hereby repealed and replaced as as follows:
Sec. 4.08.003. Allowable locations and supplemental regulations for manufactured homes
and mobile homes.
(a) Authorized locations. A HUD -code manufactured home may be located within the City only:
(1) as an individual dwelling on an individually platted lot or lawful tract in the MH
Manufactured Housing District;
(2) as an individual dwelling on an individually platted lot or lawful tract in the SF -3 One -
Family Dwelling District;
(3) within a manufactured home subdivision authorized by the Zoning Ordinance; or
(4) within a manufactured home park authorized by the Zoning Ordinance and operated in
compliance with Division 3 of this article.
(b) Land -use approval. An individual HUD -code manufactured home is permitted by right in the
MH and SF -3 Districts when the proposed home and site comply with all applicable
nondiscretionary requirements. No zoning amendment, specific use permit, special
exception, or comparable discretionary land -use approval is required for the individual
home.
(c) District standards. An individual HUD -code manufactured home and its lot shall comply with
the area, yard, height, coverage, floor -area, parking, accessory -structure, and other
standards applicable to the zoning district in which it is located.
(d) One principal dwelling. Not more than one principal dwelling may be located on an individual
lot or lawful tract under this section.
(e) HUD certification. Each transportable section shall bear the HUD certification label required
by applicable federal law. The applicant shall provide the HUD data plate or other
documentation accepted under applicable federal or state procedures.
(f) Installation. Transportation and installation shall be performed by persons licensed or
otherwise authorized by the State of Texas. Support, anchoring, stabilization, utility
connections, alterations, and inspections shall comply with applicable federal and state
requirements and the manufacturer's approved installation instructions.
(g) Foundation enclosure. Before issuance of a certificate of occupancy, the open area between
the manufactured home and finished grade shall be enclosed on all sides with securely
installed, weather -resistant skirting intended for permanent exterior foundation enclosure.
The enclosure shall provide required ventilation and inspection access and shall be
maintained in good repair.
(h) Approved enclosure materials. Foundation enclosure shall consist of brick; natural or
manufactured stone; decorative concrete masonry units; fiber -cement products
manufactured for foundation enclosure; a manufactured skirting system designed for
permanent exterior installation; or another durable material approved by the Building Official
as equivalent. Untreated wood, plywood, lattice, wire, plastic sheeting, tarpaulins, exposed
foam insulation, and materials not intended for permanent exterior use are prohibited.
(i) Transport components. Wheels, axles, towing hitches, tongues, drawbars, and similar
transport components shall be removed or fully concealed before final approval, except
when required to remain under the manufacturer's approved installation instructions or
applicable law.
(j) Exterior features and access. The home shall have residential exterior siding and roofing,
finished exterior trim, and permanently installed landings, stairs, guards, and handrails
where required by adopted codes.
(k) Additions and accessory structures. A porch, deck, landing, carport, garage, room addition,
patio cover, or accessory structure shall comply with applicable zoning and construction
regulations and shall be independently supported unless attachment to the manufactured
home is authorized by the manufacturer and applicable federal or state law.
(1) Parking. At least two off-street parking spaces shall be provided for each individual HUD -
code manufactured home.
(m) Address, utilities, and occupancy. The home shall have an official City address and
approved utility connections. The home shall not be occupied until required documentation
has been accepted, required inspections have been approved, parking and foundation
enclosure are complete, and the City has issued a certificate of occupancy.
(n) Review period. An application to install a new HUD -code manufactured home for use as a
dwelling is considered granted unless the City denies the application in writing and states
the reason for denial not later than the forty-fifth day after the date the application is
received, as provided by Texas Occupations Code Section 1201.008.
(o) Mobile homes. A mobile home constructed before June 15, 1976, shall not be newly placed,
relocated into, or relocated within the City. A mobile home lawfully located within the City
before the applicable prohibition may remain as a legal nonconforming use or structure
subject to the nonconforming -use, property -maintenance, unsafe -structure, and nuisance
regulations of the City.
SECTION 7. Existing Manufactured Home Park, Subdivision, and Special -Vehicle
Regulations Preserved.
(a) Except for the amendment to Section 4.08.003 expressly made by Section 6 of this
Ordinance, Chapter 4, Article 4.08 remains unchanged.
(b) Division 2, "Recreational Vehicles, Trailers and Other Special Vehicles," including Sections
4.08.031 through 4.08.034, is not repealed or amended by this Ordinance.
(c) Division 3, "Manufactured Home Parks," including Sections 4.08.061 through 4.08.109, is not
repealed or amended by this Ordinance.
SECTION 8. Administration.
(a) The City Planner shall administer zoning and Land Use Matrix determinations under this
Ordinance.
(b) The Building Official shall administer permits, installation documentation, inspections,
construction -code compliance, foundation enclosure, and certificates of occupancy for
individual manufactured homes.
(c) The City Engineer, Fire Marshal, and other City officials shall administer matters within their
assigned authority.
(d) Approval under this Ordinance does not relieve a person from compliance with subdivision
regulations, adopted construction and fire codes, floodplain regulations, utility requirements,
driveway requirements, or other applicable law.
SECTION 9. No Rezoning of Property.
The establishment of the MH Manufactured Housing District does not rezone any property.
Property may be classified or reclassified to the MH District only through the zoning -amendment
procedures required by state law and the Zoning Ordinance.
SECTION 10. Repealer Clause.
That all provisions of the ordinances of the City of Paris, Texas, in conflict with the provisions of
this ordinance are hereby repealed, and all other provisions of the ordinances of the City of
Paris not in conflict with the provisions of this ordinance shall remain in full force and effect.
SECTION 11. Savings Clause.
All ordinances or parts of ordinances in conflict with this Ordinance are repealed only to the
extent of the conflict. No provision of Chapter 4, Article 4.08 or Zoning Ordinance No. 1710 is
repealed except as expressly provided in this Ordinance
SECTION 12. Severability Clause.
If any section, subsection, sentence, clause, phrase, or provision of this Ordinance is held
invalid, unconstitutional, or unenforceable by a court of competent jurisdiction, such holding
shall not affect the validity of the remaining portions, and the City Council declares it would have
adopted the remaining portions despite such invalidity.
SECTION 13. Penalty Clause.
A person violating a provision adopted or amended by this Ordinance commits an offense and,
upon conviction, is subject to the penalty provided by Section 1.01.009 of the Code of
Ordinances and applicable law. Each day a violation continues constitutes a separate offense.
The City may also pursue civil, administrative, equitable, injunctive, abatement, or other
remedies authorized by law.
SECTION 14. Effective Date.
This Ordinance shall become effective immediately upon passage and publication as required
by law.
