2006-004-ORD Amendment to correct a reference Airport Manager may issue or renew permits ORDINANCE NO. 2006-004 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF PARIS, PARIS, TEXAS, BE AMENDED BY REVISING SECTION 6-22(a) OF SAID CODE TO CORRECT A REFERENCE CONTAINED THEREIN; REVISING SECTION 6-22(b) OF SAID CODE TO PROVIDE THAT THE AIRPORT MANAGER MAY ISSUE OR RENEW PERMITS FOR AERONAUTICAL ACTIVITIES TO APPLICANTS WHO COMPLY WITH THE PROVISIONS OF CHAPTER 6 OF SAID CODE; PROVIDING FOR A PENALTY NOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. WHEREAS, Section 6-22 of the Code or Ordinances establishes the procedure for issuing aeronautical activities at Cox Field Airport; and, WHEREAS, Section 6-22(a) of said Code contains an error in that it references subsection (e) instead of subsection (d) of Chapter 6, which is the subsection containing the insurance requirements for obtaining a permit; and WHEREAS, additionally, the procedure currently provides for issuance of permits by the Airport Manager; however, it also provides that those permits shall be reviewed annually by the Airport Advisory Board and the City Council, who have historically followed the recommendation of the Airport Manager; and, WHEREAS, in order to make the issuance and renewal of permits faster and more convenient for individuals or businesses wishing to conduct an aeronautical activity at Cox Field Airport, the Airport Advisory Board has requested that the Airport Director look into ways to revise the procedure to allow the Airport Manager to issue or renew permits throughout the year to any applicant who complies with the provisions of Chapter 6; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS: Section 1. That the findings set out in the preamble to this ordinance are hereby in all things approved. Section 2. That Section 6-22(a) of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, corrected so that such shall read as follows: "Sec. 6-22. Permits for aeronautical activities. (a) No person shall engage in an aeronautical activity at Cox Field without first having obtained a permit therefor from the Airport Manager. The City Clerk will provide an application for such a permit to all persons desiring the same. The Airport Manager will maintain forms for application for aeronautical activities, which may be procured by persons desiring to engage in such activity at Cox Field. A permit shall be granted if the grantee agrees to comply with all relevant provisions of this article and presents proof of the insurance required under paragraph (d) of this section." Section 3. That Section 6- 22(b) of the Code of Ordinances of the City of Paris, Paris, Texas, be, and the same is hereby, amended so that such shall read as follows: "Sec. 6.22. Permits for aeronautical activities. (b) Permits may be issued or renewed at any time by the Airport Manager to any applicant who is found to be in compliance with all relevant provisions of this Article and applicable laws. " Section 4. Any person violating any of the provisions of this ordinance shall be guilty of a Misdemeanor and, upon conviction, shall be fined in any sum not to exceed $2,000.00, and each and every day's continuance of any violation of the above-enumerated section shall constitute and be deemed a separate offense. Section 5. All ordinances or parts of ordinances in conflict herewith are hereby expressly repealed. Section 6. This ordinance shall become effective on February 1,2006.
