1990-016-RES WHEREAS, the City Council of the City of heretofore in Resolution No. 89-137 award the bid the execution
RESOLUTION NO~ 90-016
WHEREAS, the City Council of the City of Paris did
heretofore in Resolution No. 89-137 award the bid and authorize
the execution of a contract with K Mart Corporation for
furnishing of labor and materials and performing all work
required for servicing City of Paris vehicles; and,
WHEREAS, said K Mart Corporation has failed to perform in
accordance with the terms of the contract; and,
WHEREAS, the City Council recommends that the second lowest
bidder, Kwik Kar Lube, 3235 Lamar Avenue, Paris, Texas, be
awarded the bid; NOW, THEREFORE,
BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS,
That the contract heretofore entered into with K Mart Corporation
is cancelled and held for naught.
BE IT FURTHER RESOLVED, That the Mayor of the City of Paris,
Eric S. Clifford, be, and he is hereby authorized and directed to
execute on behalf of the City of Paris the contract for labor and
materials for servicing City of Paris vehicles with Kwik Kar
Lube, upon the terms and conditions and in the form shown in
Exhibit A attached hereto.

KNOW ALL MEN BY THESE PRESENTS:
THAT, the CITY OF PARIS, Paris, Texas, a municipal
corporation, acting by and through its Mayor, Eric S. Clifford,
duly authorized, hereinafter called CITY and Kwik Kar Lube, by
and through its owner, Jenn Sandlin, hereinafter called KWIK KAR,
do hereby contract and agree as follows:
1. To service CITY vehicles in accordance with the
specifications on Exhibit A attached hereto and made a part
hereof.
2. The term of this contract shall be for a period of
twelve (12) months beginning February 12, 1990, and ending on
February 11, 1991.
3. City has the right to unilaterally terminate this
agreement at any time for, failure to perform the required
services as outlined in Exhibit A attached hereto.
Executed this 12th day of February, 1990.
