1998-109-RES WHEREAS, COP DID HERETOFORE IN 1972 RECEIVED RIGHT-OF-WAY DEED RESOLUTION NO. 98-109 WHEREAS, the City of Paris did heretofore, in 1972, receive a Right-of-Way Deed from R. R. Jordan for the purpose of right-of-way for Cardinal Lane and the placement of utilities; and, WHEREAS, the City Council of the City of Paris did heretofore, on the 12th day of January, 1970, by Ordinance No. 1943 assess Lot 9, City Block 312, belonging to Homer Thornton, Jr. the sum of $732.89, which was a curb and gutter and paving assessment; and, WHEREAS, Mr. Thornton was agreeable to pay this assessment, even though there was a small strip of property between his property line and the curb and gutter which did not belong to him, being a part of the property deeded to the City of Paris by R. R. Jordan. The City of Paris has no need or use for this property and it was agreed to be conveyed to Mr. Thornton if he did pay for the curb and gutter adjacent to this property which he did; and, WHEREAS, it is deemed appropriate for the City of Paris to convey this strip of property to Homer Thornton, Jr., and a Special Warranty Deed in the form attached hereto as Exhibit A, should, in all things, be approved, and the Mayor, Charles H. Neeley, should be authorized to execute the same; NOW, THERE}~ORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF PARIS, that the conveyance the property described in the form of a Special Warranty Deed attached hereto as Exhibit A, from the City of Paris to Homer Thornton, Jr., be, and the same is hereby, approved; and, BE IT FURTHER RESOLVED, that the Mayor, Charles H. Neeley, be, and he is hereby, authorized and directed to execute, on behalf of the City of Paris, the Special Warranty Deed, under the terms and conditions and in the form shown in Exhibit A, attached hereto. Thornton, Jr. the receipt and sufficiency of which is hereby acknowledged; has Granted, Sold and Conveyed, and by these presents does Grant, Sell and Convey unto the said Homer Thornton, Jr. of the County of Lamar, State of il Texas, whose mailing address is 1110 36th Street S. E., Paris, Texas 75460, all that certain tract or parcel of land situated in Lamar County, Texas, and described as follows: SITVA TED within the corporate limits of the City of Paris, County of Lamar and State of Texas, a part of the Joseph Leach Survey, and being a part of a tract of land described in deed from R. R. Jordan to the City of Paris, dated April 13, 1972 r~corded in Volume 505, Page 219, Deed Records, Lamar County, Texas, and being more particularly described as follows: BEGINNING at a point in the West Boundary Line of 36th Street S.E., also being the Northeast corner of Lot 9, City Block 312; THENCE North along the West Boundary Line of 36th Street S.E., a distance of approximately 16 feet to a point in the South Boundary Line of Cardinal Lane; THENCE West along the South Boundary Line of Cardinal Lane a distance of approximately 182.5 feet to a point for corner, also being the Northeast corner of Lot 13 of said City Block; THENCE South along the East Boundary Line of said Lot 13 a distance of approximately 5 feet to a point for corner; THENCE South 890 40' 44" East along the North Boundary Line of Lot 9, of said City Block a distance of approximately 182.5 feet to the point of beginning and containing approximately 1,916.25 square feet.
