03 City Council Min 01-23-06 REGULAR MEETING OF THE CITY COUNCIL, CITY OF PARIS January 23, 2006 1. The City Council of the City of Paris met for a regular session at 6:00 P. M. Monday, January 23,2006, at the City Council Chamber, 107 E. Kaufman, Paris, Texas. Present: Mayor: Curtis Fendley Council Members: Tim Ray; Richard Manning, Mayor Pro Tern; Mary Ann Fisher; Karen Wilkerson; Rick Poston; and Don Wilson City Staff: Tony N. Williams, City Manager; John Lestock, Assistant City Attorney; and Janice Ellis, City Clerk CONSENT AGENDA Mayor Fendley inquired if there were any items that Council Members wanted to pull and discuss from the Consent Agenda. There were none. Upon a motion made by Council Member Ray and a second by Council Member Fisher, the Council voted seven (7) for and none (0) opposed to approve and adopt the Consent Agenda, Items 2A, 2B, and 2C follows: 2. Receipt of reports and/or minutes from committees, boards, and commissions: A. Building and Standards Commission. (12-19-05) B. Historic Preservation Commission. (12-19-05) C. Library Advisory Board. (12-14-05) 3. Consideration of and action on the following ordinances: A ORDINANCE NO. 2006-004: AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, PROVIDING THAT THE CODE OF ORDINANCES OF THE CITY OF PARIS, PARIS, TEXAS, BE AMENDED BY REVISING SECTION 6-22(a) OF SAID CODE TO CORRECT A REFERENCE CONTAINED THEREIN; REVISING SECTION 6-22(b) OF SAID CODE TO PROVIDE THAT THE AIRPORT MANAGER MAY ISSUE OR RENEW PERMITS FOR AERONAUTICAL ACTIVITIES TO APPLICANTS WHO . -. -T' Regular City Council Meeting January 23, 2006 Page 2 COMPL Y WITH THE PROVISIONS OF CHAPTER 6 OF SAID CODE; PROVIDING FORA PENAL TYNOT TO EXCEED $2,000.00; REPEALING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE. Council Member Manning wanted to know if a person taking flying lessons had to obtain a permit from the airport manager. Lisa Wright told Council the instructor had to obtain the permit. Lisa explained to Council that currently permits are renewed annually, and they go before the airport manager, airport advisory board, and then to Council. Lisa further explained this would streamline the process in that the airport manager could issue the permit as they come due. She said that the airport manager would make sure that requirements are met. A Motion to approve this item was made by Council Member Wilson and seconded by Council Member Poston. Motion carried, 7 ayes - 0 nays. 4. Consideration of and action on the following resolutions: A. RESOLUTION NO. 2006-009: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF P ARIS, PARIS, TEXAS, AUTHORIZING THE EXECUTION OF A TAX SALE DEED FOR LOT 12, CITY BLOCK 52, BEING LOCATED AT 714 GRAHAM STREET; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. Council Member Manning stated he had a letter that reflected 314 Graham Street; however, the Deed and Resolution reflected 714 Graham Street. John Bolstrom, tax attorney with Linebarger, informed Council that the correct address was 714 Graham Street. A Motion to approve this item was made by Council Member Manning and seconded by Council Member Fisher. Motion carried, 7 ayes - 0 nays. B. RESOLUTION NO. 2006-010: A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS, PARIS, TEXAS, APPROVING THE GROUNDS SUBLEASE BETWEEN THE RED RIVER VALLEY FAIR ASSOCIATION, INC. AND RENO FIRE AND RESCUE, A TEXAS CORPORATION; MAKING OTHER FINDINGS AND PROVISIONS RELATED TO THE SUBJECT; AND PROVIDING AN EFFECTIVE DATE. l' Regular City Council Meeting January 23, 2006 Page 3 A Motion to approve this item was made by Council Member Wilson and seconded by Council Member Poston. Motion carried, 7 ayes - 0 nays. 5. Presentation on status of revising mobile home ordinance. Lisa Wright told Council that Planning and Zoning had requested her to do additional research and wanted to review this item again at their February meeting. 6. Presentation by City Staff regarding the wage and salary survey and possible update thereof. Tony Williams presented Council with a salary survey to Council. He explained the survey included ten other cities, as requested by Council. Tony asked Council to study the survey and set a workshop session to go through the survey position by position. In small cities, there are many times that a person does several jobs. Council Member Wilson asked for additional information regarding the budget of those other cities and their benefit packages. He also asked for supplemental information outlining details of the EMS and Fire Departments, because some cities have them under one department. Council agreed to include this item for discussion in the special session for Monday, February, 6, 2006 at 6:00 p.m. 7. Discussion on the status of trash service within the City of Paris. Tony advised Council that beginning October 2005, changes were put into place. We have gone to four ten hour days and reduced the trucks and routes to four. We kept the same pick up days. We have changed our bulk pickup service from Wednesdays to the second pickup day of the week for that residence. Tony showed Council fifteen photographs of bulk waste. Those photographs included construction debris, four refrigerators at one house, old tires, and bulk trash left behind when tenants were evicted. Tony told Council that it costs the city to dispose ofthese tires, because they cannot be placed in the landfill. Tony further stated the fee of $14.00 per month does not cover the costs and labor ofthe service, but that it is more like $18.00 per month. He asked Council to consider making changes to the bulk pickup service to address the number of items and the fees involved, so as not to allow the abuse to our taxpayers to continue. Tony informed Council that the landfill would allow the customer to take a pickup load of bulk to the landfill for free, as long as they exhibited a copy of their water bill. Council Member Manning suggested allowing two free items for bulk pickup and charge for the service thereafter. Council Member Wilson thought it would be a good deal to charge according to dimensions ofthe bulk. Council Member Ray thought a flat fee would be better. Mayor Fendley said that he thought a flat fee would still leave room Regular City Council Meeting January 23, 2006 Page 4 for abuse of the service. Tony said staff would like to bring an item to Council at the next regular meeting, which would amend the City's policy on bulk pickup to establish limits and rates. Council Member Wilson asked that a definition for bulk be included in the document. Council Member Fisher said she was still receiving complaints about the trash pickup. She said in some instances it was getting dark before the trash could be picked up, and it was being left out until the next morning. Tony told Council he believes that making a change in the bulk pickup will help these type of situations. Council Member Wilson said that we need to have trash service the day after Christmas, because he had more complaints about that than anything else. Council Member Ray said he also thought there should be service the day after Christmas. Council Member Manning said he had one complaint from a citizen regarding selective pickup from another house. Mayor Fendley said he had received nothing but positive comments. 8. Citizens Forum. No one spoke. 9. Possible future agenda items. Tony Williams - a change order for the Police and Courts Building. Council Member Wilson - disannexation on South Church Street. 10. Referrals. Bobby Floyd - Lot 6, City Block 331,3625 Loop 286 N.W. 11. There being no further business, the meeting was adjourned.
