03 Minutes (2006-02-27) MINUTES OF THE REGULAR MEETING OF THE BUILDING AND STANDARDS COMMISSION Monday, February 20, 2006 4:00 P.M. 1. Chad Brown called the Building and Standards Commission Meeting to order at 4:00 P.M. Roll was called. A. The following members were present: Chad Brown Mary Crumpler Harrell Tippitt Chris Brown, Alternate Zach Saffle, Alternate B. The following members were absent: Pike Burkhart,Alternate Lucius Joe, Jr. Ryan Lassiter Brad Archer Steve Brown, Alternate Greg Wilson 2. Approval of Minutes of previous meeting: A motion was made by Chad Brown to approve the meeting minutes, and Mary Crumpler seconded the motion. The motion carried unanimously 3. Public hearing to consider presentations by City of Paris Code Inspectors and owner(s) and/or lien holder(s) of the below properties who have been given notice of a violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled A Substandard and Dangerous Buildings and Structures: A. 229 5th Street NE, Lot 10, City Block 37 Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. B. 1161 3rd Street NW, Lot 2-A, City Block 97 Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. D. 702 E. Booth, Lot 16, City Block 63-A Foster Stone, 1330 10th Street NE, appeared and said he wants to repair the structure. Work has already begun and can be completed within 30 days. Chad Brown made a motion that the building be repaired within 45 days with a $1,000 per day civil penalty. The motion carried unanimously. E. 720 Grove Street, Lots 8 & 9, Block 1, Estes Addition Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. F. 1180 25th Street NE, Lot S Pt. 25, City Block 259 Robert Talley advised that this structure has fire damage, and animals are getting into it. Gene Rader, 2565 Clark Lane, stated he would try to have the structure torn down within 30 days. Chad Brown made the motion that the building be demolished within 60 days with a $1,000 per day civil penalty and, if the building is not demolished within the 60 day time period, the City will demolish the building. Chris Brown seconded the motion. The motion carried unanimously. G. 365 29th Street NE, Lot 4, Block 4, Springlake Addition Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. H. 11610th Street NE, Lot 9, City Block 32-B Mike and Nell Vaughn stated that their mother owned the house originally but it became tied up in an estate. Ms. Vaughn thinks that the house should be demolished but there is still a lot of her mother's property in the house. The house preceded the Paris fire, it was built in the 1860's. The house was offered to the Historical Society. Mary Crumpler seconded the motion. Motion carried unanimously. I. 1011 E. Houston, Lot 8, City Block 32-B Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. J. 139910th Street NE, Lot 22, Block Q, East Park Addition Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. K. 1350 10th Street NE, Lot 25, Block P, East Park Addition Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. 1. 136410th Street NE, Lot 21, Block P, East Park Addition Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. M. 139112th Street NE, Lot 18-20, Block Q, East Park Addition Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. N. 401 E. Grove, Lot 6, City Block 74-C Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. O. 440 Pine Bluff, Lot 7, City Block 37 Robert Talley stated that Irene Dotson would like 90 days to repair the house. Chad Brown made a motion that the house be repaired or demolished within 90 days with a $1,000 per day civil penalty and, if the house is not repaired or demolished within the 90 day time period, the City will demolish the house. Harrell Tippitt seconded the motion. The motion carried unanimously. P. 636 W. Kaufman, Lot 25, City Block 124 Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. Q. 1230 11th Street NW, Lot 6, City Block 101-A Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. R. 1310 W. Henderson, Lot 11, City Block 101-C Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. S. 3400 Block of NW Loop 286, Lot 7, City Block 324 Ozie Battle, 1715 N. Main #504, said the property belongs to her husband's family of 10 siblings. None of the siblings would agree to sell the property when she had a buyer. There is no way in the world that she can clean the property up. Ms. Battle said that she had given Millie McDonald the names of all the siblings but never heard back from her. The taxes on the property are not current. Chris Brown made the motion that the buildings be demolished within 30 days with a $1,000 per day civil penalty and, if the buildings are not demolished within the 30 day time period, the City will demolish the buildings. Harrell Tippitt seconded the motion. Motion carried unanimously. T. 990 Pine Bluff, Lot 9-A, City Block 34 Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. U. Tract 37, CR 32900 2006-02-20 Minutes.doc Page 4 of 6 Kirk Ballard, 534 CR 140, stated that this is his mother-in-Iaw's land and she is deceased. He has been trying to clean the property up but he needs more time. He has talked with Josh Bray but he is busy right now. Chad Brown made a motion that the building be demolished within 60 days with a $1,000 per day civil penalty and, if the building is not demolished within the 60 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. Motion carried unanimously. V. 239 2nd Street NE, Lot Pt. Lot 2, City Block 39 Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. W. 245 & 253 2nd Street NE, Lot Pt. of 2, City Block 39 Motion was made to recuse Zach Saffle by Chad Brown, seconded by Harrell Tippitt. Motion carried 4-0. Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Chris Brown seconded the motion. The motion carried 4-0. Motion was made by Chad Brown for Zach Saffle to return to the meeting, seconded by Mary Crumpler. Motion carried 4-0. x. 1613 S. Main, Lot 2, Block 1, Neagle Addition Cora Adams, Box 1565, Lindale, Texas, said that she will be retiring soon and wants to know if she can wait a year to build a house on the property. She cannot build a house on the property if there is not already a house on the property. Lisa Wright advised that the program that Ms. Adams is referring to is not available at this time. Ms. Adams stated that she can get her brother to tear the house down. Chad Brown made a motion that the building be demolished within 60 days with a $1,000 per day civil penalty and, if the house is not demolished within the 60 day time period, the City will demolish the house. Zach Saffle seconded the motion. Motion carried unanimously. Y. 1567 S. Main, Lot 7, Block 14, Texas & Pacific Addition Chad Brown made a motion that the building be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish the building. Harrell Tippitt seconded the motion. The motion carried unanimously. z. 1545 S. Main, Lot 10, Block 14, Texas & Pacific Addition 2006-02-20 Minutes.doc Page 5 of6 Charles Council, 630 13th Street SE, stated he is trying to repair the house but needs 60 days. He has cleaned up the yard. Mary Crumpler made a motion that the house be repaired or demolished within 60 days with a $1,000 per day civil penalty and, if the house is not repaired or demolished within the 30 day time period, the City will demolish the house. Chris Brown seconded the motion. Motion carried unanimously. AA. 18 W. Hearne (the building is actually marked 24 W. Hearne), Lots 19,20, & 21, City Block 157 Kenneth Wood, 8303 FM 197, said that he has a demolition permit and has talked with Josh Bray about tearing the structure down. TXU will have the electricity off in 3-5 days. Chad Brown made a motion that the structure be demolished within 30 days with a $1,000 per day civil penalty and, if the building is not demolished within the 30 day time period, the City will demolish it. Harrell Tippitt seconded the motion. Motion carried unanimously. 4. Receipt of report from the Historic Preservation Commission regarding structures considered by code inspectors to be in violation of Article III of Chapter 7 of the Code of Ordinances of the City of Paris, Paris, Texas, entitled .'Substandard and Dangerous Buildings and Structures," and found to be buildings or structures that can be rehabilitated and designated on the National Register of Historic Places, as a recorded Texas Historic Landmark, or as historic property as designated by the City Council of the City of Paris. Lisa Wright reported to the Commission that the HPC had removed a structure on Pine Bluff; however, the house has been sold and the new buyer is making repairs. She stated she did not think the house would be brought to the Commission for action because there would be no need. 5. Status report related to the properties on which the Commission has previously issued orders. Lisa Wright presented the memo to the Commission. 6. Adjournment.
