Center Street, Paris, Texas with the following members present: 1. Reeves Hayter 2. Barbara Forrest 3. Richard Hunt 4. Bobby L. Myers 5. Marshall Kent Lisa Wright, Director of Community Development, was also present. 1. The meeting was called to order by Chairman Reeves Hayter. 2. Approval of minutes from previous meetings. (October 3, 2005, Regular Meeting) Motion was made to approve the minutes by Bobby Myers, seconded by Marshall Kent. Motion carried by a vote of 5 ayes and 0 nays. 3. Public Hearing to consider the petition of Thou Chan for a change in zoning from a One-Family Dwelling District No.2 (SF-2) to a Two- Family Dwelling District (2F) on Lot 1, City Block 255-A, being number 204 25th Street NE. The public hearing was declared open. Thou Chan spoke in favor of the petition stating that she bought the home on 25th NE a long time ago and wanted to repair it but it is too old. She wants to build two 2 bedroom duplexes that will look similar to the others in the neighborhood with a brick exterior. The public hearing was declared open. Caroline Dangerfield, 261 25th Street NE, has owned this lot for 3 years and cannot put anything on it. There is one house with the lot overgrown on this side of the street. Ms. Dangerfield thinks that a manufactured home will add to the appearance of the neighborhood. Beverly Yates spoke on behalf of her parents, A.J. and Ann Johnson, who lives at 1031 7 ~ Street NE. Ms. Yates stated that her parents wanted to know what type of home was being proposed to go onto the lot. Ms. Dangerfield stated that it is a double-wide manufactured home with 3 bedrooms and 2 baths-she would be living there. There was no opposition, the public hearing was declared closed. 6. Motion was made by Barbara Forrest to deny, seconded by Marshall Kent. There were no manufactured homes in the area and there are brick homes in the area-the area seems to be improving. Motion to deny carried 4 ayes and 1 nay. 7. Public Hearing to consider the petition of Victor Chavez for a change in zoning from a Multiple-Family Dwelling District No.1 (MF-l) to a Neighborhood Service District (NS) on Lot 1 and W 15' of Lot 2, Block 1 of the Anita Park Addition, being number 1705 Margaret Street. The public hearing was declared open. Victor Chavez, 21412 Street NE, would like to build a bakery at this location. His plans are to live there eventually. Phil Hamilton, 1734 Margaret Street, in support of the petition stating that he does not believe that Multiple Family is the best zoning for this address. Mr. Hamilton said that he does not want to see an apartment complex come into the neighborhood. He believes that Neighborhood Service would be appropriate zoning and welcome Mr. Chavez to the neighborhood. Marvin Cannon, 1750 Margaret and Brenda Lee, 1745 Margaret, were also in favor of the zoning change. Joe Iglehart who owns the house across the street did not oppose the zoning change but wanted to know if the downstairs would be the bakery and upstairs be the living quarters. Victor Chavez stated that his intentions were to have two buildings on the property, a bakery and a house. T- Planning and Zoning Minutes November 7, 2005 Page 4 Lisa Wright advised that Mr. Chavez could not put a commercial building and a house on the property because of the residential zoning. Mr. Chavez said the building would face 17th Street with the bakery in the back and the parking lot would be in front of the structure. The front will be brick with metal on the back. There will be 8 or 10 parking spaces. The building will be 30 x 30. Mr. Chavez will have a picture of the proposed building at the next Council Meeting. There was no opposition, the public hearing was declared closed. 8. Consideration of and action on the petition of Victor Chavez for a change in zoning from a Multiple-Family Dwelling District No.1 (MF-l) to a Neighborhood Service District (NS) on Lot 1 and W 15' I of Lot 2, Block 1 of the Anita Park Addition, being number 1705 Margaret Street. Motion was made by Bobby Myers, seconded by Richard Hunt to recommend the zoning be changed to PD-a (Retail Center). Motion carried by a vote of 5 ayes and 0 nays. 9. Public hearing to consider the petition of Bobby Smallwood for a change in zoning from an Agricultural District (A) to a Planned Development District - Office Center (PD-f) on a 5.574 acre tract of land located to the east of Townwood Estates #1 at the east end of Levi Lane, which tract is part of a called 99.54 acre tract of land described in a deed to the Townwood Development Company, Inc. and recorded in Volume 511, Page 188 of the Real Property Records of Lamar County, Texas. The public hearing was declared open. There was no one present to speak in favor of the petition. y- r Planning and Zoning Minutes November 7, 2005 Page 5 Richard Culver, 1130 Levi T ,ane, opposed the request stating that he is concerned about traffic that will funnel in on the residential street and also about property values. Lisa Wright received a letter from Mr. Culver with signatures opposing the zoning change. Michael Zanchi, 1125 Levi Lane, opposed the request. Mr. Zanchi recently purchased his home and stated that his purchase would have been impacted had he known that this was going on. Mr. Zanchi expressed traffic and safety concerns for children. Mr. Zanchi would like to see it developed in the fashion that it currently is. Myra Zanchi Woodall, opposed the request stating that more people on the street would be opposed but the are not within 200' of the property. Raphael Lui, 1140 Levi Lane, spoke in opposition himself and also on behalf of his wife who opposes the change. Mr. Lui states that he will be directly impacted by the multi office building and property values will also be depressed. Glenn Goode, 1110 Levi Lane, spoke in opposition stating that he wanted a quiet neighborhood for his 3 small children. Mr. Goode stated that it was an ideal move for his family, a dead end street, next to the movies and Chili's but he is concerned that this office building will create a lot of traffic. He had hoped that the property would appreciate over time. There was no further opposition, the public hearing was declared closed. 