1994-041-RES WHEREAS, ON SEPTEMBER 9, 1993 COP DID APPROVE LOTS 1, 2 & 4 BLOCK A MORNINGSIDE
RESOLUTION NO. 94-041
WHEREAS, on September 9, 1993, the City of Paris did approve the Replat
of Lots 1, 2, & 4, Block "A", Morningside North #1 which contained a 15 foot
utility easement across Lot 4; and,
WHEREAS, the City of Paris finds no need for a portion of said utility
easement, said portion being 102.9 feet in length adjacent to the north boundary line
of said Lot 4 as described in Exhibit A attached hereto, and the same should be
abandoned; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
that the Release and Quitclaim giving a portion of the original utility easement
located on Lot 4 as shown in the Replat of Lots 1, 2, & 4, Block" A", Morningside
North #1, back to Bobby J. Floyd and wife, Jan Floyd, in the form attached hereto
as Exhibit A, be, and is hereby approved.
BE IT FURTHER RESOLVED, that the Mayor of the City of Paris, George
Fisher, be, and he is hereby authorized and directed to execute on behalf of the City
of Paris the Release and Quitclaim in the form attached hereto as Exhibit A.

The City of Paris, a municipal corporation, by and through George Fisher,
its Mayor, for and in consideration of the sum of ONE DOLLAR ($1.00) and other
good and valuable consideration, to us in hand, the receipt of which is hereby
acknowledged by the City of Paris, does hereby abandon and quitclaim unto BOBBY
J. FLOYD and wife, JAN FLOYD, of the county of Lamar, state of Texas, on April
25, 1994, and to their heirs, devisees, or assigns, all the right, title, interest, claim,
demand or use the City may have acquired by a certain Easement shown in the
Replat of Lots I, 2, & 4, Block 'A', Morningside North HI, as recorded in
Envelope 312-0, Plat Records of Lamar County, Texas for utilities under the
hereinafter described premises, more particularly described as follows:
SITUATED within the corporate limits of the City of Paris,
County of Lamar and State of Texas, a part of the Joseph Leach
Survey #524, and being a part of a utility easement and a part of Lot
4, Block" A" Morningside North #1, as shown in the Replat of Lots
1, 2, & 4, Block "A", Morningside North #1, as recorded in Env.
312-0, Plat Records of said County and State.
BEGINNING at point for corner in the NBL of Lot 4 and the
SBL of Lot 3 at the NEC of said Utility Easement, said point being
North 89 Deg. 32 Min. West, a distance of 87 feet from an iron pin
(0 at the NEC of said Lot 4 and the SEC of Lot 3, said point also
being in the NBL of a 0.724 acre tract of land surveyed out of said
Lot 4 and Lot 5.
THENCE North 89 Deg. 32 Min. West along the NBL of Lot
4 at 15 feet passing the SWC of Lot 3 and the SEC of Lot 2, and
continuing with the SBL of said Lot 2 a total distance of 102.9 feet to
a point for corner at an el corner of said Easement, said point being
South 89 Deg. 32 Min. East a distance of 10 feet from an iron pin (s)
in an iron pipe (0 at the NWC of said 0.724 acre tract;
THENCE South 0 Deg. 26 Min. West a distance of 15 feet to
a point for corner;
THENCE South 89 Deg. 32 Min. East a distance of 102.9 feet
to a point for corner;
THENCE North 0 Deg. 26 Min. East a distance of 15 feet to
the place of beginning, containing 1,543.5 square feet, more or less.
