1994-063-RES WHEREAS, the City Council of the City of Paris did heretofore in 88-044 authorize a 15 % penalty to be RESOLUTION NO. ~ WHEREAS, the City Council of the City of Paris did heretofore in Resolution No. 88..044 authorize a 15 % penalty to be added to the delinquent tax accounts in accordance with Section 33.07 of the Texas Property Tax Code; and, WHEREAS, in order to add the 15 % penalty to tax accounts which are delinquent on July 1 of a year, it is necessary for the governing body to direct that the same be added thereto and that the governing body enter into contract with an attorney for the purpose of collection of the delinquent tax accounts; and, WHEREAS, the City Council of the City of Paris deems it to be in the best interest of the citizens of Paris to engage Thomas E. Hunt, III, as delinquent tax collection attorney using the professional service contract in the form attached hereto as Exhibit A; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OJ' PARIS, that the form of the Professional Service Contract for delinquent tax collection, by and between the City of Paris and Thomas E. Hunt, III, dated June 13, 1994, attached hereto as Exhibit A, is hereby approved; and, BE IT }WTHER RESOLVED, that the Mayor of the City of Paris, Don Shelton, be, and he is hereby authorized and directed to execute on behalf of the City of Paris, the Professional Service Contract for delinquent tax collection with Thomas E. Hunt, III. PASSED AND ADOPTED this 13th day of June, 1994. ATTEST: '-m\\-n~l~~~~ Mattie Cunningham, City erk ..~ PROFESSIONAL SERVICE CONTRACT STATE OF TEXAS } COUNTY OF LAMAR } This contract, entered into this 13th day of June, 1994, by and between the City of Paris, a municipal corporation of Lamar County, Texas, hereinafter referred to as CITY, and Thomas E. Hunt, III, an attorney licensed to practice law by the State Bar of Texas, a citizen of the City of Paris, Lamar County, Texas, hereinafter called HUNT, wherein the parties contract and agree as follows: 1. That HUNT agrees to serve as Delinquent Tax Collection Attorney from July 1, 1994, through June 30, 1996, performing those duties in accordance with the Texas Property Tax Code. 2. That CITY agrees to pay HUNT for his services as Delinquent Tax. Collection Attorney, fifteen percent (15 %) of additional penalty assessed against ad valorem taxes payable to CITY and delinquent on July 1, 1994, and each year thereafter, and all other attorney fees permitted to be charged by the Texas Property Tax Code upon which tax suits have been moo.