10. No action was taken on this item. Reeves Hayter had to be recused which left no quorum, therefore, this item could not be considered. 12. Consideration of and action on the Final Plat, Lot 5, Block A of the Industrial Park #1, being number 1810 Loop 286 SW. Motion was made to approve by Reeves Hayter, seconded by Barbara Forrest subject to the City Engineer's memo dated, November 4, 2005. Motion carried by a vote of 5 ayes and 0 nays. 13. Consideration of and possible action on the Final Plat of Lot 4 of the East Park Center, Toyota of Paris. Motion was made to approve by Bobby Myers, seconded by Reeves Hayter, subject to the City Engineer's memo dated November 3,2005. Motion carried by a vote of 5 ayes and 0 nays. 14. Dennis Chalaire is requesting that the property located on Lot 4, Block 318, of East Park Center, being number 3235 Loop 286 N.E., be rezoned from an Agricultural District (A) to a Commercial District (C). A portion of this lot is currently zoned Commercial (C); however, when the lot was replatted to enlarge its size, it took in property currently zoned Agricultural (A). The Comprehensive Plan recommends that this area be zoned retail/commercial. 2. Donna L. Moore is requesting that the property located on Lots 2 and 3, City Block 36, being number 546 Pine Bluff, be designated as Historic Overlay District No. 14 (HD-14). The property is currently zoned Multi pIe Family Dwelling District No. 1 (MF -1), and this overlay zoning will not affect the existing use. The Historic Preservation Commission has recommended approval of this request, and this request is not inconsistent with the Comprehensive Plan. 3. Rita Buford is requesting that the property located on Part of Lot 4, City Block 29, being number 617 E. Houston Street, be rezoned from a Multiple-Family Dwelling District No.1 (MF -1) to aN eighborhood Service District (NS). The Comprehensive Plan recommends that this area be zoned Medium Density Residential. 4. Kaufman, Paris, Texas with the following members present: 1. Reeves Hayter 2. Barbara Forrest 3. Russell McCain 4. Richard Hunt 5. Brad Archer 6. Marshall Kent 7. Benny Plata 8. Bobby Myers Lisa Wright, Director of Community Development, was also present. 1. The meeting was called to order by Reeves Hayter. 2. Approval of minutes from previous meetings. (November 7,2005, regular meeting and November 14,2005, special meeting). Motion was made to approve the minutes by Bobby Myers, seconded by Russell McCain. Ms. Bush stated that Ms. Moore bought the O'Neal house, and her plans are to restore with probably no changes made to the outside. Houston Street. The public hearing was declared open. Rita Buford bought a home on 3rd Street NW that was on the National Registry in 1988. Mrs. Buford stated that all of the property that she and her husband own is well maintained. Their son bought 2 rental houses on E. Houston Street, which they have leveled and redone inside and out. Ms. Buford is wanting to open a retail store, and she provided the Commission with a list of items she proposed to sell. If the zoning is approved, she and her husband will sell their 4,000 square foot home and move next door to this location. She stated that she had planned to put in a beauty salon, but that the person cutting hair wanted to work late at night, so she changed her mind and instead wants to sell antiques and other retail items. Lisa Wright advised the Commission that Mrs. Buford had originally requested to put in a beauty salon only, so Neighborhood Service was recommended. She stated that the Commission could approve NS with a Specific Use Permit to allow for the sale of antiques; however, the other items on her list could not be sold in NS zoning. The home will not be moved because the wheels will be removed. He was okay with a bakery run from the home, but this has changed and he does not think it creates an appropriate transition to the Commercial businesses around it. Joe Iglehart, 1700 Margaret, echoed Mr. Hamilton's sentiments. Also, he was concerned about parking and what the building would look like. Lisa Wright explained that the City Council referred this item back to the Planning and Zoning Commission for reconsideration to allow Mr. Smallwood time to meet with the developers to come up with an alternative access route to the property to reduce the impact on Levi Lane. The public hearing was declared open. Bobby Smallwood, 343 FM 2121, spoke in favor of the petition stating that he sold the property to doctors and they are wanting to put in offices. He advised that the new owners also owned a strip of land alongside Honda, but they did not wish to build an entrance there and planned to use Levi Lane as the access point to the development. Richard Culver, 1130 Levi Lane, spoke in opposition to the petition, stating that he does not want to be surrounded by business property. He is concerned about the impact on home values-the values are already depressed and this will further the depression. Glenn Goode, 1110 Levi Lane, spoke in opposition to the petition stating that he purchased his home 6 weeks ago. He knew that the movies and Chili's was already there.
