1994-074-RES WHEREAS, the City Council of the City of Paris has received Action in the City of Port Arthur vs.
RESOLUTION NO. 94-074
WHEREAS, the City Council of the City of Paris has received Notice of Class
Action in the City of Port Arthur vs. Southwestern Bell Cause No. D-142,176 wherein
the class seeks payment of various percentages of gross receipts derived from the rendition
of "local exchange telephone transmission service"; and,
WHEREAS, the City Council finds that it is in the best interest of the citizens of
the City of Paris to pursue this claim for underpayment of fees by being included within
the class; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that
the City Attorney, T. K. Haynes, be, and he is hereby authorized and directed to proceed
to take action to include the City of Paris in the Class Action in the City of Port Arthur
vs. Southwestern Bell, Cause No. D-142,176, and that the City Manager of the City of
Paris, Michael E. Malone, be, and he is hereby authorized and directed to execute on
behalf of the City of Paris, any required instruments or pleadings.
