RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF PARIS,
PARIS, TEXAS, APPROVING A REQUEST FOR A NEW PRO RATA
WATER MAIN EXTENSION TO SERVE THE AREA ALONG A PORTION
OF 42ND STREET S.E., A PRIVATE ROAD, BEGINNING AT OLD
CLARKSVILLE STREET AND ENDING ON THE NORTH SIDE OF
HIGHWAY 271 SOUTH; MAKING OTHER FINDINGS AND PROVISIONS
RELATED TO THE SUBJECT; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Paris did heretofore receive a request for
additional water pressure and service requiring an 8"" water main extension to serve the area
bounded on the South by Highway 271, on the North by the north boundary line of Lot 2, City
Block 347, on the East by private road right-of-way (known as 42nd Street S.E.), City Block 353,
and on the West by Lot 2, City Block 347; and,
WHEREAS, it is deemed necessary for protection of the health and welfare of the above-
described area for the City of Paris to extend the above-described line and act in the capacity
of sponsor under the terms of Section IX of Subdivision Ordinance No. 1315 of the City of
Paris, with any refunds due under the pro rata charges being paid to the City of Paris water and
sewer fund; and,
WHEREAS, upon receipt of the above-described request, preliminary plans,
specifications, and estimates of the total cost ofthe project were prepared and delivered to the
City Manager and considered at the regular Council Meeting on the 9th day of January, 2006,
and a public hearing concerning the same was set for the 13th day of February, 2006, at which
time such public hearing was held; and,
WHEREAS, after hearing the matters presented at the public hearing, the City Council
is of the opinion that it is in the best interests of the citizens of Paris, and particularly the citizens
in the vicinity of the proposed project, that the City of Paris act as sponsor for said project,
which is necessary for the protection of health and welfare in this area; and,
WHEREAS, such project should be known as the "Pro Rata 8" Water Main Extension
42nd Street S.E. Project," which has a total estimated cost of$29,176.65; and,
WHEREAS, the front foot method would be equitable and is the method described on
Exhibit A attached hereto; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, PARIS,
TEXAS:

Section 1. That the findings set out in the preamble to this resolution are hereby in all
things approved.
Section 2. That the pro rata 8"water main extension to serve the area bounded on the
South by Highway 271, on the North by the north boundary line of Lot 2, City Block 347, on
the East by private road right-of-way (known as 420d Street S.E.), City Block 353, and on the
West by Lot 2, City Block 347, containing approximately 1,015 linear feet of8" P.V.C. water
main, be, and the same is hereby, approved and shall be known as the "Pro Rata 8" Water Main
Extension 420d Street S.E. Project".
Section 3. That the City of Paris act as sponsor of said pro rata water main extension.
Section 4. That the front foot rule is the method described in Exhibit A attached hereto,
less the cost of oversizing, is found to be equitable and is adopted as the method to be used for
refunding the cost of the water and sewer main extension to the water and sewer fund of the
City of Paris; and,
Section 5. That the City Manager be, and he is hereby authorized and directed to
proceed with said project and that a pro rata contract is waived with regard to this project, but
upon completion of the project the actual costs of said project shall be fixed and the price per
foot established in accordance with the plan described in Exhibit A attached hereto, which shall
be used for the purpose of the charging ofthe pro rata charges to the property owners benefitting
from the same and the amounts to be collected in the event of connection to the line so
constructed and paid to the water and sewer fund of the City of Paris.
