02-A Bldg & Stand Com Min 12-19-05 MINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION Monday, December 19, 2005 4:00 P.M. 1. Chad Brown called the Building and Standards Commission Meeting to order at 4:10 P.M. Roll was called. A. The following members were present: Pike Burkhart, Alternate Chris Brown, Alternate Chad Brown Stephen Brown, Alternate Harrell Tippitt Mary Crumpler B. The following members were absent: Brad Archer Ryan Lassiter Zach Saffle, Alternate Greg Wilson Lucius Joe, Jr. 2. Approval of Minutes of previous meeting: A motion was made by Stephen Brown to approve the meeting minutes, and Pike Burkhart seconded the motion. The motion carried unanimously. 3. Public hearing to consider the presentations by City of Paris Code Inspectors and owner(s) and/or lien holder(s) ofthe below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled A Substandard and Dangerous Buildings and Structures: A. 1030 Park Street, Lots 7, 8, and 9, Block 5, Smith's 1st Addition Motion was made by Mary Crumpler, seconded by Harrell Tippitt for the property to be demolished within 30 days with a $1,000 per day civil penalty and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. B. 1025 Park Street, Part of Lot 11 and Lot 12, Block 9, Smith's 1st Addition The door to the structure is open, there are broken windows, interior is not in good condition, and the roof is deteriorating. Motion was made by Pike Burkhart, seconded by Mary Crumpler for the property to be demolished within 30 days with a $1,000 per day civil penalty and if the property is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. ..- .. r C. 123115th Street N.W., Lot 14, City Block 233 Motion was made by Chad Brown, seconded by Pike Burkhart for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. D. 1020 28th Street N.W., Lot 2, Block 5, Cedar Hill Addition Emma McAfee thinks that she owns this property also. She was expected to attend the meeting but was not present. Motion was made by Chad Brown, seconded by Stephen Brown for the building to be demolished within 30 days with a $1,000 per day civil penalty and ifthe building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. E. 1010 28th Street N.W., Lots 1 and 32, Block 5, Cedar Hill Addition Motion was made by Harrell Tippitt, seconded by Mary Crumpler for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. F. 2885 Colvin Street, Lot 11, Block 1, Cedar Hill Addition Motion was made by Mary Crumpler, seconded by Chad Brown for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. G. 2875 Colvin Street, Lot 12, Block 1, Cedar Hill Addition Motion was made by Chad Brown, seconded by Mary Crumpler for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. H. 2265 W. Campbell Street, Lot 1, City Block 237-A Motion was made by Pike Burkhart, seconded by Harrell Tippitt for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. I. 1029 4th Street N.E., Lot 7, Block 1, Washington Heights Addition Motion was made by Stephen Brown, seconded by Harrell Tippitt for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. J. 910 3rd Street N.E., Lot 1, City Block 74-C This building is an old church with fire damage. There was no contact from the Church. Motion was made by Pike Burkhart, seconded by Mary Crumpler for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. K. 766 3rd Street N.E., Lot 6, City Block 75 Billy Brown stated that they are having trouble finding someone to demolish the building and would like an extension of 90 days to give them time to find someone. His sister is wanting to rebuild on the same property. Motion was made by Chad Brown, seconded by Chris Brown that the building be secured within 21 days and then demolished within 60 days with a $1000 per day civil penalty and, if the building is not demolished within the 60 day time period, the City will demolish the building. Motion carried unanimously. L. 425 2nd Street N.E., Lot 15, City Block 76 Motion was made by Mary Crumpler, seconded by Harrell Tippitt for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried 5-0 (Stephen Brown left the meeting momentarily). M. 403 1st Street N .E., Lot 13, City Block 77 There is a nursery school behind this house that has been broken into. Motion was made by Pike Burkhart, seconded by Chris Brown for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried 6- o (Stephen Brown returned to the meeting). N. 333 1st Street N.E., Lot 4, City Block 57 Motion was made by Chad Brown, seconded by Stephen Brown for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. o. 990 W. Henderson Street, Lot 7, City Block 100-C The owner will try to demolish the building. Motion was made by Chad Brown, seconded by Mary Crumpler for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. P. 1019 3rd Street S.E., Lot 44, City Block 160 Motion was made by Mary Crumpler, seconded by Stephen Brown for the building to be demolished within 30 days with a $1,000 per day civil penalty and if the building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. Q. 301 E. Jackson Street, Lot 31, City Block 160 Mr. Gray stated that he does not own the house but he would like to have the property. Whenever he gets permission from his brothers and sisters, he will tear the house down. Motion was made by Chris Brown, seconded by Mary Crumpler for the house to be demolished within 30 days with a $1,000 per day civil penalty and ifthe building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. R. 655 Graham Street, Lot 3, City Block 44 Mr. Talley advised that ownership ofthe property is not clear because LCAD records list several owners. He stated that a fire occurred about 5-6 months ago with 60-70% destruction to the buildings, but there was no fire damage to the north end of the building. Mary Crumpler stated that the structure is a hazard to kids, and Robert Talley stated that the buildings are close to a school bus stop. Lisa Wright advised the Commission that she was aware of a sales contract on the property and that she provided a courtesy notice of the meeting to the realtor, so she was surprised no one was present. She recommended to the Commission that they order securing of the structure since the cost of demolition would be very high; this way the City could at least make sure the property was somewhat safe until funds were available for demolition in the event the City had to tear it down. Motion was made by Mary Crumpler, seconded by Harrell Tippitt for the structure to be demolished within 30 days with a $1,000 per day civil penalty, and if the building is not demolished within the 30 day time period, that the City will demolish; also the property must secured within 14 days, and if the property is not secured, then the City will secure. Motion carried unanimously. Pike Burkhart would like for the City to look into civil action-the committee agreed with this suggestion. Pike Burkhart thinks that the City should move as quickly as possible to determine what legal action can be taken. S. 339 4th Street S.W., Lot 26, City Block 118 Robert Talley advised the Commission that they had previously heard from Jacob McCullough who stated that he does not own this property. The City has determined that he does; however, Mr. McCullough received the letter but did not respond. T Motion was made for the house to be demolished within 30 days with a $1,000 per day civil penalty and ifthe building is not demolished within the 30 day time period, the City will demolish. Motion carried unanimously. 4. Receipt of report from the Historic Preservation Commission regarding structures considered by code inspectors to be in violation of Article III of Chapter 7 of the Code of Ordinances ofthe City of Paris, Paris, Texas, entitled "Substandard and Dangerous Buildings and Structures," and found to be buildings or structures that can be rehabilitated and designated on the National Register of Historic Places, as a recorded Texas Historic Landmark, or as historic property as designated by the City Council of the City of Paris.
