1994-028-RES WHEREAS, COP DOING BUSINESS AS THE PARIS POLICE BEAT THE HEAT RESOLUTION NO. 94-028 WHEREAS, the City of Paris, doing business as the Paris Police Department's Beat the Heat, an affiliate of North Texas Beat the Heat Association, an anti-drug public relations activity, has a need for the use of a 1984 Cutlass to be used for hot-rod racing, and the City Council of the City of Paris is agreeable to encouraging such public relations activity; and, WHEREAS, in order to receive the use of said automobile it is necessary for the City of Paris to enter into an agreement with Billy R. Hill; and, WHEREAS, the form of agreement for such use of said automobile and the contingencies related thereto, attached hereto and Exhibit A, should be in all things approved, and City Manager, Michael E. Malone, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the City Manager of the City of Paris, Michael E. Malone, be, and he is hereby, authorized and directed to execute on behalf of the City of Paris, doing business as the Paris Police Department's Beat the Heat, the agreement with Billy R. Hill for the use of a 1984 Cutlass and the contingencies related thereto, in the form shown in Exhibit A attached hereto. PASSED AND ADOPTED this 11th day of April, 1994. ATTEST: Mattie Cunningham, City Cler Mj::1FO~ STATE OF TEXAS ) ) ) KNOW ALL MEN BY THESE PRESENTS: COUNTY OF LAMAR THAT, the CITY OF PARIS, Paris, Texas, a municipal corporation, doing business as Paris Police Department's Beat the Heat, an affiliate of North Texas Beat the Heat Association, an anti-drug public relations activity, acting by and through its City Manager, Michael E. Malone, duly authorized, hereinafter called CITY, and BILLY R. HILL, hereinafter called CONTRACTOR, do hereby contract and agree as follows: 1. CONTRACTOR shall provide to CITY the use of a 1984 Cutlass, which will be used for the purpose of hot-rod racing. 2. Within or at the end of two (2) years, CITY agrees to return to CONTRACTOR the 1984 Cutlass, or, if said automobile is not returned within or at the end of two (2) years, CITY agrees to pay CONTRACTOR $4,500.00, which is the agreed upon value of said automobile. 3. CITY has the right to unilaterally terminate this agreement at any time. In the event of CITY's unilateral termination of this agreement during the primary term hereof, the CITY is bound to return or pay as agreed in paragraph number 2 above. day of April, 1994.
