1998-144-RES WHEREAS, CITY COUNCIL DID HERETOFORE ON THE 4TH DAY OF APRIL RESOLUTION NO. 98-144 WHEREAS, the City Council of the City of Paris did heretofore, on the 4th day of April, 1996, in Resolution No. 96-029, authorize an application to be made to the Texas Department of Housing and Community Affairs for a Community Development Fund Grant under the Texas Community Development Program, for the purpose of funding the construction of sanitary sewer mains to serve the residents on FM 79, 18th Street N.W., 19th Street N.W., and Butler Lane, north of Loop 286 N.W., in the City of Paris; and, WHEREAS, the City Council of the City of Paris did heretofore, on the 10th day of October, 1996, in Resolution No. 96-105, authorize the execution of the Texas Department of Housing and Community Affairs Contract for Community Development Programs, TCDP Contract No. 716641, for the period beginning August 23, 1996, and ending August 22, 1998, for grant funding in the amount of $250,000.00, requiring $114,520.00 to be provided by the City of Paris in the form of local funds from the Water and Sewer Fund and $34,026.00 of in-kind engineering-architectural services and general administration; and, WHEREAS, it is deemed appropriate that said contract be amended to extend the contract period for six (6) months, same being February 22, 1999; and, WHEREAS, the form of Amendment No. I to Texas Community Development Program Contract No. 716641 between the Texas Department of Housing and Community Affairs and the City of Paris, attached hereto as Exhibit A, should, in all things be approved, and the Mayor, Charles H. Neeley, should be authorized to execute the same; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS; that the form of Amendment No.1 to Texas Community Development Program Contract No. 716641 between the Texas Department f Housing and Community Affairs and the City of Paris, attached hereto as Exhibit A, be, and the same is hereby, approved;. and, BE IT FURTHER RESOLVED, that the Mayor, Charles H. Neeley, be, and he is hereby authorized and directed to execute, on behalf of the City of Paris, Amendment No. 1 to Contract No. 716641, under the terms and conditions and in the form shown in Exhibit A, attached hereto. Foster, City Attorney AMENDMENT NO.1 TO TEXAS COMMUNITY DEVELOPMENT PROGRAM CONTRACT NO. 716641 TEXAS DEPARTMENT OF HOUSING AND COMMUNITY AFFAIRS AND THE CITY OF PARIS STATE OF TEXAS COUNTY OF TRAVIS ;;; i' Section 1. The Texas Department of Housing and Community Affairs, an ag~ncy of the State of Texas, hereinafter referred to as "Department", and the City of Paris, hereinafter referred to as "Contractor", do hereby contract and agree to amend their original contract, as initially executed by the Executive Director of the Department effective August 23, 1996, through August 22, 1998, for the performance of community development activities. Section 2. The parties hereto agree to amend the contract identified in Section 1 above by deleting in its entirety Section 2, Contract Period, and replacing it with the following: Section 2. CONTRACT PERIOD This contract and agreement shall commence on August 23, 1996, and shall terminate on February 22, 1999, unless otherwise specifically provided by the terms of this contract. ',ft<. Section 3. The parties hereto agree that this amendment shall become effective on August 22, 1998. Section 4. The parties hereto agree that this amendment shall require no change to previously approved funding. Section 5. The parties hereto agree that all of the terms of the contract identified in Section 1 above shall remain in effect and shall continue to govern except to the extent that they conflict with the terms of this amendment. The parties hereto agree that nothing in this amendment shall be construed as authorizing any violation of federal, state or local laws or regulations as they pertain to the contract identified in Section 1 above. Section 7. By the signing of this amendment, the parties hereto expressly understand and agree that this amendment shall become a part of the contract identified above i:n Section 1 above as though it were set forth word for word therein.
